Section 19 in The Limitation Act, 1963
19. Effect of payment on account of debt or of interest on legacy.-Where payment on account of a debt or of interest on a legacy is made before the expiration of the prescribed period by the person liable to pay the debt or legacy or by his agent duly authorised in this behalf, a fresh period of limitation shall be computed from the time when the payment was made: 19. Hi, let's say a borrower has taken a loan 10 years back and there are no payments in between. Letter of acknowledgement of debt not obtained in last 10 years, but obtained recently. Will it extend limitation period or does continuous acknowledgements have to be there every 3 years.

I think its a requirement to pay the debt during prescribed period as written in bare act ..."before the expiration of prescribed period"the words deliver the interpretation itself.

After the expiry of the limitation period of 3 years, debtor Rohan makes a part payment of debt to creditor Sohan. Sohan then files a suit against Rohan for recovery of the debt after 2 years from the date of part payment. Discuss the maintainability of the suit. Please Ma'am answer me this question. It will be of great help🙏

Sir if someone took money 4 years ago. Can i file a case at present date as date on cheque is of feb 2021. Will limitation act of 3 year apply on my case? Can my case be rejected on the base of limitation act.

Sir counting of 3 year will start from date of cause of action means when that person refuse to pay. If you have a cheque, present it in bank.

@@GOLEGAL He never said that he will not pay. He stopped replying my messages since August 2018. And i gave money in 2016-2017. So from which time limitation period will start, cheque date is feb 2021.
