Because the state has to bring those charges. The jury can't just pick and charge and decide that's it. Instead the state has to give them the opportunity to find the person guilty of a lesser crime. Prosecutors sometimes only have murder and the person gets off when they would have definitely been charged with something less, look of Casey Anthony. That's why she got off. It was the Prosecutors fault for having murder or nothing when the autopsy couldn't even prove there was murder. So that's why this happens.
