Service of summons & subpoena

A court can issue documents requiring people to come to court or bring things to court. It can also require appearance at a deposition. In this video Michelle explains how far a court can reach and what things you should check if you receive court papers. Why am I STILL required to go to court, if I was told that no further action is required? I got beat up by a homeless lady a couple of months ago. An Assistant State Attorney called me & asked me to tell her what happened, & she kept trying to convince me to continue with the charges when I was trying to drop them. She told me that no further action was needed. Then, last Monday an investigator, who didn't even initially introduce herself, hunted me down & found my exact hotel room, & gave me a subpoena for January 4, that says that if I don't call over the phone, then I'll have to go to jail for contempt of court. I don't know much about the law, & I'm disabled. Please give me some advice & help me out. I am losing sleep because of this.

Thank you. My family was the victim of another very UN integris business. They have since taken over the unit we occupied to dbl their profit. I can 100 % prove by my and their actions that they schemed against us to our out of state landlord and the land lord caved and acted 100% unprofessionally. HI @Renee If you are bringing a small claims action the Court Clerk usually has some papers you can use- check there first. If there could be some fraud involved you can contact the state attorney general's consumer division in your state capital.

What happens if a State witness (main Trooper) is now fired and has failed to comply with a subpoena twice for a deposition? Know of any caselaw pertaining to this? Thank you in advance.

HI T - the attorney who sent the subpoena will have that answer for you. That is covered by the procedural law for the state- either civil or criminal depending on the type of case.

Everyone has access to the courts- but you have to know what to do and that can be time consuming and riddled with mistakes. If there was a criminal component then go to the DA and they will take care of getting info. If it is civil then please contact counsel to help. Injury attorneys take cases on contingencies. This sounds like an awful experience.

My foreign friend, a non-US alien living in Hongkong with zero US assets and residence, is threatened by a US broker who would sue him in US court for a margin call. Does US district court own jurisdiction in this case? How would the court use service of process/deliver the summons in a foreign country? If the summon is delivered to a wrong foreign address where he is no longer living or the summon is not delivered to the person in person, or even the court cannot locate/reach the defense, what will happen?

How do you see if you have a subpoena issue to you but you never received the subpoena? Can you call the clerk of courts?

Hi @Paris If a summons or a subpoena is issued and reported back or claimed as 'served' then there is a return of service filed with the clerk of the court which states the date and manner of service. Many cases are now online and can be checked. Call the clerk of the court or look at the court website to see if you can search online.

A trial attorney from DC hand delivered papers to my residence, showing up with 2 officers at my Kentucky residence for an investigation stating they have sufficient evidence against me to present an indictment to a grand jury. What does that mean? Why don’t they just arrest me if they have evidence? The letter head states U.S. Dept of Justice Criminal Division. They want to discuss plea agreement and state they must hear from me by January. I’m not in DC. What can I do?

Hi Victoria - please seek legal assistance - find an attorney in your area who specializes in federal criminal law. Most of the attorneys who practice criminal defense work in federal court used to be prosecutors so they know the rules etc. Everything you tell your attorney is privileged and confidential so they cannot be forced to tell information you share with them. Take all the papers you received. The first thing they can do is tell you if this is legitimate or a scam. Often a plea agreement will be offered in exchange for testimony against others. The first one to do this usually gets the best deal. Best of luck.

@Victoria you need to consult with a criminal defense attorney to determine 1. if this is legit 2. what it is about and 3. so you can know your rights. The first party to come 'in' and help the prosecution gets the best deal - but you need to do what is right for you.

Hi @Will Records are subpoenaed through a court or other official action. Each court has distance limitations. Ask the attorney handling your matter- they will have the best information for your situation. Thank you for the question- just gave me an idea for another video!

Hi @Vane - that sounds like a document showing that you were formally served. This means you either are to appear in court on a certain date or file a paper in response. Do not wait If there is a date on the paper you need to call the court to see if this date has been changed. If the paper says you need to respond then you should get counsel to prepare your response.

HI @Push - Get more information. What company wants the information and why? What type of case or investigation is going on? Have someone look up the case to see what this is all about. Also be sure to get information on the time you have to make any objection etc.

@@FinelyRevealed it’s a civil case and it’s some supply company. The letter came in late me they already handed over that information to them. So I don’t know what to do next. Would I need to hire an attorney to figure out what’s going on? Do I call them? I don’t know what my next step should be
