2:18 - You will NEVER know if the burglar is just there to steal, or what lengths he’ll go to when you turn on the lights and he feels like he’s been caught. You can’t take chances with your family and hope the burglar is just there to steal.

It would depend, If I am at home and I catch someone stealing something and he or she is making no effort to attack me then that would not be OK. Moreover, if I was coming home and I caught the burglar AFTER the fact say running away with my belongs that would CERTAINLY not be OK and that may even be charged as murder as opposed to you might could argue voluntary manslaughter in the first case depending on the facts.

Of course the second part is true legally, but, again those cases are rarities. Put your "cases" links up if your so sure. Oh and while you're at it, included the number of cases where it DOES happen just as the OP stated. That way it is clear as day that you aren't wrong.

These self defense laws just breed cowards. afraid to stand up and protect themselves, family and their property. The SECOND someone enters my home I’m not going to wait around to ask them “you guys stealing or trying to hurt me?? I have to relay this to my lawyer “ smh🤦🏻‍♂️

Ok, that second point needs clarification. How is a homeowner supposed to predict the intent of the person who just broke in when we know people have, can, and too many times DO die in home invasions?

Basically a criminal can use whatever forces whenever he wants, in whatever way, to commit a crime without being killed. But a law abiding citizen can only use a deadly force when the criminal starts pulling gun or running towards you with a knife, and you will be charged for murdering or manslaughter if you stop them running.

Who the fuck has time to sit there and figure out if someone breaking into your home with a mask on is there to burglarized or cause harm? What do we do ask him? I think it's universally assumed that if someone breaks in Your home in the middle of the night you theres a high possiblity you might be killed.

So basically the law says if you are a law abiding citizen, you cannot use deadly force to eliminate a threat unless the it is a threat to your life, but a burglary can easily run away with your belongings such as your life savings, if he is quick enough to turn his head and start running.

Unfortunately NEW York State has minimal if any stand your ground or self defense laws. I was getting BEAT up and strong armed ROBBED collecting money 💰 from a previous plumbing job with my 6 year's old daughter when a Tennant began beating me yelling, "give me the money 💰 BITCH!!" I swung a 18" long 1" steel gas pipe at his head with everything I had he blocked it and I broke his elbow, he came after me again and I smashed him in the back of the neck putting him temporarily out of commission in front of witnesses who told police they witnessed the robbery and "The plumber" protected his daughter and himself. After speaking to 5 different witnesses who All said I protected myself and daughter from a very VIOLENT felon the police came to me and I am thinking if they are going to ask me if I want to press charges. Instead she said, "Put your hands behind your back, you are under arrest" I thought she truly was joking but she wasn't. On the way to police station (my wife picked up daughter and service Van) I said I don't want to answer questions. I told her 5 minutes later I recently had rotator cuff surgery and being cuffed behind my back is very PAINFUL. She said, "Sorry you declined to talk to me so I can not speak to you" at the jail waiting to get in I was put in a cage inside a closed garage waiting for sheriff's to open the door 🚪. After another 20 minutes I told her place the cuff's in front of me my shoulder is killing me due to recent surgery. Another, "NO, you are a VIOLENT felon" I told her I am in a cage inside a locked garage with two armed police officers here what am I going to do? Finally after another 20 minutes I heard the sheriff's say over the loud speaker to uncuff that suspect. Finally the bitch did it. 2 years of going to court and $15,000 in legal fees later the case was thrown out of court

Shouse Law Group I believe where you stated if someone is going to punch you that's not reasonable to use lethal force. Your life is in Danger you could get knocked out and could get Stabbed or a Beating to death while unconscious and so on if knocked out. What if the aggressor is 6ft 250 lbs and the victim a woman 90 lbs I believe that's invalid. A push or shove would be more valid.

Just like a police officer, you have to have articulable facts as to justify your “fear” if you are 5’5 small person, alone in the dark at night who has never been in a fight, and the agrresor is 6”7 big tattoos makes very aggressive mannerisms and threats and punches you in the face I think it would be reasonably neccesary to use deadly force to prevent GBI (great bodily injury) or death. There was a case with a cop just recent in Florida, where a big muscular guy Flash KOd a cop and the cop shot him (later deceased) justifiably. On the other side, if someone looks at your wrong at Walmart and you stand up to be tough because you have a concealed carry permit, and he throws a swing and you shoot him dead it might not look so great

CALIFORNIA CONSTITUTION ARTICLE 1 DECLARATION OF RIGHTS SECTION 1. All people are by nature free and independent and have inalienable rights. Among these are enjoying and defending life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy. Doesn't this mean we do in fact have a right to protect property?

Just the act of breaking and entering, regardless of what you believe or interpret the perpetrators motives or capabilities are, make the use of deadly force justified under California Castle Doctrine. This is per: People v. Silvey (1997) 58 Cal. App. 4th 1320.

So to a degree it's okay to shoot. Say the criminal charges at you or at a family member bare handed, during home invasion, is it okay to shoot them in the leg to drop them? I understand if they have a weapon, then it's okay to shoot in order to eliminate the threat.

If you take the time to watch this video the law expects two or more parties to know better than to resort to violence. What kind of "reasonable mindset" would carry lethal force and risk violence? I have a question someone please answer. Let’s say someone is extremely upset with me and messages me “yea you fucked up ima see you soon” I go out and get a gun not to look for drama but to feel safe. Now let’s say I’m at a gas station or a corner store and said person happens to find me get out of there car and want to hurt me yet they are unarmed no knife no gun but they plan on doing physical damage to me and I pull out my gun. Not to kill of coarse but to just stop the attack and hopefully scare off this person an let them know I mean business about leaving me alone, say they don’t listen continue to approach ready to wrestle for my gun or beat on me or whatever if I were to shoot them in the foot (so it’s clear I’m not trying to kill) would that be considered a crime. I live in California a state I know is very fishy on these types of situations. Thank you for reading I’d appreciate serious responses.

Observe how you explain. You have to keep a reason.(why)Maybe the person had only a rock. But you need to explain how this person was trying to harm you. Perhaps person had multiple rox. Maybe only one but had thrown a bit of trash at you. Next was going to be the rock. Perhaps person played base ball. So that was why. You honestly where not sure totally. Perhaps a throwing 🗡️ or star. Perhaps the person was an x fighter- wrestler. "All with in reason."Person charged attempting to get my gun. You asked person to leave. Told person of your gun. The person was high or drunk charging at you. Stick, 🔪 and crazy on the attack. Maybe an x con. Just got out. Who knows.
