The judge is too far ahead of himself. The counsel can't say there were no intruders in the house, because that's not their space. Theirs is to prove that their clients were not there.

Yes they can say there were no intruders if they can dig enough, secondly, you are right, their duty is to prove that their clients were never there, I think that was the exact argument from the judge, and he also made some examples on how to argue on that matter, for instance you can try to prove that your client was in KZN instead of disputing that there was ever a gun, he asked what was the court about, he said if you are saying there was never intruders or Makhumalo never cooked then put it to this witness, they were asked if they are saying there was never a gun shot and they all put their tails between the legs, the judge is top notch 🔥🔥

Zandi shouldn't be asking the lawyers to slow down their pace or speak louder because she has a Zulu interpreter who's meant to translate what the lawyer is saying to her from English to Zulu, why does she need the lawyer to speak louder cause from my basic understanding of the need of an interpreter is to translate a language you do not understand or extremely basic in. So they must speak louder for you to understand what exactly, awusizwa nje isingisi? I think given that she clearly understands the lawyers in English, the interpretation is just used to buy extra time for her to process the questions from the lawyers and her answers before they are translated to her in Zulu.

The judge is just about causing confusion. The line of question by the two previous guys is around identifying their clients as those intruders. Ramosepele’s line of questioning wrongly, using an association fallacy, that the statement that Zandile made is correct because our police messes up statements. I even supported my argument by stating that we have successful prosecution in this country from police statements. But of importance was that I stated that if it was adv. Mnisi he would pushback from that objection and he will defend his statement. And we saw that. Again judge Ratha Mokgoatheng seem to not writing stuff down and that worries me a lot, why I am saying that judge Ratha’s almost sustained an objection that he himself was not arguing for. Vaseline’s objection is misguided because he is stating that the determination of the suspects will be made by the police. However, adv. Mnisi is categorically stating that no one was ever arrested meeting the description of Zandile. The judge then accussed adv.Mnisi for saying that the intruder will never be arrested. Family this is important, because it was the judge that unfairly stopped adv. Ramosepele’s line of questioning, because that statement was signed by Zandile and she agreed that it was read to her, now for a judge to believe Zandile’s statement with a fallacy is totally troubling. Adv. Ramoseple was trying to demonstrate that Zandile’s statements have a lot of descrepencies for her to be taken as a credible witness. If the state then quiry that, it was for them to prove that the police inserted what Zandile did not say in the statement, not adv.Ramosepele, or not to throw the police who did his/her job under the bus without any evidence. This part I was totally not happy about, because it is the compilation if these things that seem little that demonstrates to anyone including Vaseline that the witness is not credible, she changes statements over and over again.

The affidavit from the undisclosed person leads the case to that direction, even besides Teffos suggestion...the undisclosed witness says there was a call between him and Tumelo and the content thereafter is that there was a fight between Longwe and Zandi and Senzo was unintentionally shot. I expected that the advocate will put it to Zandi that there was a fight between herself and Longwe. All they'll need after that is prove that the was call between Tumelo and the undisclosed witness and the second will be clearly valid

In all the drama that is happening in court by Zandile, I have noticed that the judge is too soft when it comes to Zandile , she is doing as she pleases in court, when a witness have chose to speak isizulu or what ever language, he must stick to it till he or she finish testimony for the sake of the record but Zandile mixes now and again and the judge is keeping quiet not reprimanding her. Not really loosing as such. Actually, it would be very unprofessional and unacceptable if a judge would take it upon him/herself to assist either side. He is simply telling them not to waste time asking irrelevant questions that do not help their case in anyway. Remember the defense lawyers are not there to pin any case on anyone.
