Yes Judge whoever had the phone was moving with it in Gauteng, but the biggest issue now is that we can't tell who had that phone. All Gouws is presenting still doesn't prove that Ntanzi had the phone. It could be the IO/police who were moving around with his phone editing pictures.

If accused No.2 Ntanzi had a phone with him since his arrest, then why did he ask Magistrate Cronje if he could make a call to his family so that they can bring him toiletries so he can bath, and also say hello to his daughter and let them know he's arrested because they don't know what happened to him. The state is really desperate to pin Ntanzi on this case. As far as we are all aware that once arrested they take all belongings away from the suspect to avoid to temper with evidence while they are still investigating. Why did Ntanzi had his phone pillar to post because to me it seems it's not once. Baloyi needs to gather his facts together before the court. All his lies are being exposed to whole world. If I am not mistaken, the analyst could not access the messages when downloading the cellphone because of security protection (either password, pattern or biometrics). So the easiest thing to me to solve this issue is to check if the messages appear as "read". If that is the case, then it's either the owner of the cellphone or someone who was given the password.

The state's claim that the cellphone unit, SIM card, and memory card tracked accused No. 2's movements is improbable without inside help, which is also unlikely. An accomplice would need detailed knowledge of No. 2's movements and the ability to bypass holding cell security. This scenario is highly improbable. It will be interesting to see how the prosecution proves this in re-examination.

This case is really interesting, the state were so relying on phones/Sect 205 to place and prove that the accused were either at crime scene or know each other but immediately when technicalities arise now they want to separate the cellphones from the accused yet they own them. Ntanzis cellphone was in his possession after detention for 8 crazy months and the state is adamant but when it picks up different towers from where he was detained now suddenly the state puts that somebody else was involve to move it around. Amazing 😮 failure of the so called cold case unit to do their required procedure on day of arrest and the state to accept such vague evidence to produce b4 court. Lets wait and see 👀

The state would benefit from adopting a version in which Accused No. 2's SIM card and memory card moved with him, and he used any available cellphone handset opportunistically. This approach is only viable if the cellphone data supports it. One would need to follow the forensic data (IMEI) closely to confirm this.
