As crazy as it sounds, the police may have to pay for the window. The law gets really weird regarding damages occurring as a result of police action. We had a incident here recently where a man was in the process of being arrested and during the arrest he broke free, pulled a gun, and fired on the arresting officer. The officer fired back and shot him; now the city is required to pay this guys medical bills.

I’m not sure why you’re saying “anymore” because this case is over 15 years old, and the laws have changed since then. Most states have changed liability when it comes to smashing windows in times of emergencies. Now, the person that breaks the window doesn’t have to have a reasonable expectation of imminent danger for the animal or infant in the car. Also, a police man or a firefighter breaking a window or door is extremely different than a random citizen breaking it, because they act on the behalf of public safety, while a private citizen may not be acting in that same interest.

The fact that the US judicial system supports people ignoring endangering of animals and humans when they are locked in a place is an extremely bad precedent. What it tells me is “if you see someone or something being locked up and will die if you don’t save it in the next 2-4 minutes, you should NOT save it if there is any damage you would have to make to save said thing, even if damage is minimal and reasonable.” Thankfully I don’t live in the extremely corrupt and extremely anti life saving United States but if I did and I saw a child or pet in a car, I would have no choice but to leave it as it’s death is inevitable due to me not legally being able to save it. The law is on the murderers side. The United States cares more about $100 in property then an animal or humans life. Thinking about it though it actually makes sense. Since if they ban abortions then the only way to get rid of the child is to kill it after the fact legally. And the best way to do that is to leave it in a hot car and around people who done know that the law states it’s illegal to rescue the child/pet, that way they break in and they are 100% liable! It’s brilliant! The United States is so morally correct and 100% safe for all humans of all people.
