Why is no one reporting on the fact that the US patent and trademark office issued a flat denial over the weekend for use of the name “American Riviera Orchard?” The trademark Examiner did not just have a few minor issues, he had a fundamental problem with the use of “American Riviera” and/or “Orchard.” Megs is going to have to start over with an entirely new name. Every single thing they want to sell is already being sold by companies either called “American Riviera” or “Orchard”. Clearly, their name choice was monumentally stupid. And their 3 applications are still unsigned, as of Saturday. Despite being warned several weeks ago. So I suspect they are behind in paying their legal bills. Because they are using a respected Intellectual Property firm, so the most likely explanation is that they ignored legal advise (dont use a geographically associated name) and their attorney is not generating work product without being paid. My ex was an IP lawyer: “no money, no work” is the hill they will die on.

The USPTO is a Federal Entity. I read their application when it first dropped at uspto, along with all the approved and denied applications for companies using “american” “riviera” and “orchard” separately or in combination. It was very clear to me that their application would be denied. They would have to buy the trademark rights from at least 6 other companies to use ARO. Yes, I am a Patent and Trademark nerd.

I was watching the Johnny-Amber trial live, and I was impressed by the way the lawyer (I forgot her name, shame on me! She was the best) persisted with questions for clarity and detail. Not a native speaker, but for sure Meghan's Spanish accent was all over the place. She spoke with an Italian cadence most of the time. She sometimes pronounced "yo" as "zjho," which in my area is typical of folks from Michoacan, MX. I had a Cuban acquaintance at one time. The tend to 'swallow' consonants, especially terminal consonants. "Muchas gracias" would sound a lot like "Mucha Gratia." She may have had multiple people coaching her, with different accents. You'd think she would notice that though. Perhaps she did it deliberately because she wanted the attention.
