no department follows such laws..... court should start taking action against the appointment authority n not against the department .... big officers r responsibles for delay in appointment n not the department...... evry1 doesn't hav lotz of money to go to the supreme court n all.... supreme court must taking action against the authority in a serious manner....

Sir i belong to open category. My mother passed away in 2018 during that time my age was 35. Govt set a rule for open category dependents 33 years and for spouse 45 years. My application was rejected on the basis of age. I went to honourable high court and submitted my prayers to honorable justice. Honorable justice said consider my case on par with other candidates mentioning the Go's and directed to consider age relaxation but, still my application not considered sir now, what i have to do sir? The time limit honorable justice has given up nearly ended sir.

If there is specific direction that age is to consider and that application to be decided within specified time that it attracts contempt petition before Hon'ble Court

मई 2021 में मेरे पिता की मृत्यु हो गई। वह एक केंद्रीय कर्मचारी था। 4 साल का काम बाकी है। जब मैं अनुकंपा नियुक्ति के लिए कार्यालय गया, तो मुझे बताया गया कि मेरे सामने अभी भी 16 लोग हैं। सभी क्रमागत होंगे। लेकिन एक साल से अधिक समय हो गया है और किसी को नौकरी नहीं मिल रही है। कार्यालय भी इस संबंध में कोई कार्रवाई नहीं करता है। अगर ऐसा ही चलता रहा तो 10 साल बाद भी नौकरी नहीं मिलेगी। इस बीच सुप्रीम कोर्ट ने अपने फैसले में कहा है कि 6 महीने के अंदर नौकरी दी जाए.एक अन्य फैसले में, एक आवेदक ने 8 साल बाद मामला दायर किया, सुप्रीम कोर्ट ने कहा कि उस समय परिवार की वित्तीय स्थिति को ध्यान में रखते हुए अनुकंपा नियुक्ति दी गई थी। इतने सालों के बाद स्थिति बदल गई है, इसलिए मामला खारिज कर दिया गया है। अब मुझे क्या करना चाहिए?

We should written representation to the authority for the decision on the application. Then move to High court under writ jurisdiction for appropriate directions to decision on the application

You firstly file the representation before the authority for decision on the matter, if no reply the you can move to your High court by filing writ under article 226 of Indian Constitution

Compassionate appointment is given under rules frame by the government or the institution. The judgement pass by honorable Supreme Court says that any application if filed for compassionate appointment should be decided within the period of 6 months. Admissibility for compassionate appointment is decided in accordance with the rules. In case the employer is not providing the compassionate appointment in accordance with the rules then representation in this regard could be given which could be further enforce by filing CWP in the High Court.

As per Notification dated 11Oct 2021 issued by Government of Odisha for the clarification it is specifically mentioned that all the pending application for appointment will be considered under the rules of 2020. This judgement is specific to this particular case only. BUT the important thing which will be helpful for you by this judgement that your application will have to decided within 6 Months as it seems it is already delayed

Hello sir please help in my important matter. My father expired in service period in 2007. he was in Corporation bank now merged to union bank. We asked for compassionate appointment for my mother but that time rule of compassionate appointment was not there so my mother took ex-gratia amount. But in 2014 the rule of compassionate appointment is started again. Now my mother is 50+ and have health issues and I to have little sister who is still studying. So can I get compassionate appointment in my father's place now. Pleae reply sir

Normali there is a cut off date for application of compassionate appointment and usually PSU like Bank used to give money in lieu of job and under these rules I think that you are not eligible for the same.

Sir department me pahle compassionate vacancy nhi thi .. but kuch din pahle vacancy a gayi hai .. But department wale kah rahe hai .. ki abhi pahle direct recruitment walo ka online form,Pre exam,mains exam, result aur fir unki joining ho jane ke baad hi compassionate appointment hoga.. usse pahle nhi .. Kya yeh rule sahi hai ???
