When I worked at a fast-food joint, I tried to tell my manager about the ADA act, but she refused to listened. The guy with the service dog did not take it lightly, and filed a complaint with head office. Needless to say, she had a new one torn into her by the district manager- whose husband also had a service dog.

Forget the paperwork. As a CGC certified evaluator, it takes 2 minutes to see if the dog is a working dog. No barking, fearful of fast movement, focused on owner. That young German Shepherd is either one of a kind, amazing. Pretending that going to a socialization class with the American Veterinary medical Association is enough. Let's not demean the dogs that really did it right.

The ADA doesn't require formal "paperwork" but many organizations offer it to those who think it may be helpful, so having documents shouldn't be a "red flag". If the owner can answer the 2 questions employees are allowed to ask, that should be sufficient.

You are only allowed to ask a person with a service dog two questions. You can ask if they're a service animal and what they're trained to do. Legally you cannot ask for paperwork, you cannot ask for medical records, you can't ask for anything else. And before anyone makes the argument that they'll have paperwork it's very easy to get fake paperwork to pass a pet off as a service dog.

THERE IS NO REGISTRY FOR SERVICE DOGS!!!
@JustMe-ec2ph6 жыл бұрын
ADA does not require service dogs to be registered but your information that there is "no" registry for service dogs is incorrect! Q20. My city requires me to register my dog as a service animal. Is this legal under the ADA? A. No. Mandatory registration of service animals is not permissible under the ADA. However, as stated above, service animals are subject to the same licensing and vaccination rules that are applied to all dogs. Q21. My city / college offers a voluntary registry program for people with disabilities who use service animals and provides a special tag identifying the dogs as service animals. Is this legal under the ADA? A. Yes. Colleges and other entities, such as local governments, may offer voluntary registries. Many communities maintain a voluntary registry that serves a public purpose, for example, to ensure that emergency staff know to look for service animals during an emergency evacuation process. Some offer a benefit, such as a reduced dog license fee, for individuals who register their service animals. Registries for purposes like this are permitted under the ADA. An entity may not, however, require that a dog be registered as a service animal as a condition of being permitted in public places. This would be a violation of the ADA.

I understand that this man has been medically diagnosed with PTSD, but please, do your research before just getting a dog and training it for Service work, and sending them out into the public. PTSD is NOT a disability. His dog if anything was a therapy dog or comfort animal NOT a service dog. The dog must perform a function in regards to the disability. Only service dogs (or miniature horses) are covered under the ADA
@FR-tb7xh3 жыл бұрын
Actually, PTSD can be a bona fide disability, if it is severe enough. And those with such PTSD can have service animals that are tasked with recognizing breakdowns before they happen and ways to mitigate them. Their tasks can include signaling the disabled person to sit down and providing body pressure to calm the person and more. Those people truly need their service animals by their sides to function in potentially challenging environments. But it seems anyone can claim PTSD anymore, judging from all the KZbin videos taken by young women, in particular, whose bodies shake uncontrollably yet are able to video themselves with a steady other hand to hold their cameras. Too many seem to pick fights, weaponizing their ‘disabilities.’ As to this guy in particular, his story just doesn’t pan out IMO. He was mighty fast in pulling out documents as if they proved his dog was a service animal. They didn’t. And for him to claim his dog was certified or registered as a service animal was fraud *unless* he was in one of the rare communities in the US that will actually certify or register residents’ service animals and provide a special tag as a courtesy. Outside of those communities, such certification and registration is bogus. Also, I didn’t catch him saying it in the video, but some are saying he explained that his ‘service animal’ was trained in ‘search and rescue,’ of all things. If that’s even true, just because a dog is trained for an important service doesn’t qualify it as a ‘service animal’ under the ADA. Unless the man runs away when he has an episode and the dog has to find him! 😉

The "comfort"dog thing is what hurts the legitimate service dog. A service dog is trained to provide a specific service to their master i.e. a guide dog for blind. They have been trained and tested for years before they get the vest. "Comfort" dogs can be any dog you buy and want to carry with you everywhere and that has become somewhat of a pain in the neck to businesses.. Some docs give letters to owners, owners out scarves around dogs neck and ecpect to take them anywhere.

@glitzyx4x8526 жыл бұрын
Under the Americans with Disabilities Act (ADA), privately owned businesses that serve the public, such as restaurants, hotels, retail stores, taxicabs, theaters, concert halls, and sports facilities, are prohibited from discriminating against individuals with disabilities. The ADA requires these businesses to allow people with disabilities to bring their service animals onto business premises in whatever areas customers are generally allowed.
@barbarawilson9585 жыл бұрын
The part about not having to explain disability or licenses is the source if the problem. It becomes easy for the fakers to get certification. Maybe the service dog had an ID like we have driver license. I know this is not the point, Im sick of people and dogs being thrown off flights, out of restraunts, stores. It's pretty obvious which are the Valid Service dogs and owners just by the they interact with their animals and the non reactive behavior of said animal. Even durjng training there are very clear signs that it's an animal in training don't interfere or pet ! I hope hero Vets, and all disabled who have been finally helped will Not be hassled. These people are out there functioning and coping. That is to be honored and applauded. GOOD JOBS ! Sorry for length but just watched 5 videos of Unfair treatment towards these heroes.

Emily Joy Um maybe you should read better, I said wash out not lash out. Wash out in service dog lingo means to be cut out from service work. I've had dogs all my life, I've reached GSDs for over 9 years. Maybe you should research more about service dogs before making an arrogant comment. Yes, GSDs can be great med alert dogs, guide dogs, and mobility dog, but rarely ever do they make good psych dogs. Which this puppy was going to be a psych dog.

I been a vet tech for 5 years I usually Ignore all the dogs at the store because I don’t want to distract it if the dog is a real service dog. Some dogs are obvious that they aren’t real service animals.If the dog isn’t Being aggressive towards I ignore it. Two months ago I was shopping at a Walmart and this lady had a huge pitbull, she comes next to me and her dog does not take his eyes of me. He had his chest pumped up and his tail between his tail just staring at me. I told the owner if she could get better hold of her dog because he was ready to attack me. She no that her dog is an emotional support/ security dog so I couldn’t tell what to do. I told her emotional support dogs aren’t service animals and if her dog attacks me I would defend myself. She called the cops on me but the cops told her dog was a service animal.

No customer or store employee is allowed to question about the dog its required to have a special vest.. No customer or store employee can deny a service animal working or in training its illegal. Its like telling a cyclist they are not permitted on the streets its like telling a service animal they are not welcome or allowed. The person has every legal right to Press charges and take immediate legal action towards the store manager and the company this is not allowed.

I don't know how long it takes for a dog to take for him/her to be a service dog I was told it depends on the situation and all. And even than, the dog would still have to be trained (finally touches and all that law would require. and would still have the dog trained enough for the job) the dog would be at least 2-3 plus, to go out and it's job. But it would depend on the state, shouldn't it? I mean, I don't know

This whole situation is a Pathetic. He provided them more than what was required or needed, and they handled it unprofessionally and with disgrace. The service dog along with this owner deserve more than an apology. The fact that they are still discussing the “ban” with him being able to take his service dog to their location or any other is outright wrong! Shame on Whole Foods as a whole, this entire situation (even after the fact) is a poor reflection on your company. Everyone who was involved with this incident at Whole Foods should really work on customer service, and really evaluate themselves on personal relations. Clearly there’s a disconnect within the Company. As for the service dog and his owner, I’m so sorry you had to go through this traumatic experience.

There's organization that trains service dogs specifically for our Vets and the dog does come with an I.D card and paperwork showing that the dog was properly trained and that vet has the right of using said dog. Other people/organizations that co-train a dog with their disabled handler also can get an I.D. for the dog with paperwork showing who trained the dog, etc. The ADA says you do not need I.D or certification nor provide said information to have a service animal but trainers will give the handlers certificate or I.D cards to prove that the service animal was properly trained and to drum up business but non of it is legal. It's all just fluff.
@kineiya6 жыл бұрын
Main Street Boxer sorry I didn't realize the papers came from an online scam site. My bad but people commenting that there's no "such thing as paperwork" is incorrect because like I said there's organizations that do give paperwork/id/etc to handlers and yes the paperwork isn't valid under ADA laws cause there is no paperwork, handlers use the paperwork during disputes to show the training their sd has gone through. But then this hurts self trained sd's and their handlers because they don't have this papereork. It's a catch 22 and needs to be stopped just like all those fake registry sites.
@Nikki-o5l7 күн бұрын
Service animals are exempt from being asked any questions. It's no ones business. They are trained and have a special vest that states they are properly trained. They are not emotional support animals. I saw a woman of 80 years old get hand cuffed and go to jail for harrassing a man who had a trained support animal in a grocery store. He called police and off she went. Booked and jailed and she had to pay bail to get out. She had a later court date.

service dogs been around for ages. I just dont understand how anyone can object to people having them, or taking them into stores and restaurants. I am not dumb. I googled about service pets. Just to get to know the law. and know what not to do with a service pet. I never knew not to look them in the eye, but I did know not to pet them, etc. now when i see someone with a service pet I will not look the pet in the eye to distract them. I will say hi to the person, but that is just how I am. i say hi to everyone, but I wont engage in any more talking unless they ask me to. I dont want to distract their service animals from doing their jobs. the owners of the stores, ect and even the police got to learn it's not just "rules" its the law

To the manager of the Whole Foods store in Austin: You blatantly violated the state law, the federal law, the United States Military, and the Americans with Disabilities Act. You need to be fired and replaced for banning a United States Veteran and his service animal.
@carolinepaquier81567 жыл бұрын
According to federal law NO service dog is mandated to carry "papers" other than their ID which clearly states the fed law regarding service dogs's rights on the reverse side. Whether anyone "thinks" a dog is or isn't a service dog is irrelevant. I know many people try to fake vests, collars, etc. but bottom line there is only ONE legal right a business has re service dogs. IF the dog is not behaving, barking, sniffing, bothering other customers, etc, things a service dog would NEVER do, then the store can act. Until a dog misbehaves, the dog gets the legal benefit of the doubt.
@kineiya6 жыл бұрын
Depends. Some states have the ability to register your sd if you want to and you'll get an id card and about 50% of the time it will have the ADA laws/questions asked/etc on the back for a small fee. Other countries do have sd certification id cards but I'll "assume" they're talking about the US unless stated otherwise.

We here in Scottsdale AZ have tons of fake service dogs. People just lie or get a "Medical friend" to write a prescription. Just like handicapped parking cards. These fake dogs bark endlessly, Pee anywhere, Snarl if you or your dog are near them and in general are out of control. I tell managers that the real SD's don't do that. I have a well trained service dog and wherever we go we are welcomed. My dog by name, me sometimes. :D Yes even when we fly. Really. Of course his records show how good he is.
