Mike Graham clashes with Peter Hitchens after the columnist said Shamima Begum is “being punished without a trial”.
The 23-year-old lost a challenge against the decision to strip her of her British citizenship on national security grounds last week.
Shamima was 15 when she travelled from East London to Syria to join the so-called Islamic State.
Peter says: “The crimes which she is accused are crimes against the laws of this country.”
Mike disagrees, saying: “But her crimes were not committed here.”

The problem with Hitchens stance is that when she comes back she has said that she will be prepared for court and sentencing. However, her lawyers will use the under age, groomed, and trafficked for sexual purposes. Also they will argue that any evidence collected is unreliable. So probably wont even go to court. Even if it went to court and she got a prison sentence say 8yrs i bet her lawyers would argue for immediate release as she has already spent that time in the syria. And i am not even a lawyer😀😀

Hitchens makes a strong point. Due process should be implemented even in the most heinous cases. Trial by the media and the mob is not a valid substitute. As much as one might despise Begum, her loyalties, and actions, what precedent would this set for other cases? Why not let due process take its course?

Disagree when the person being trialed by media is a terrosit that poses an immediate threat to all of us and our children and conversations are being held like this considering allowing her to come home I think everybody are then more than within there rights to rise up and make a stand and voice there concerns on this it affects everyone of us so by you trying to urge people to stay quiet enough for this to take place being our backs isn't going to help anyone I think everyone should continue to voice there concerns so we will be listened to this is our country we pay to live in and we will protect it no matter what

I really like listening to Peter, I find him fascinating. I really disagree with his position on drugs, but this I thought he brought some credible arguments. However on a personal level, I don’t believe she should come back

But if you have exceptions to justice you’re on a slippery slope. He knows and we knows she will probably be found guilty but it’s the process that’s important if you want to hold up democracy and the rule of law.

@@petersmith2522 I'm also anti-dope and I know he is too but I just can't agree with him on this topic. I understand his Christian principle behind His stance in that Shamina is akin to The Prodigal Son in Jesus' parable from Luke 15 but frankly the Christian culture in the UK isn't strong enough nor is the justice system trustworthy enough that such principles can be carried out without it being further detriment to the country. The UK is a country on its knees so much so that the nation cannot afford to entertain anything that would further harm Christianity or the native culture. Therefore Shamina needs to be left to dry, she simply cannot be trusted.

@@paulhatton9564 I don’t trust the law in this scenario. Plenty of people believe her to be a victim and therefore innocent of any crimes. Even if she is found guilty it wouldn’t be a life sentence, and whatever sentence it was would be followed by expensive appeals clogging up the legal system, and even if they failed she would eventually be released and still a potential risk. To come back to the UK, MI5 must monitor all her communications digital+in person for the rest of her life (another massive drain on resources) or she be given a “whole life” tariff. Otherwise, she should never step foot in the UK again.

I don't have sympathy for her plight as such, but I think Peter is right in that she was stripped of her citizenship in a rather dubious way. It's quite evident that she is now stateless and it is quite evident she has no real connection to Bangladesh. As mentioned in this very debate, there are other people already back in the UK, who did much the same thing, but the government couldn't manage to argue they had another state option. I think the reason why so many people are okay with it is that they know the government and country is overall weak on crime and terrorism and this gives some easy victory worthy of overlooking the dubious aspects of how it was accomplished. We consider her current plight apt, therefore we overlook the method.

This is the problem with Peter, Mike states that she is a danger to the country (according to mi5) and Peters answers is essentially "what if it happened to you?", that doesnt answer the question of safety. He also states in one breath that everyone deserves mercy but is all for the death penalty.

The problem being if her parents hadn't originated in Bangladesh then the Government wouldn't be able to do what they did, even if MI5 has a thousand page dossier of reasons. She was born and raised in Britain. She has never even visited Badladesh. The method used is highly dubious, but I think we overlook the dubious method because we actually think it is an apt punishment. Just one not supported by the law. I think it's also because we know full well she won't be help accountable if she returns to the UK.

@@johnstrong5436 We all know that the legal system in the UK is flawed or poorly applied in many cases (something Peter has noted himself). But we want Shamina to be able to access that legal system which will undoubtedly give her a lenient sentence, in which she will likely only serve half her sentence (if she is found guilty at all), then BAM! she is back in the UK and gets to live a new, tax payer funded life. She has shown no real regret, nor stated that she would not do the same again. She wants back in because the enemy she joined was defeated not because she realised the error of her ways. As for her parents, well arguably they shouldnt have been allowed to become UK citizens considering some of her father's practices and beliefs. Shamina hardly has heritage in this country considering her parents moved here from Bangladesh. She betrayed the UK, she turned against "her country" so she clearly doesnt have much love for the UK. Most of us do not want her back. For her punishment and our safety she now gets to be exiled and guess what? 99% dont not care.

At the end of the day if there's anybody in the uk England yesterday in the uk England feels that she should be allowed to come back to the uk have to take on the financial burdens that she will create that I have to be responsible they have to be responsible for her pay for the security and so forth it doesn't come out of the taxpayer's money of the taxpayers money or pocket These muppets don't understand she would never be trusted believed and also she would have to have around-the-clock's security These people don't want us to come back to the uk 100% should get the bill She knows if she goes to any other countries they will execute her for what she has done Make no mistakes about that

No need to put her on trial. She hasn't just admitted committing vile inhumane acts, but boasted & gloated about them. These crimes occured in Syria, so that is where she should face justice. The fact that she hasn't been tried over their, is testament to the appalling state the country is currently in.

I'm no fan of hers, I agree with her losing her citizenship; the taxpayer shouldn't be burdened with her because of a choice she made * 15 years old is above the age of criminal responsibility and she has to live with the consequences - but why are people going to Ukraine to fight hailed as heroes but those who go and fight in other wars can't return? Just saying there seems to be a double standard here...

In the first interview she gave she stated it was for religious reasons, she knew ISIS murdered people and cut off their heads and she was fine with that, it didn't bother her, she's changed her story many time, why on earth would we want her back hear, her crimes weren't committed here, she'd cost us a fortune.

Not being punished, Shamima is being looked after by Kurdish authorities, well fed and able to promote her own celebrity status worldwide. Meanwhile the Yazidi women and girls brutalised by ISIS religious sex slavery have to spent the rest of their lives punished by that unimaginable trauma, if they managed to servive at all. Why does a devout Islamist actually want to live in an infidel country?

This isnt an innocent women, she is guilty and she doesnt even deny her actions. Yes we could try her in court but why bother? We dont want her here now or if and when she finishes her sentence. Because the likely outcome of a trial is she will be given a very lenient sentence if found guilty and then end up here anyway all funded by the taxpayer.

Trial now that's a joke as she joined a group who didn't believe in giving the people they murdered a trial , she says she has NO regrets watching innocent people being beheaded so please don't expect sympathy from us , we don't want her here as she does not deserve forgiveness

If we had a foreign national come here and commit a serious crime (as happens) we would expect to punish them here and then deport them, or even try them and deport them for punishment. if in the meantime, their own country revoked their citizenship, I am sure Mike Graham, based on his position over Shamima Begum, would be perfectly happy for said criminal to simply stay here and become our problem in perpetuity. Or maybe not, and he just hasn't thought things through, holding to principles that remain consistent.

The worst acts that she is accused of didn't take place within the jurisdiction of UK courts, but in Syria or Turkey. Indeed give her a trial - In Syria under Syrian law and then let any punishment be meted out there. Afterwards, she could maybe return to Britain to face charges for crimes committed here, but I've a feeling she won't be back in that case.

To allow any government of any political persuasion to be able to petition it's legal system and have that legal system agree and inact such a ruling is incredibly dangerous 🤔. It effectively means that those in power can act like like tyrants and the common man would have no protection. Laws aren't there to be popular or easy, they are there to be just and should be built on individual liberty of it's citizens.

If the government had made the law to seriously punish citizens who leave this country to join a terrorist organisation ie punishable for life sentence, then I can see a case for letting her come back to face trial. That means the only evidence needed is to show that she left the country with the intention of joining a terrorist organisation, or having left the country did join a terrorist organisation. That’s it. Other than that circumstance she should be made to stay away.

I get what you're saying, Mr Hitchens... And, for the most part, I think I've been - more or less - persuaded by your forceful arguments regarding her citizenship status (and her genuine 'right' to freely enter the United Kingdom of Great Britain). But perhaps you can explain why self-proclaimed 'enemies of the state' (if not outright enemy combatants) shouldn't have their matters heard by a military tribunal..??
