Sir, it is very clear to understand 313 cr.p.c but a question is that if if Incremented evidence is not put before the accused at the time of 313, than same evidence can be taken to punish the accused?

It seems, logically sec. 313 crpc is to incriminate further the accused, since he would be attacked with incriminating evidences and his silence would go against him adversely....
