Strange that I can’t find much when it comes to what kind of safeguards are in place to protect a person for being the subject of an abuse and being wrongfully detained and deprived of his/her liberty which undoubtly will lead to a trauma

Yes, thatis true. been trying to find that for ages. & yes, what u say does happen. the people who do such things to others, r not looked at. they must be? it's quite serious that they r. it just can't b accepted. watch a US ABC TV, a good news report on those who voluntarily go 'in', but cant come out easily!

I’m so grateful my partner is in a hospital! It’s taken weeks and weeks to get her a bed- had to go private in the end- no nhs beds in the whole Uk for weeks! NHS is crumbling

So a section 2 is up to 28 days and it doesn't necessarily mean you'll be there for 28 days and you might only be there for a few days or a week or 2 weeks etc, depending on your assessment?

Yes, that is correct. The Responsible Clinician can take somebody off a Section 2 at any time if they no longer meet the criteria for detention. The patient is then free to leave or to remain as an informal (voluntary) patient if advised to do so.

Thanks for the information. At what point do the doctors decide that the patient needs to be in a full-time mental care home? I have a nephew that has just been sectioned 2 to a 3. But he really needs to be under full-time care. He has a history of heavy drug abuse. Very gullible and the drug dealers just take all his money and supply him with ever more lethal drugs.

Section 17 isnt a form a rc can agree verbaly ect. It is purely a matter of rc agreeing to leave the form is just a trust thing

Are you the Nearest Relative as defined in the Mental Health Act? kzbin.info/www/bejne/jGOWgYGdiNKFjbs If so, you can write to the Hospital Managers to say you want to discharge your daughter in 72 hours. If the Responsible Clinician agrees to this, he/she will take your daughter off the Section 3 and your daughter can remain as an informal patient or go home. If the Responsible Clinician does not agree, he/she will block the discharge. There will then be a Managers' Meeting regarding the discharge. If the Managers do not agree to discharge your daughter, then you or your daughter can apply to the Mental Health Review Tribunal. Best wishes, Beth

Yes, it has all changed over the years with beds being closed and services moved more to the community. To me it means that the Home Treatment Teams have to carry a lot of risk. Best wishes, Beth
