Respected sir, the question here is if defendant files a setoff after the expiration of prescribed period and then the original plaintiff withdraws a suit, then how would the court deals with setoff, which was already time barred and saved his position only because of its being setoff as per limitation act ????

So, as per my opinion defendant cannot setoff the liquidated amount if regarding his cause of action prescribed period already expires. He can only setoff the amount if his claim is within the prescribed period and as per limitation act his claims deems to be filled at the date of the institution of the original suit.🙏
