As a self-defense shooting survivor I can bring some reality to the table here. Im a private investigator and in 1987 was serving an eviction summons. After serving the documents I was pistol whipped to my my head cutting it open with significant blood loss. This happened at night in near total darkness. I went down on my knee grabbing my five shot revolver and got up. I pointed it in the direction of my attacker screaming for him to drop his weapon. His response was telling me that he will kill me. I then fired all five rounds stricking and critically wounding him. He never fell or dropped his gun. I couldn’t tell if I actually hit my target. I then fled for my life. (This was before cell phones.). I did not call 911 but proceeded to the hospital. Somehow I lost all my memory of the hours before the shooting! However I remembered the shooting itself. I recounted privately to my lawyer how I felt the grass under my feet. I thought positively that I knew my position at the scene. Of course there was a blood trail on the ground that marked my position. Later as I reviewed photos of my blood trail I learned I was not near grass but was on gravel! Had I told that to police they’d have made a liar out of me in court! As I fled the scene my assailant’s son came out with a shotgun and a next door neighbor responded with a .38 revolver. Thankfully I was gone already! The corrupt small town cops came to the hospital, arrested and tried to question me. I immediately invoked my right to legal counsel. The detective did all he could to conspire with the guy I had to shoot and his family to frame me. Witness and serious evidence tampering began and I was indicted and I was forced to stand trial. However, at trial I proved my attacker and his family lied under oath and was acquitted in only four minutes of jury deliberation! I think that’s a world record short time. After the verdict was read, the jury foreman jumped up and said the jury demanded that my attacker and his daughter be charged with evidence, witness tampering and perjury. Eventually they were and pled guilty. My Pima County, AZ prosecutor, Keneth Peasley was disbarred for knowingly producing perjured testimony in an unrelated death penalty case. Today I specialize in defense investigation of self defense deadly force cases and have 15 out of 15 cases with defense verdicts. I’m licensed in CA and AZ. My bottom line is tell the cops only four words, “I want a lawyer.” Save your story for the courtroom!

I am a recently retired detective and was a patrolman and a field supervisor. First, you will be stressed and nervous after a shooting, and that's normal. The responding officers will be stressed en route to a shooting call and upon arrival because they don't know what they have until they arrive and secure the crime scene. Do everything the police officers say until they secure the scene and sort things out. If safe to do so, secure your firearm in your holster and locked inside your vehicle or vehicle's trunk before their arrival. The responding officer may be a rookie or experienced patrolman or a lazy patrolman. The police officers will attempt to talk to you to check if you are injured, ill, under the influence of an alcoholic beverage, controlled substance, or medication. The police officers may have bodycams on their persons and may have dashcams in their patrol cars, so if you talk to them, it will be recorded on video. When speaking with 911 operator/police dispatcher, describe the suspect(s) first, and anything meaningful about the suspect (s). You want the police officers' attention on suspect description(s).

My wife was emergency dispatch and she has confirmed numerous times the horror stories in terms of breakdown of communication between the caller, the dispatcher and to the responding officer. I spent 6 years in the military, I've done a lot of training in and outside of that profession. Continue to take classes and training even now that I'm out. Stress/fear can cloud judgement and result in hasty actions that would've seen appropriate in the immediate action but later heavily scrutinized. Personally I strongly disagree with qualified immunity for a main reason that it actually holds civilians involved in shootings to a higher standard than police. And it seems in this day and age law abiding citizens are more so targets than actual criminals. This all being said me and my wife both agree in the instance of something like a home invasion that police aren't called till after the fact. 1. More focus on defense and not talking on a phone while stressed 2. Nothing on recording that would potentially be used against me. Many say this is stupid but that's just how I see it. They show up after the fact we agree to tell them we aren't giving a statement till we've had time to recollect and seek a lawyer.

I have been following Andrew for over 10 years. This topic has been evolving for that time. Andrews version of this topic is not repeated well in other criminal defense attorneys. There is more to it than just shutting up. But it is clear more than 90% of people would probably be better off just shutting up. George Zimmerman's video explanation at the scene went well for him. I would never tell anybody to do what George Zimmerman on camera. I've come to know Andrews professional responses so well I knew the answers.

Not with LAPD. The officer is interviewed that same day. Unless he/she was injured and taken to the hospital. Sometimes the officer waits for hours, I’m talking , it could be 8 to 12 hours before they are interviewed.

When I was involved in a LEO shooting I conducted the investigation. I filled out all the primary paperwork. Investigator took witness statements. But my report was used as the right way to write a report. I wrote thiss report within an hour after the shooting. Thank God nobody died. If I am involved in a self defense shooting I intend to cooperate fully and give a full statement. God bless us all.

Good point about the dispatchers communicating incorrectly. I once called my local police to report an agressive loose dog. I told the dispatcher I hope I wasn't going to get the dog shot (by police). The responding officer said I had told the dispatcher that *I* was going to shoot the dog!

Rule Number One - do NOT talk to the police aside from basic questions. This applies to rules one through nine. Rule Number 10 - you CANNOT talk yourself out of an arrest, but you can most certainly talk yourself into one. Accept the fact that EVEN if you are justified in the situation you still may be arrested so accept and be prepared for that.

Rule #1 *DON'T LIE* No matter how justified you were, if you get caught lying about the smallest, least significant detail, they'll pull that thread until your whole life unravels and see what falls out. There was a road rage case in my city recently, where a driver pulled a gun and got himself shot. The shooter gave the good ole 'He just pulled a gun, I have no idea why'. Then they found traffic video of him driving like an ahole and flipping off the guy that pulled the gun. You cant pull a gun over rude gestures and it wouldn't have had any impact on his self-defense claim... until he got caught lying about arguing with the guy he shot.

As a self defense and civil rights attorney who has represented people who have used deadly force with fatal results, a lot of what Branca says is correct. I happen to work in a location that is very self-defense friendly so that is a caveat. In my opinion you NEVER say you are invoking your right to remain silent. You say you will be giving a statement after conferring with your attorney and under the advise of counsel. Let the lawyer negotiate the number of days/weeks before you submit a statement. There is nothing wrong with submitting a carefully worded written statement under the advise of counsel. I do agree that it is important to let the police know immediately of any witnesses or evidence that may be pertinent at the scene as those could be lost forever. Thats a hard call to make at the time but there is probably no way (unless a lawyer is VERY close and available) to avoid that conundrum.

Prepping people/clients to stick to a script to the police in real time under an intense amount of stress is IMPOSSIBLE. I'm not a criminal attorney, but as a civil rights attorney for almost 30 years, I can tell you from my experience that sometimes prepping a client to say certain specific things under stress can and will backfire. Dealing with the police immediately after using your gun in self-defense is immensely more stressful. My advice is always NEVER TALK TO THE POLICE. Always best to assert your 5th Amendment rights, request an attorney, and stay silent for the next 24 hours you'll be in custody and under intense pressure to give a statement. Do not give a statement. Ever. No matter what they say or promise you. They are legally allowed to lie to you to get you to talk to them. You see? Never talk to the police. They will never help you out, even though they'll tell you that. That's all BS.

The time to know what to say is not after the incident. Its long before it ever happens. You need to practice before it happens. It needs to be trained into your response the same way you train to get off the X. Practice it. You respond like you train especially after the adrenaline kicks in. Under any circumstances, DO NOT talk to a police officer. Anything you say CAN and WILL be used against you. The police are human, and CAN twist your words to end up making you the criminal. When you end up on the witness stand, your early statements to the police can and will be twisted around by the prosecuting attorney. Remember the old WW2 Navy motto: "Loose Ships Sink Ships". My CPL instructor informed us in the gun safety class these 5 points. FIRST: Have the phone number of a Defense Lawyer in your phone's directory. SECOND; The First phone call you make after shooting someone in defending yourself,, IS THE LAWYER'S OFFICE.THIRD,: Then call 911. FOURTH: Call your loved one or friend informing them that you shot someone in self defense. FIFTH: Always remember that you are allowed to make one phone call after being arrested. Use that one phone call to notify your loved or friend where you are calling from, and have them notify the lawyer by name, where you are being held under arrest. My gun safety instructor was a a retired decorated police officer. He told us of many righteous self defense shootings being turned around against the innocent shooter because of mis - statements "heard" by the responding officers in comparison to the rightful self defense shooter. My instructor's bottom line was this: NEVER NEVER get into a seemingly casual conversation with the police officers without an attorney present. Only identify yourself by handing the responding officer's your driver's license, or state I.D.. Wait until your lawyer arrives at the police station, to confer privately with him or her FIRST before being questioned. That will be the difference between you going home to sleep in your bed at the end of the night,, or you going to jail and sleep in the bed of a jail cell at the end of the night.

They are trained at the police academy to psychologically make you feel that they are on your side, that they are your friend. But the bottom line is that they want to rack up as many solved cases and as many convictions as possible on their police service record. That's in order to go up the ranks from a flatfoot street cop to Detective or Sargent or some other high ranking position which puts more moola in their paychecks. Any Lawyer will tell you, when it comes to speaking to a cop in the street or in a closed room at the police station - KEEP YOUR MOUTH SHUT UNTIL YOUR LAWYER' CONFERS WITH YOU PRIVATELY.

Here in Chicago we just had an incident that involved road rage both individuals are concealed carry holders the victim was struck six times in the back stated she never branched or discharged weapon assailant says he feared for his life discharge weapon six times on expressway. How can you be threatened if you fire six times in the back of a vehicle that is in front of you

We need to revamp fifth amendment jurisprudence to eliminate a bunch of the exceptions (sworn testimony in other contexts, the hearsay exception for excited utterances and statements against interest, etc.). Any statement by the defendant, at least in a criminal trial, needs to be treated as presumptively more prejudicial than probative, maybe with exceptionally rare exceptions.

I was ARRESTED after I stoped a girl from getting killed and myself getting struck in back of head by 2x4... by watching videos I realized after I got hit I went to pull out gun and he had dropped wood and had back turned and leaving... I ended up choking them out and the girl I saved ran, he was out and I had a gun... I just said I stopped attack, let 911 know I was armed and my shirt color..... I was arrested as he said I attacked him.... I just gave my name.... 16 hrs later after video reviewed, girl found.... I was released.. guy got 7 years

The game of telephone is real. My neighbor’s adult grandson began screaming yelling at and haranguing them for about fifteen minutes. My wife and I decided to have the police make sure everything’s alright. They of course came to our door presuming I was beating my wife. Took about ten minutes to convince them otherwise all the while audibly the grandson could be heard shrieking obscenities at two eighty year olds.

As a 24 year police officer with about 50 schools and court experience behind me I know the ins and outs of this. From the attorneys point of view it is correct but the practicality is often different. I even understand that from the lawyer's perspective getting getting arrested is no big deal but someone who never got arrested it can be pretty traumatic. But most importantly in many states with good self defense law not telling basic things to the police like "I was attacked, battered, shot at and I was fearing for my life I had no choice but the produce my legal firearm and respond!" etc. Some states you won't get arrested if it appears self defense is the case. Matter of fact it is spelled out in the law! Of course there is a danger that people say too much and that is a danger for the defense.

Nothing a suspect says is safe when talking to the police, not even with a lawyer present. The only way to be sure of the correct answer is to absolutely know what the police claim and if the cop is absolutely honest. Even if the cop is honest, they are not perfect: compare the misheard lyrics phenomena, for example, I thought the song “Gangnam Style” was saying “open condom star.” I could only tell after somebody told me what the song actually said. Sometimes, the suspect tells the truth and the cop lies, but the judge and jury believe the lie, not the truth. I don't advocate never talking to the police, but it should only be to assert and exercise Constitutional rights, such as requesting a lawyer. (At least one court upheld a conviction of a driver for refusing to report an automobile accident, on the grounds of the right against self-incrimination.) I like this lawyer, take his advice. If you are like me and do dumb stuff like drive-through checkpoints merely to exercise and assert your rights (I don't drink or do drugs, but suspicionless checkpoints irritate me), don't do it. People have been arrested with 0.0% blood-alcohol content or using prescription medication). I have been assaulted by a police sergeant with a package of Halloween teeth, for example, because the cop didn't like me telling him to lie on his police reports through the candy teeth so he didn't need to use his own teeth to lie through.

BULL! After a self defense incident, you are in no shape to calmly talk about anything. You can easily be manipulated into saying something self incriminating. There is a video on this on KZbin, btw which explains in far more detail how anything you say can possibly hurt you, but CANNOT HELP YOU.
