This while fictional is a great representation of why eye witness accounts cannot be the only evidence used.

I don't understand how the judge could be upset by this. Literally our entire law is based on innocent until proven guilty and he proved that no one, even the guy on the stand, could accurately identify the guy.

it's a stunt that upsets the procedure of court. it's a reasonable belief that the person in the well is the defendant, so Jimmy was effectively lying to the court as well. a real attorney tried something similar and was given contempt for it

@@boinguss yeah see for one that is literally just them trying to find any way to get mad at people using their brains as lawyers there’s nothing lying about having a different person sit in the defence spot and have the person who supposedly saw them. Confirm that that is them that literally is not lying that is using the message. You have available to prove that they do not actually know who it was despite clearly stating that you do which is actual lying

@boinguss I still don't understand, if the "witness" is going to stand up there, define without a doubt and point to the guy. Just to not only be wrong, but it be a totally different guy. That, to me, would be beyond a reasonable doubt and if the case went to a jury trial, he would 100% be let off, simply due to the fact that the witness has no clue who did it. If the only evidence is 1 eye witness and the only thing he had, he isn't sure of. I wouldn't feel comfortable convicting someone of anything.

Cause its obviously deceptive to get a guy that looks just like the defendant and have him sit before the judge while hiding the actual defendant in the back of the court???

The judge is upset because they were kept out of the loop in their own courtroom, which makes the judge look kind of foolish, and judges do NOT like being made fools of in their own court room. If Jimmy had told the judge (and prosecutor) “I want to do a live lineup before the jury”, they’d likely have been fine with it.
