Not sure what you mean with AI inspired art. AI art is not allowed on Redbubble, for example. If you mean selling art you've made yourself with an AI image as a reference, I don't think the reference itself makes it more or less illegal. Using the character is the problem.

The POD fan art programs include some artists/bands, too. And actors are included in movie / TV show brands. As far as I understand, there are 2 possible problems with selling fan art of celebrities without permission. The copyright of the original photo, if you're using a reference photo. And using the likeliness of the celebrity.

Did you submit them as part of the Fan Art Program or not? (Did you add the tag for the brand?) If you did and the designs don't get approved, they'll just be deleted and it shouldn't be a problem for your account. (By the way, I've had designs waiting for review on TeePublic for over 2 years now.) And one of the designs I uploaded for the Fan Art Program on Redbubble got declined, but the brand let me have the design up anyway.

They are not allowed to sell it. The consensus is, make it until you get hit with a cease and desist, however.. 1/10 times, the company will actually sue instead of giving a C&D. It's Russian roulette. Many are just taking their chance with it.

I think the fan art programs include some games too and you just need to follow the guidelines they've set. If you're asking about selling game fan art without permission, I don't think changing the character's clothes is going to help, if you plan on selling it with the brand's/character's name.

I don't think an art style is something that can be copyrighted. It's moreso about using characters someone else created, the likeliness of a celebrity or a trademarked brand name. So, just using a similar art style in your commissions should be ok.

So, yes it would be illegal to make anything Pokémon related and sell it anywhere, without a proper license. Does that mean that people don't do it? Absolutely not. It just means that they either are uneducated or are willing to take the HUGE risk or getting sued for everything they own. As far as you question about the Chibi drawings, as long as you are drawing and selling original Chibi you would be legal, but be sure to research anything you wish to turn into a Chibi, as anything that is copyrighted or trademarked, has the potential to get you into legal trouble. PSA: 99.9% of shirts on the internet are illegal, no joke. There are anime shirts everywhere, some are fan art, others are images pulled from the net. Doesn't matter who the fan artist is, the original character is not allowed to be sold in any form. There's Genshin shirts, chibi fan art of them, etc etc.. even Ned Flanders smokin a joint. Illegal. The best advise is: DO NOT SELL SHIRTS OF EXISTING CHARACTERS IN ANY FORM unless you have permission or a license from the artist to sell it. Only create an OC and sell that. Parody is in a gray area, there have been instances where parodied shirts have been C&D'd, so again, stay away from existing characters for what it's worth.

For Genshin: they do allow you to sell your fanart/fan merch but you can only sell 500 or less units until they will come down on you. You can always petition for more but there arent any guaranteed.

Besides, if the transaction and the artwork remains private... I really don't see how that would be seen as illegal. You're allowed to draw anything you want for yourself. You can also give that drawing to someone as a gift and, if they wanna pay for it, what's the matter?? I mean it would be an extremely far stretch for any corporation to sue someone over a private commission.

I don't think it matters, where you live, you can take part in the fan art programs from anywhere as far as I know. But the new "account tiers" that many POD companies started this year, might limit who can sell fan art.

It's free. You need to use the tags mentioned in the brand's guidelines, so they'll find it. From what I've understood, you publish the design, but while it's in the review process by the brand, it will not be public until they've approved it.

But if you want a simple guilt free solution, don't do fan art of the band but do fandom art instead. They own the band name but they don't own the fandom. That is public domain as fans created it.

especially anime characters... Japan and the US have a tightly mingled legal system. China on the other hand.. has a government agency that looks for western media to copy and make into their own. Because of this, people from the US and China tend to steal things from each other. If there's an interesting image made by a Chinese artist, someone from the US may attempt to steal it to spite China and vise versa.

I wanted to know something that’s a little more specific... what if I want to sell my Disney artwork (some are characters)? Because Disney owns the characters, so do I need to make it watercolor, do something different to the character (eg: clothes, etc), or just not put Disney in the title?

You can't sell artwork with Disney characters without a contract with Disney, if the characters are recognizable. Using a different medium or style doesn't make a difference.

Hey Lily i have a doubt, is it legal to sell soccer/football fan arts based on players that play the game I have taken some images of the footballers from google using the creative commons license tool and modified it using my own art work to represent the iconic moments, Most of these photos i found only showed their backs and not any of the team logo if its not , Then is there any ways i can inquire on how to use it legally

The only legal way to sell fan art is with the copyright holder's permission. If you don't have this then it's illegal.

Exactly and probably the easiest way to get the permission is through print on demand, 'cause they've gotten the permission for you.

sad yee yee if you watched the video, she explains that some companies like red bubble have established agreements with the original creators like Star Wars and have created agreements with them to allow other creators to legally sell fan art. I don’t know if that helps or answers your question or not.

You need to contact the band (or whomever owns the trademarks and other intellectual property rights associated with the band if they broke up years ago). Whenever you want to sell merch associated with someone else's intellectual property, you need to contact them directly to ask permission and perhaps work out some kind of licensing arrangement.

Selling fan art *without permission* is copyright/trademark infringement. In this video I'm telling you how to sell fan art without having to ask for permission from individual brands / copyright holders, because these print-on-demand companies have already done that for you. However, I think it's unlikely to get into legal trouble just for *making* fan art without permission, if you're not profiting from it.
