sir i have questions. Suppose A is resident of Ambala and B is of Ludhiana. B has govt contract of hospital construction in Patiala which he sub lets to A. A completes work but B is not paying him. Now A files suit for his payment. Sir A kahan par suit file karega, Ludhiana mein jahan defendant B rehta hai ya Patiala mein jahan immovable property(Hospital) situated hai? Kya ye problem sec 16(d) mein aayegi ya sec16 k proviso mein ya sec19 ya 20 mein? kya is problem mein subject matter property ko mana jayega ya money ko? please ye sare problems ko answer kare so that i can make my basics strong. thank you.

This is not the case of immovable property but a case of contract, so he has an option either to file a suit at patiala or Ludhiana where defendant resides

Sir personal obedience mein agar property ka matter ho , kya hum compensation file krr skte hai . Suppose registry hui property ki and property haryana mei hai. Hum chahte hai ke property chahe na bhi mile , compensation mil jaye jo registry mein mention kiya ho. Toh kya hum suit file krr skte hai compensation ka Punjab mei.

Aur usko sabit kaisey kiya jayrga pehleyw aley suit ko key car hyderabad me hee thee ab usko drive kerkey yahan sey lejaya gya hai .

Suit can be filled at place where defendant resides or carry on business. Only these two things are taken into consideration

Sir proviso of section 16 does it apply to all casese mentioned in CLAUSES A to F? Second proviso's bare language perplexed me. What does it mean? OR, IN THE CASE OF SUITS REFERRED TO IN CLAUSE (C), AT THE PLACE WHERE THE CAUSE OF ACTION HAS WHOLLY OR PARTLY ARISEN. sir please elaborate this point. Why is it reffering only to clause C?

Clause c deals with the Immovable property, whether given in mortgage or given in charge to someone it's Cass is always filled at the place where the property is situated
