Kennedy didn't speak correctly. The 2nd Amendment doesn't give us the right. It recognizes that the right exists and says government shall not infringe it. If people would read carefully they'd know this. The 2A speaks of the right as though it already exists. No rights are granted by government or a document, the rights in the Bill of Rights existed before the Bill of Rights did.

Kennedy is also wrong in saying that a prohibition against a bazooka is allowed under the 2A. Nope. Rights extend to any extent as long as one isn't infringing the rights of others. Someone owning a bazooka doesn't infringe the rights of anyone else. The limit to any right is where the rights of others began. It's why murder is illegal but owning a gun is not.

hillplace- people don’t “need” free speech or religion but they’re protected by the first amendment. The second amendment protects all weapons and had no restrictions until 1934 with king FDR and even then they didn’t ban anything because they knew they couldn’t but they placed an onerous tax on the items regulated by the NFA. It’s not the bill of needs but it is the bill of rights and it seems that our politicians can’t seem to understand that you need to amend the constitution if you want to change something rather then trample all over the only amendment that says “SHALL NOT BE INFRINGED”.

The second amendment clearly states "arms". It does not say what arms. Repeal every law ever made that take away rights of keeping and bearing arms. And nullify the ATF. There should be no question for the Supreme Court when it comes to any infringement against the 2nd amendment.
