Second Visit To The Passive Aggressive Recycling Plant
After checking to see if the road that I was stood on during my last visit was private or not, and finding that it was publicly maintained, I decided to pay another visit to the site.
This time the encounter was much more amicable, and the person I spoke to was insistent that I shouldn't video, but was a very nice and pleasant man.

Pretty sure that's the place where several 'stolen' trains went in the early 2000's. As far as I can remember they were stolen (sold) by some manager at Tinsley marshalling yard when it was closed down. I remember seeing them being shipped out on trailers.

The guy in the white hard hat pointed his camera/phone at you in the hope of intimidating you. And all he got for his effort was a video of a polite senior citizen chatting about the fact that he’s severed his country, worked hard for 52 years and now has a perfectly legal hobby videoing for recreational purposes. If one item has sat there for 2 years and they can't find the invoice then they get shut down.

Section 33 of the criminal justice act 1972 makes it a "public place" regardless of if it's privately owned or not.

@@richardishereagain Yes. Don't get "public place" and "public property" confused though. They mean different things. Section 33 grants rights to any member of the public to access any area, in its normal operating hours, which the public can access. Like shopping centres, privately owned access roads, reception areas, car parks.... you get the idea. You can be asked to leave by the owner (not just the bloke who works in the yard) and you should leave. But if you don't, it's not a criminal matter but only civil trespass.

Alex wileman section 33 also states "where the public is permitted access". That permission is not always implied just by the fact that the property is accessible. For example permission to a particular accessible site could be dependant on a pre arranged appointment. You are right in saying that permission can be removed and a trespasser asked to leave. However when auditors begin arguing when asked to.leave they tread a fine line towards aggravated trespass. Just because it's accessible does not mean access is permitted

Since you were on a publicly maintained road there is no need to use s33 (or s74(1) of the anti-social behaviour order act) but you can use s62 of the copyright, designs and patents act 1988. That specifically allows photography and filming of buildings and structures for artistic purposes. Yes its there to mean that copyright can't be broken doing the photography, but it also means that the owner can't stop you. It also means that you can bamboozle people who don't know the law. Don't forget that art, like beauty, is in the eye of the beholder. And a scrap site does have some certain artistic qualities.

The jnr site is ron hulls. Booth and Ron hulls are the 2 big scrap merchants in rotherham, live just up the road. Booths own the land that rotherham uniteds old ground is situated on, they built the new ground across the road after a dispute over the land and the money.

Hi-vis Harry, then came out, in disguise, with his brand new, white hard hat, and brand new face mask, WITH A BRAND NEW, LONG SLEEVED HI-VIS COAT, to complete his disguise, while doing undercover videoing.... The funny thing is, I reckon this guy isn't an aggressive person and finds confrontation awkward, but is trying to live up to the previous guys standards. If it is publicly accessible it becomes public property and you can film anything you can see from public and the law substantiates this with lawful precedent and he can film and no matter how many times people say it the law says different and they cannot overrule the law. Once again they misquote the law and think they are correct and they cannot see what idiots they look.
