Then you need to look at the facts of the particular case and read the justifications made in text. Culpability to a crime matters and that's exactly what she took into account. Giving a maximum sentence for every single wrong is not reasonable and not something our society wants. In this case, she tried to explain that she had sentenced over a hundred people and without having the information in front of her, she wouldn't be able to give the explanation properly. Perhaps this kid panicked when he saw the files and his it in a drawer and never looked at it again. Or maybe the perp was actually one of the children being victimized but they still had the photos after turning 18. In either (completely hypocritical) case, while the person would technically be guilty of possessing child porn, intent to harm or be sexually gratified is not a contributing factor. In a case like that a low sentence would be warranted. And since she's sentenced so many people she can't be expected to remember details.

Why should congress provide minimum sentencing threshold and other guidelines and blame judges for applying their discretion in sentencing? They should have spelt out only maximum sentencing threshold or increased the minimum threshold. Ted Cruz can’t blame her for that. @@jeneendove906 Making assumptions about people who collect child p0rn is like making assumptions about murderers being sick and therefore incurable, except murderers actually kill people and we oftentimes give them second chances. It's dismissive to do that because they're not all the same and don't all do it for the same reasons. I get that children could be at risk but you also have to think about the people you're incarcerating. If "we can't take the risk" doesn't apply to most cases, then it shouldn't apply here, especially if no physical harm was done to the "victim" by the "perpetrator" (in this case, the image collector). Putting them in jail for the rest of their life for that would be like putting someone in jail for collecting images of murder scenes and saying they're a danger to society. Not all CP collectors would physically do anything themselves so that has to be considered before you label them a serious threat. I get that you don't like it but we're talking about what's fair to everyone, not just the people you care about. Also, if it truly is a sickness, why not hospitalize them? A lot of people call them sick but at the same time argue that they're evil as well and therefore should be either jailed indefinitely or killed, which doesn't make sense to me.

I will say that the US does have sentences that are absurd. Like juveniles that are tried as adults at the age of 9 or 10 etc. But when it comes to crimes against children there should be very strict cases. Now I did see a guy that was charged with kidnapping and not letting a child go (can not remember the charge) anyhow now the truth. The girl was 13, she wears make-up and looks much older. She was not kidnapped, she jumped in her boyfriends car and so did 2 other friends, nobody held her against her will and she said and her friends said they told her boyfriend she was 17 and a senior in school. Her BF was 19. I think that cases like this need special attention, not child rapists and kiddy porn diddlers.
