Agreed. The entire incident was out of line. As a Sergeant, not a regular patrol officer, he knew his ticket was flawed and defaulted to the subjective "reckless driving" claim, knowing he didn't have ANY evidence whatsoever. It cost me thousands of dollars in attorney's fees.

You should ask your police friends as to what's the best way for this incident to become a learnable experience for the police dude to learn from. Having the ticket dismissed won't do anything from this happening again because the cop guy doesn't care since he thinks he still won because he wasted your time. I myself would like to know but I hear a written letter goes on their permanent record/file.

first mistake was pulling over in a car that fast (jk) first mistake was actually saying you may have been swerving because that is where he could have got you. He said you where going 70 or over 70 which is likely where he lost the case. You right to remain silent is there for a reason and that reason is to prevent yourself from giving testimony against yourself without legal council to make sure you are not throwing yourself under the bus. I wish officers where required to go to these court hearings so they can be smacked by the judge for wasting the court's valuable time on negligent charges along with pissing off the population.

I got a careless driving ticket in a target parking lot on Christmas Eve for starting my open header cammed camaro while it was parked, officer wrote the ticket and forgot that the whole parking lot was loaded with cameras as was my vehicle, went to court and made him look like a dumbass and in the end he apologized, I didn’t accept it, for obvious reasons. Cops abuse their privilege and authority and it’s quite disappointing.

This cop was out to give this guy any kind of tickets that he could because he simply didn't like the fact that he was in an exotic car and normally exotic car drivers are easy targets because it's easy to believe that the person was driving fast, he'll just the talk that was going on between these two was enough to think this guy in court for reckless driving. Tell the court system that a guy had a fancy car that was making a video and then try to get the courts to believe that he wasn't driving like an idiot..... no evidence of reckless driving took place, but what the gentleman said could have been verbally stretched into sounding like it was reckless driving. The court system of the United States has went from proof to just convincing people by the sound of the words

Never admit to anything. If the officer says you were doing this, then think of it as “I’m accusing you of doing this.” It means they think they saw you, but that doesn’t mean anything in court unless they have some sort of proof, and even the proof they have isn’t that great.

Best answer would have been "I don't answer questions why don't you tell me why you pulled me over" answering questions to law enforcement is incriminating yourself. Next time use your 5th amendment right to remain silent.

Everyone should take this advise and NEVER answer ANY questions police ask you. It’s hard to do but there is absolutely nothing you can say to help what so ever. You admitted to “swerving” and “accelerating to hear the pop”, so without knowing a judge, paying $1000’s for a lawyer and getting a “fair” trial, a conviction would have been likely. Most take a plea bargain. Your encounter is a great learning example of how not to act when being pulled. Honestly, I would have struggled not to act the same way.

Isn’t it normal, that the state pays your expenses in defending yourself if you are found innocent? Serious question. I’m from Germany and here the rule is pretty clear: Whoever loses a law suit will pay the winning parties expenses, so people and state attorneys will think before they go into a law suit where they are not sure to be on the right side.

I have lost several rights for the rest of my life because I could not afford an attorney and they do not provide one for civil cases. This is a country where someone can lie about you with zero evidence and fuck you over for the rest of your life (unless you are wealthy)

If you know the area, you can check the officer's speed using the trees from his body cam, a stopwatch, and measuring the distance.

For future reference,, when you get stopped by the police and they asked you a simple question... why do you think I stopped you today ? if you make any excuse or if you make any alleged allegation ,, I was speeding I forgot to use my blinker I didn't come to a complete stop...If you make any statement the police will go with that, that's what he will use in the court that you admitted that you were swerving even though that might not be the reason for the initial stop ...but since you admitted to it,, it's easier to get a conviction... you never answer a question on why do you think you're being stopped ..you always say I don't know.

NEVER answer the age old question of "do you know why I pulled you over?" NEVER EVER give them freedom to search your vehicle. Never engage them in "small talk." They'll use everything they can against you whether it's a "friendly" conversation or not.

You were too friendly and acted naive initially...so the cop took advantage of you bro..you shouldn't have helped him, when he asked you, do you know why I pulled you over ?..this is what you call entrapment...your response should have been " not sure officer, I know I wasn't speeding and I have been recording audio/video for my records...most probably you liked my car, so you pulled me to check it out...again just to be clear, I am recording everything" ....he was simply motivated by his jealously for your car and success. Hope lesson learned.

It sucks you won the legal battle but the officer doesn't learn anything or change his behavior from it. I hope you consider filing a complaint as atleast that could result in some sort of training/learning experience for the officer. He seems like he could use some public relations training, his social skills are fairly unprofessional.

I remember getting pulled over without a valid license (30 day suspension, commuted to college), and the lawyer asked me how much money I had, got out of a 1 year suspension with $400. Capitalism. I now always fight all tickets, and never suggest a reason "why were you pulled over"

Never ever voluntarily talk to the police, even if you witness something aweful as you instantly become the suspect. If the police knock on your door never ever open the door, or talk to them from behind your door. If the police call your house using their 911 dispatcher, do not ever answer the phone. Never ever give the police a statement.

Nearly every LEO car has integrated GPS files with extremely accurate estimates of SPEED and location every second. DEMAND those files ... they will try to ignore your request and violate the BRADY act. Those files will tell you EXACTLY how fast he was going every second. But the cops will NOT give you those files. You need the judge to throw the book at them Good luck. One rotten cop infects the whole bushel of apples.

when you are acquitted you walk away they pay their own fees to themselves. you pay your attorney, you loose, then u pay fines and fees etc.

@Silvio Manuel my own experience in Court, when you are acquitted or the case is dismissed there are no fees to the accused. I go to court with others on a regular basis. This goes for felony charges and County paid attorney fees--if u are lucky to get one that actually works for you.

I've had as many bad experiences with the cops as I have good ones. Plain and simple, there's people wearing badges that shouldn't ever have that responsibility or privilege. And it's my position that the cops should be the ones weeding them out of their ranks as part of their duty to serve and protect the law abiding public. And save themselves a lot of grief and disrespect brought on them by failures. Sorry for your loss to this one. He costed you more than enough in time and money paying to clear yourself from his little power trip.
