Madam, Very good class.I am a Aircraft Engineer. I was living outside my native place since long. When I came back, I found my younger brother created lot of legal issues and even financial liabilities. I am 63 years old. 155(2)...order is passed for investigation in non ..cognizable offence N under 156(3)...order is passed for investigation in cognizable offence ....in case police in not doing proper investigation....it includes ...various orders ..like order for proper investigation...order for filing f.i.r etc

Mam, my question is as under: A wife accompanied with husband is missing from the journey by train and husband reports the matter before GRP as well as informed to her family members. She was not traced by the investigation agency till now and husband has been booked for the offence under section 304b/302 ipc, 498A But matter of alive or death has been raised under section 108IEA as 7 years has been over. Civil death declared under 108IEA whether Natural or Unnatural? If date of death is not decided under 108IEA then how can it be decided within 7 years for proving the case of 304b?
