Police swarmed his property and arrested him while the object of the note was standing across the street watching .Hmmm ? That doesn't sound retaliatory at all 🤔

They made their corruption clear. Taping a note to the door of town hall sounds the epitome of demanding redress of grievances, a 1st amendment activity. There was no graffiti, no vandalism, no damage at all except to egos. The chief is obviously a delicate little flower that can't stand criticism and will burn down civil rights for his hurt feelings. What an oath-breaker and traitor to the United States.

It per this case, the new sheriff should be arresting every pet owner who puts a lost pet sign up on a public bulletin board or telephone. Wanna guess how many he’s arrested for that…? @@charliepiland3285 Yes, Good point about pets. Assuming we are operating under "EQUAL JUSTICE UNDER LAW" (Equality), not "This rule is for thee, not me." (Slavery / Fascism). What I wrote is correct. We are living under the Fascist / Feudalistic system created by the Organic Act of 1871 and the 14th Amendment making all Americans Citizen / Slaves. I don't subscribe to the concept of "Parens Patriae", but this is the Doctrine Judges derive their "Authority" (Fraud) from. ALL Judges, Attorneys, and Police are criminals enforcing SLAVERY. Policing is not about Law, Safety, or Justice... Policing is about SLAVERY, keeping the slaves in their place. It's a holdover from the Civil War & Runaway Slave Catchers. Exercising your Rights, makes you a Runaway Slave, and you must be maid to heel (submit)! You will be punished (thrown in jail) before you are convicted, just to teach you not to question Authority.

jury request might not be an option, or it might up to the judge. Judges favor the township, else the Council might not hire him next year. Perhaps in depth investigating of the city's inner working would be interesting to read, but now no one would want to. Risking 30 days in jail? vendetta is frightening. Those street signs are not cheap. Kickbacks are a way of life for spending taxpayer money. Corruption means kickbacks

@@cliffontheroad I think you have a fundamental misunderstanding of how the US system of governance works. Neither the judge (for a bench trial) or the jury (for a jury trial) are there to determine the validity of the law but instead to determine if the defendant violated the proposed law beyond a reasonable doubt. He committed the action which is inline with the definition of vandalism, they have him on video doing it. Technically both a judge or jury (bench or jury trial) could nullify but that sets the precedent that taping something onto a building is not vandalism, which has consequences (should anyone be allowed to tape up anything they want onto that building? and if so where can they do it?). The legislative body over their municipality, not the executive or judicial, is what you seem to have issue with, if the law, as written, is too vague or too far reaching. A judge or solicitor can only do so much interpreting of "or otherwise placed on structure" so it is up to the legislative body to have more precise language and laws as to not force the hand when leniency may be needed.

A jury trial will bring this petty retaliation to more people's attention. This retaliation is not big enough to get the DOJ involved but he can embarrass the people involved and get voters pissed off about how the police and prosecutor are acting.

Clear case of retaliation, based on the content of the man's reporting. Tortured interpretation of the state law quoted. The aggrieved councilman looking on while the arrest takes place. Not sure what the State rules are, but if possible he should demand a jury trial. The townspeople should be ASHAMED of this!

That's what I was thinking as well. More so if there are other signs and such taped to the doors. Well, taped or temporarily fixed to any city property in which no such action was taken against those offenders. Furthermore, he seems to be directing his ire towards a specific public figure. Which because he's a public figure has a heightened threshold of what is allowed for criticism. Because the sign looks like a open and directed criticism which is protected speech under the first amendment and then being arrested for it, likely at the direction of the in question city council member. There's a high chance of success with a lawsuit against the city, possibly the specific counsel member, for first amendment violation on top of retaliation for expressing protected speech. Malicious prosecution might also get swung if the DA doesn't kick the case as far away as possible as quickly as possible.

@terry Vandalism in South Carolina generally requires damage. The Illegal Graffiti Vandalism code doesn't mention damage, but I would argue that it is required.

As soon as he's acquitted, he should file a Federal Lawsuit for Civil Rights Violations. ARRESTED for taping a piece of paper on City Hall = obvious retaliation by the PD/ Mayor.

He could file a criminal complaint under USC title 18 section 242, Depravation of rights under color of law. City and county statutes and codes are NOT laws, and anything repugnant to the Constitution is null and void. Truth is the people need to pull their heads out of their asses and learn their rights to fight these tyrants, until the people do this then tyrants will always impose their tyranny.

The vandalism charge involved consulting the Circuit Solicitor? The SC Attorney General is over solicitors (D.A.’s in other states) in SC & needs to speak on this ASAP as does the SC Supreme Court which handles complaints against magistrates & all lawyers in SC. That solicitor needs to be suspended from office immediately, pending removal, as does the magistrate signing the warrant for going along with idiotic, hayseed politics. Each of them must spend a night in jail when the attorney general charges them with a crime fir what they’ve done.

I'd expect to see the new police force writing citations for posters taped to sign posts, utility poles and along the roadside for realtors, and other quick cash offers. The town will be rich and clean in no time and the jail will be full of desperadoes.

3 of 6 elements are required for a crime to occur; Victim + Bodily Injury, Property Damage, Fraud, or Mischief + Intent. I fail to see how a paper sign meets this criteria. FREE SPEECH is a Right, Public Notice is a Right, Redress of Grievance is a Right, that the City Government does not like it, is precisely the point.

Would like to see the video of it 'falling off' of the window. And what are the courts going to decide is too long of a time for an object to be attached to the building before it is illegal? Listen to the dumbness of the elected official - first he blames he the citizen journalist for not including any comment from them on any issues with: ‘he never says in his articles “Mayor/ Council said this…”, he never does’ - immediately followed by this admission: “we never offered any comments to give our side’. Umm, yep…he just blamed the man for never including the non-existent comments he never provided to the man. I mean, wow!

McBee residents should protest by Taping SIGNED NOTES on the town hall window. However All notes MUST be complementing, positive messages. If no action against the citizens is taken for vandalism, then it would be a clear case of retaliation.

Glad to see that ALL CRIME has been solved in this town. The police have nothing to do, they're so bored and have so many resources that they can track down anyone for any small thing for the purpose of swarming their home with an arrest warrant. He should 100% fight this and have the person that said the note didn't even stick testify. A jury can say not guilty based on the punishment not fitting the crime. $1k and/or 30 days in jail? For a piece of tape?

That code is for permanent placed things on a wall/door, etc. not for taping something that doesn't even stick on it (it lied on the floor in front of it).
