Oddly, I show up today for my mandated physical only to find our it was canceled by the ssdi person.... when I called they said they had all medical records going back year. I just don't know what that means.

My partner had a long, complex and difficult case. We watched almost all Jonathan Ginsberg's excellent instructional videos to prepare our documents for court. AMAZINGLY the judge ruled in our favor just before the hearing! We were told he was highly impressed and said our case was so strong it should have been been ruled in our favor before it reached him. I have been fighting disability for almost 7 years! I have been through for lawyers and then denied about 7 times and I'm on my third appeal with my fourth lawyer! My surgeon and my primary doctor have both written notes stating that I am totally and permanently disabled but disability just over looks all of that! It's not fair to the people that need it like me and then people that can work get the disability! Why??? I really feel that they do not even look at your medical records that you send in! The amount of mental stress a person has to go through for Social Security Disability should be added to the overall accounting of benefits you receive. That's my opinion. I had my hearing Oct. 12th 2018 and was lamenting about that. Afterwards, my lawyer says it went well but now Im waiting for the final decision. My financial situation is running on fumes and I had to pay almost 7K for dental procedures after I cracked a tooth back in July. Talk about draining resources. I think I will be approved but this forever waiting is mentally draining. I don't want to file for bankruptcy either. These are supposed to be my "Golden Years".

Sorry to hear this. Hope it don't go the same way for me. I just had my hearing on March 12 this year. Oregon normally has a turnover rate of 4-6 weeks after a hearing. But the process has been 2 years.

I just had my hearing today and the occupational therapist said there were no jobs favorable for me to do. I was nervous, but I do feel better after the hearing. Watching the video helped me feel better too.

Congratulations, I just had mines (by phone due to the coronavirus) this past Monday 4/27/20 and my lawyer said it went pretty good. The vocational witness expert answer no to all questions about there being a job for me out there. I will update you later to see if I was approved. [Updated] Hey everybody I am happy to say that I was just approved for my Social Security Disability on May 22, 2020. It took me 10 months and being denied 2 Times. The guy said there was 2 jobs I could do which was watching cameras at a hospital or business and cleaning eye glass wear but when my lawyer ask could she lay down if needed and miss 5 to 6 days a month due to medical issues she said would she be able to hold those jobs & he said well then NO. The judge said that's all I needed to hear. Do you think that went good for me?? I'm so worried. I've been fighting them for over 3 years now.

Funny story... Today 11/09/2020 I was watching this video. I watched most of your videos all day taking notes prepping myself for my telephone hearing with the judge at 8:30 in the morning. I received a call from my lawyer at the 7:13 time mark of this video. My lawyer informed me that the OAD’s office called and canceled my court date and the judge was giving me a favorable decision. I was overcome with joy and mad at the same time because I had 5 pages of notes front and back. I felt prepared, calm and confident because of you videos. Thank you for what you do 🥰

I had a hearing today and a vocational and medical expert was there. Medical expert said I met the requirments for blue book listing and explained why. Medical expert also stated how long I met the listing. The judge bascially said ok and court was done, less than 15 minutes. Me or the vocational expert did not have to testify. My lawyers said good news I won my case fully favorable. Thank you for providing an accurate account of what to expect.

I'm out of Michigan and I'm seeing a judge and Livonia judge McClain I think it is and I was denied once and this time he's postponed my case 3 times just so he could get information for me because my file was pretty much empty because I was in prison a long time ago and used an alias and so he's postponed it and he sent me all my medical record mental records and I had to get them in there and then in 10 days I should have a decision do you think it's promising that I'll be approved thank you for all your advice

Found your channel and have been watching a lot of your videos the past couple days. I was pending a case for 20 months and the day to throw the dice was yesterday. Extremely stressful, and I found a lot of stability after watching many of these videos. I got a tough judge apparently, but I believe it went well. I'm hopeful and I think I'd be panicking if I didn't have some education from your insight. Thank you very much for posting these. I'll know the result in a couple months and I'll be sure to follow through with my result. At my hearing I was presented a hypothetical about if I could return to my prior work, which was no. But I could do grocery bagging and laundry washing. After that a second hypothetical added in my mental limitations and suggested I'd be off task for 15% of the time, and absent 4 days a month. To which there was a firm no in response from the vocational expert. The hypotheticals ended at 2, and the judge thanked my lawyer for having a well presented case. I was respectful, referred to him as your honor, and though it was telephone only I believe he understood I was sincere about what I said. I don't think I would have walked into there with confidence if I hadn't stumbled on your channel. Thank you!

Had my appeal hearing a few weeks ago. When it came to the hypothetical questions the judge simply said “ based on testimony and the records before you, are there any jobs available”? The answer was no and the judge said “ok, I don’t need anything else and will write my decision “ hoping for a good outcome since that was complete different from initial hearing

I got the worst judge in my state, and he basically just crucified me and my witness as unreliable in the hearing. My attourney made it so the VE couldn't find any jobs I could sustain for any period of time. But I'm 100% sure because of how he acted, my case is being denied. He asked me questions that neither me nor my attourney even thought of preparing for. Thank you for your videos and help, but I guess there's really no helping a judge who seems to play god with people.

I am Bipolar II... had my hearing yesterday March 12 2019, I made one small mistake that might not look so good, I lied about one small thing,l judge ask me if I cooked, cleaned and did chores around the house, I told her I did the chores but did not cook ...she said well it says here you told your counselor you do all the cooking at your house, I didn't want to say I cooked because I was afraid of what they thought as far as a man doing all the cooking, in my culture men don't do house work period or you will be looked down on...the truth is that I do alot of the cooking at home...I'm worried now that because of that one small mistake I might get disapproved..everything else was on point as far as my attendance and mood swings at work that has led me to termination, other jobs I have just left on my own do to my illness....my job listing that I am able to do was only narrowed down to 1 job, my lawyer said that my statement was good but it's a 50/50 chance because the judge is a conservative...in my mind I was like, WTH is that! I had to go Google it and was a little discouraged...I should've been completely honest about everything....

Paco Shark Conservative judges are the worst of the worst. Hopefully you will get yours soon. Ive been waiting almost a year for “my hearing” date. I have 2 spinal injuries , daily pain, depression , anxiety, and wish I could just be normal but while Government employees can retire after just 20 years of so called “service” they get their Pension and health insurance FREE while we have to fight for ours. REPUBLICANS want to attack SSI,SSD, Medicaid, Medicare because THEY have dipped into money that DIDNT BELONG TO THEM in the first place. Whole system is trash IMO.

My opinion on this matter: It doesn't matter. If you win, you won. That was the goal, that was the focus of all your efforts. If you lose, you will need to adapt and respond to that circumstance and hopefully already be prepared well in advance. As an athlete, I would never know how big of a trophy I would win or where I would put it, if I lost it wouldn't be relevant. And there have been times I've later found myself struggling with the problem of how to get it back home with a vehicle packed full of people and equipment. Always stay focused on the goal, put all your efforts into achieving victory, especially when it is desperately needed and hard fought. Once you know the results, go from there. Athletics are pretty swift with instant feedback, courts not so much. Be patient and diligent in times of uncertainty, and take that time of uncertainty hoping for the best, but get a head start on planning for the worst.

It took me 4 years to get approved. They finally had to move my case from Cleveland to Connecticut to help with the backlog. this was 2004 - 2008. From the time connecticut got my case it took about TWO or THREE months before I won it,

This was extremely helpful, because of covid I had to do my hearing over the phone and I've been going crazy waiting for the judge to give her discission . I ( and my lawyer) think I have a strong chance but nothing is ever a 100% certainty, but some of the things you said gave me a lot of hope. One thing the judge did say before the vocational expert spoke was " we are going to treat this arm as an amputation " which I would think would be an extremely good sign, also the expert only listed 2 possible jobs but the number of available ones country wide was extremely low and that was not even factoring in covid , or my other injuries that would make it impossible to do them. Once again thanks for the video!

I became disabled in 2015 , represented myself because I wouldn't fake an injury . I was denied 2015 and 2016 . I was finally approved after my first hearing for 2017 and stumbled upon your videos a couple of months ago and they did help with my 2nd hearing this past week . I thought I angered the judge twice with my ignorance so I didn't think it went well , but after the doors closed the secretary told me it looks like it went favorable for me . I've been donating plasma twice a week for over a year and that's way too often for a healthy person ! It honestly would be easier for me to go to work but I can only swing a hammer one time . This sucks !!! Thanks for easing the mental pain of feeling like I've slipped through the proverbial cracks of society . I've driven million dollar tanks and built entire neighborhoods and now I can't hardly ride a bicycle ! Social Security ,...fixed income ??? It's really social insecurity with a broke income . Thanks for the clarity in a mire of confusion !!!!!

I have watched many of your videos and they helped me feel better prepared thanks to your advice. I am super nervous because I feel the vocational expert wasn't very helpful in regards to my work capability of going back to work. I'm not in the same situation health wise as I am now. Rarely, a judge will tell the claimant what the decision will be at the end of the hearing. I would say this happens about 1 time out of 10. Your attorney/representative will often have a good idea of your chance of winning, based on how the judge reacted to your testimony and especially what the judge's questions to the vocational expert were. Mr. Ginsberg is right on target with his observations here.

Judge approved my case in 3 minutes he thanked me for my military service and said he was bypassing all the steps and asked the vocation expert is there any jobs out there for me VE said no judge told me i was approved my lawyer told me that was fast - it was a good ride home !!!

Even with my VERY low available work for my condition, with years of medical records, Spinal Stenosis, & mental disorder, if you got a judge that only approves like 15% of cases, you have no chance!

Thanks to you I now know my Judge has a 64% approval rating for 2018 going back to 2009 nothing less then 60% and 70% at his highest, I know he is fair and values credibility over all. I just had my hearing on 09/15/2020 I have lupus, fibromyalgia, arthritis, PTSD, and depression and anxiety Al are documented in records. I'm 39 and at the end of hearing vocational expert said three jobs that were light but when the judge ask the vocational expert hypothetical questions for those three jobs she said, no. My lawyer didn't have nothing to say at the end he called me and said great job and he said he just need to send all my medical records because all she has is the rfc forms the rhumatologist and phycologist signed. My attorney said he so proud of me and my testimony he put a star by my name. I been dealing with SSI for 5 years. I hope I get approved I can't work or think in the condition I'm in.

Just had my hearing over the phone due to Covid restrictions, I was asked questions by the judge the doctor and the judge never asked the vocational expert any questions, when it was over I didn’t understand what the out come was so I called my attorney and he said the medical expert read my mri’s and past medical visit Dr. reports and sided with me and that the judge didn’t ask the vocational expert any questions so he said we won the case, I hope he’s correct now waiting for letter.🤞

This is my second time in front of a AJL and my medical records were very well documented. The judge AND my attorney determined with the VS that I couldn’t work the jobs she mentioned. I knew then I would get approved.

I have to say, I had my hearing yesterday and my lawyer said it could take up to 1 hour, well, it took less than 10 minutes and the judge never asked me anything other than my proof of my name swear me in then they called a psychologist first and then it was over just like that. Listening to what the doctor and judge were saying about exhibits and my medical records, it sounded as if I was meeting 90-95% of the criteria, and the doctor was using words like"disableing" "incapacitating" "severe" and so forth. When my lawyer and I left the courtroom he told me he thought It was favorable because of how my medical evidence was, still have to wait and see. For the record, I can't stress enough to anyone how important your consistent medical documentation is, I have records all the way back to 1988. It is absolutely crucial. I'm 37, I am diagnosed with bipolar, depression, anxiety, agoraphobia, dependent personality disorder, turrettes since age 7 and ODD, OCD, and ADHD. I have took soooooo many different meds throughout my life I could never remember them all and still take meds to this day. I have worked in many different fields as well and have had almost 30 different jobs since I was 16. I tried not to give up and It sucks trying and failing over and over, I guess mental health finally took its toll on me. Good luck to anyone out there in a similar boat. FYI, it took me 14 months from application date to hearing date, now I'm waiting some more. I consider myself lucky to be where I'm at in the process in the amount of time it has been.

I had a hearing and the judge told me to just stop being lazy and get a job. I did that, ended up in the hospital many times afterward. It’s so frustrating that no one will help me or try to offer help.

The judge asked the VE if there were any transferable skills and she said no. He added some hypotheticals and she said yes, 1000s of jobs which was still none in large numbers. . Then my attorney got to cross the VE and it ended with absolutely No Jobs.. Attorney went for Grid Rule 201.14 I received a fully favorable decision.

I live in the state of VA. The rehab man said there were jobs i could do, twice, then the judge asked him if there were jobs with my conditions, currently that i could do and twice he said no. My attorney said i had a fair judge and he wasn't sure id get it or not, bc it was up to the judge. My hearing lasted about 45 to 50 minutes. I pray I get it this time

I have my hearing early April this year and I am very scared to go. I don't explain things very well, I lose my train of thought and sometimes I can't even speak at all. I have multiple physical disabilities and a few mental, plus just now getting diagnosed with bipolar. It's too close to my hearing to submit much more evidence so the judge won't even know all the information from this months tests and new diagnoses. Plus every time someone asks me about my problems I just start crying, I can't even control it. But I will do the best i can. Thanks for making this video, I am still terrified but listening to you helps.

Attorney Ginsberg, I want to thank you for your excellent and informative videos on SSD. I retained counsel in my case and recently was advised that I prevailed. The process from filing to the final decision was approximately 7 months that included a medical IMA and Consultive IMA. I did not have an appeal or need for a hearing before a judge. Although I had a well known law firm representing my case, the best advise and information I received to prevail in my case, came from you and your very informative videos. I watched very many of them. I do want you to be aware though that I initially contacted you and was referred to another firm because I live on the East Coast. Your referred firm actually told me that I did not have a good case and was not interested to represent me. However, they were very wrong in their analysis. Fortunately, I persevered and contacted a well known firm in my area who realized that I had a slam dunk case at the onset. You might want to revisit some of your referred firms because I’m not sure they’re on their game. Thank you again for your wonderful videos on SSD. All the best to you Attorney Ginsberg!

My court date is coming up in may i an so afraid that i wont get approved i been waiting for 1year and a half i suffered from depression, aniexty and other elements i been see my pcp psychiatrist and therpist i got the name of my judge and to me he seen like he is 50-50 he approved half and denied half so i dont what will be the out come of my case i have being listening and reading comment about how people won their cases and lost their cases now im in the same boat wondering if im going to win or lose my case the lawyers dont know they kust have and ideal on whats going to happen they have to wait just like us so having depression doesn't weigh that much any more as Jonathan described well the only thing that i have to do is pray and asked the judge to have mercy on my case because i really is living on hard times awaiting on this hearing i just have a month now and its seen like for ever lord please touch this judge heart so that he would approved my case good luck to everyone that is awaiting on their hearing

I got my favorable decision today 4 years and 3 days to the mark. Horrible thing happened 3 months before my hearing, my doctor lost his business for insurance fraud, yep locked the doors, that was it. When my lawyer called the doctor's office to get my medical file they told him they hadn't seen me for over a year, I couldn't believe it, I had seen him every month for the last five years up until he got his doors locked up and they had put a sign up saying he was on medical leave and left a phone number to a pain specialist doctor, I couldn't believe it, this is the doctor that told me to apply for my disability, I thought I was screwed. So my attorney told the hearing judge what happened and what the hearing judge did was set me up an appt with one of their disability doctors, that was cool, but I always heard the more medical records you have, and my doctor had 5 years of my medical records, the better off you are. Man I'm glad the judge went that extra mile with me thank you judge. You just never know. Good luck to you man.

I have my hearing this morning. It’s going to be a phone hearing due to the pandemic. I am very nervous. It’s been a miserable 2 years that I haven’t been able to work or make any finances. I really hope it goes my way. I have Quada equina syndrome and had back surgery. I suffer from back pain, extreme numbness and loss of bowel and bladder function. I’m only 36 years old and my life has become very miserable. I hope they have mercy on me😢🙏🏻

The judge I had yesterday (I'm dealing with a hearty set of mental diagnoses) he and the voc rep asked the questions set almost exact to the example you have. They went over 3 jobs that people with similar issues have, then the hypothetical questions. He asked two, one bases on my lack of attention, and and other about missing so many days (with my issues, I have to have stays at a psych ward to .. wind down) both answer from the voc rep was a stern strong No. This gives me more hope that I will get my case. Again ik there's still a chance of being denied, but you have helped alot! Ty for giving a resource for people seeking disability. My attorney told me I pretty much won” due to the Conversation with the judge and VE.. I actually never heard the VE...say anything I was asked if I could Hypothetically If I can operate as a cashier... I said no due to my meds making me lose footing... I was asked could I do chores at home I said to walk to the mailbox and bring a empty trash Container to my garage... After that Attorney my attorney asked to bring In my mom...she spilled the beans on me being a cutter. A few moments later my attorney said the hearing was good and I pretty much won the case. I won’t Count my eggs before they hatch.

Thank you for your video on this topic. I have my hearing tomorrow and am, as I'm sure most are, incredibly nervous. This just gives me a little reassurance going into it that things *should* be fine. It's tough after dealing with ERISA disability for a while beforehand, with their wrongful denials/shady behavior, to go into something like this that's face to face. Hard to not feel like things may be stacked against you. So, thank you for this. I have a strong file and KNOW I have a strong file. Knowing what things are good signs may help curb anxiety while waiting for the official outcome notification.

Had my hearing on April 26, 2018. Just found out yesterday that a decision was made on June 30th. Last turn down 2016 and the Appeal council sent my case back to be reviewed. I my hearing was with same judge who turned me down. Had a double surgery and couldn't have hearing on January 9 2018 so that's why I had hearing on April 2018. Social Security phone rep said judge sent my decision to writer. When will my lawyer know and when will I know. I'm on a wing and prayer and I'm just seeing your video from curiosity. - I have permentant brain damage from viral endephelitis and my doctor wrote a limitation letter. It includes loss of memory every morning for 15min- 1/2 hr. I have gone to jobs I have not been at in 20 years. I had previously sold my house to care for my Dad. Now when I wake up, I go thru reliving the moment my dad died. I have missed all but 2 of my grandchildrens baseball and soccor games. I never missed one before. I have many side effects like loss of eqilibrium ( I work on Heavy equipt and Dr. said no climbing on equiptment. I have short term memory, so when I tried toto sit at a desk job, I would get everything mixed up and always let go. I had a great career, working on trucks,busses,boat for people like Michael Jordan,Scottie Pippen,Garth Brook, Paisley and there was nothig better than hearing an engine I built running. I was well in demand. As you can tell , my spelling and grammer off. I am over 50 so a change of jobs isnt going to happen. I had to use my retirement account to live. Im finally getting my hearing after the first denied, apeals judge moved and it got rescheduled 8 months later. I planned to play a special song at my daughters wedding in OCT. I can no longer do that as I try a min of 2 hrs everyday to ge t thry and remember it. I read it is better to remain non emotional before judge. The main question is how bad is it to get emotional when expaining hings, I cant even think about how this has ruined y life without tears running down.Then I worry my problem will be word loss, where I just freeze motionless as I try and get words out.I am lucky my house is paid andI pay $2K per year taxes and my neighbor pays over $10k our taxes were grandfathered due to owning it since 1970. I never planned on retiring, Working on machines was like playing with toys. My Dad wored till he died at 76 and my grandpa dies still working at 91. I ctually brought my car into a shop for first time in my lidee as I became a master tech for buses, truck,diesel and automotive.I was embarrassed inside. Anyway, shoould I keep emotionless or honest..I know poor me I cant wor isnt something to show, cuz I want to. I follow companies testing for cures, raise and donate money and wont stop trying to work if I can. so any advice..sorry about spellind..not going to go back and correct, its mind numbing.

Usually if vocational says NO jobs then you win. Also ALJ ask you how come you couldn't work since whatever date?...that sets the onset date. Must check reason for hearing carefully because some hearings are for vocational expert approval only. I won my case fully favorable & ALJ went to day I stopped work instead day I filed. Good luck. & P.S. I received the notice in less than 3 weeks

I was denied 😔 My attorney and I will appeal again. I’m only looking for a portion of the time that I was debilitated and the judge apparently missed that part. He’s going by how I look now. And we told him that I have started working again recently. It angers me so much😡 I have been working since the age of 13. I have paid into my Social Security and all I was asking for was some help while I was going through the most difficult time in my life with breast cancer. I’m not asking to be on permanent disability. Oh well… Back to the drawing board. Good luck to all of you🙏🏾

I hope I win mine. I have alot of hardware in my legs. Had a second plate inserted 3 months ago. And that was pretty much it for me. I through in the flag. I got about 34 screws ,2plates, 1 rod, and a screw in my knee with a horrible ACL Replacement. Warehouse and distribution work is all I know. Long hours and lots of lifting. I feel all these videos are helping me process my claim. Wish me luck.

I had my hearing last week and the judge was doubting and knocking the vocational job person down like she'd say he can fold clothes and the judge said can he fold clothes with a cane? And he said id have to have a job with zero human contact my lawyer said I had a 50/50 chance I hope all goes well. Everything is falling apart for me

My husband finally has a court hearing for a disability case on June 27, 2019. After being diagnosed with Ehlers Danlos Syndrome, this has actually been a relief for the random dislocations, subluxes, and abnormal hypermobile movements. This is a quite painful disease which can randomly affect virtually any joint, muscle, or tissue in the human body including the veins and arteries. My question is: Have you personally and successfully won a case for EDS hypermobile or vascular types?

Hi Attorney Ginsberg. I had my appeal hearing in January of this year. The vocational expert’s final statement to the judge is that “there are no jobs that this individual would be able to maintain long term” (upheld by a work history of more jobs than I have years on this planet, most lasting 6 months or less with excessive write ups and conflict with supervisors and coworkers). If the vocational witness testified “there are no jobs this individual could maintain long term” why then would the ALJ deny my appeal? The ALJ’s denial has been appealed to the Appeals Council as of May 2019 with an application date of July 2017 though it was my 4th application since January 2015. I believe I am eligible to receive an expedited appeal decision based on the diagnosis of a psychosomatic disorder (pseudoseizures) but my lawyer has not responded to my attempts to contact/speak with him and I have been trying since August 24th in writing and with multiple phone calls/voicemails left. What can I do?

The best sign you can get is when the judge tells you that they are approving your your claim. That is what happened to me.

evidently the judge I have coming up next week likes to tell the claimant during the hearing on her decision, so could be good or bad cause heard she's usually already made her mind up before the hearing and its difficult to convince her to change it

Mr. Ginsberg, I want to say thank you from the bottom of my heart. I mean that . I had THE worst representation you could possibly have, and on top I had a judge that had a 24% approval rating and every comment about him on SSDI website was extremely bad. I actually emailed you last year about quiting the firm representing me but after talking to you I decided I had to prepare myself and I did. I spent 5 months prior to the hearing asking my firm for the name and number of my lawyer and was denied every single time, called asking how we were going about winning my case and was sighed at and told by my caseworker that she had a college exam the following day to prep for and she didnt have time to talk to me and try the next week, you see the point, this went on 3 years through 2 denials and 17 hours before my hearing my attorney finally got in touch, THROUGH TEXTING MY PHONE . Yeah , telling me to be 10 min early? Basically I knew I was screwed. Met her the next morning, she arrived 7 minutes before our case? All 22 years old with braces and shy and told me this was her 3rd case and the first 2 cases she had was with this judge and she lost... Yeah... So the week before I went and got letters from all my ex coworkers , made special trip to my doctor and got more detailed letter about my limitations, went to my ex employer and had him write me a lengthy letter about my limitations and filled my briefcase with all these things and 7 medications that I was on , and took pictures of my bedroom showing I had a massage table that my wife used on me , my treadmill, and inversion table. After meeting the judge he said , My court my rules I Do Not Allow Opening Statements or Closing Statements and I See you been denied 2 times before. And he asked my lawyer 2 different questions and her answer both times were a sound like Uhhhh for a moment followed by I dont know and seemed to be struggling....... Glad I watched your videos or I would've been toast... I wasted no time Jumping right in and said Judge , I dont know my lawyer , never seen her before, was denied fair counsel and I have evidence here to support my case that just became available because of a recent change of address and a lengthy time in the mail and would you consider it your honor. He said yes I will accept it. Looked through the letters and Dr notes briefly and said thank you.... Asked the lady if their were any jobs I could do and she said yes ? 200,000 parking lot attendants Job's and 200,000 assembly jobs using only my hands? Judge said how many can he do with limited use of his left arm and needed unscheduled breaks throughout the day, I spoke up and said ALSO taking 3 Narcotic pain meds and 1 Barbituate multiple times a day and several controlled muscle relaxers and Gabapentin to numb my nervous system... She looked at the judge and said there are 0 jobs he could do . Judge said thank you ma'am, put his files in order and closed his book and said , Well there you go that wasnt bad was it ? I said I guess not.. The judge sit back and spent the next 1 hour asking me what kind of dog I had, then told me what his was, ask me if i ever had any hobbies before my injury and I told him yes years ago I build and raced muscle cars , and he told me what his dream muscle car was and on and on forever. Told me I was done and to hang in there that it takes awhile to get an answer in the mail, got up and left the room... That was the end ? Never told me if I won or not , nothing..... My young clueless lawyer walked so fast I couldn't catch her to ask her? So in your honest opinion what do you think Sir ? Waiting for your opinion

Just seeing this 2 years later. I was denied. I have a phone hearing tomorrow. I have 2 RFCs filled out by two different NPs. Also my Knee Doctor wrote in his notes I need a knee replacement and should be disabled due to the advanced arthritis in my knee. I also have a new MRI of my back showing herniated disc, annular tears, bulging disc, compression fractures, etc. I truly hope I'm approved this time. It's my last chance. My Lawyer says we have plenty of evidence. We shall see.

been 30 days since hearing. Thought it was going horrible until she questioned vocab guy. he was struggling to find jobs I would qualify for.. and the ones he did find after spending time looking the judge asked how many days would they tolerate me being late he said 1... in my neuropsych testing it said 4+. She asked what about being late or having to leave early he said that the 1 includes that. I’m thinking if I would have been denied would have heard by now.. what do you think?

I actaully have my hearing coming up in April of this year of 2019 tho i am not applying for SSD but SSI. I dont feel like i waited so long for this Hearing its been less then 2Years. So im wandering if thats a good thing or a bad thing. Im thinking its a good thing tho. I was actually a bit surprised that my hearing came up so quickly. But your video's are helpful 4sure. The Doctor witness for my Social Security hearing admitted that I had multiple severe conditions but felt that I did not qualify. The vocational witness said there were no jobs that I could do. The Judge asked about driving jobs because the judge felt that I could possibly drive people around or deliver food. My driver's license is no longer valid because I regularly pass out so it is no longer safe for me to drive. So driving for Uber or Lyft is out of the question. I got favorable for my hearing. Now, I wait for the paperwork to see what happens next.

My ALJ hearing was about three months ago. (SSI case) There was supposed to be a VE present but she was not. The ALJ asked me two questions he already knew the answer to. "How old are you?" "What is your date of birth?" Then he asked me two more questions: "How far did you go in school?" "When was the last time you were working?" The entire hearing lasted only 7-8 minutes. My question is: Why wasn't the VE present at the hearing if they were called upon to be present? There was no explanation given for why the VE wasn't there. Is this a bad sign? Or was it a good sign that the VE was absent? Also wanted to add, this was not an in person hearing. It was a video hearing. Sam, generally speaking if the evidence is extremely compelling the judge can cancel the VE. Given that he asked you only a couple of questions it sounds like you should win (assuming that the medical evidence is compelling). If the judge denies you I would think you would have multiple grounds for appeal but this sounds like a win.

Mr. Ginsberg, I might have made a mistake with my original comment. This is my first time of having to go through the disability process. (I'm learning as I go along.)I also meant to ask: When there's a VE present at a video hearing, are they on the claimants side? Or the ALJ side?

@D foster Thank you. I kind of figured that was the right answer. Well, my ALJ has sent me a written decision: UNFAVORABLE. It still makes me wonder if the VE was present but never uttered a word, why was she even called upon to be there? Do I have the right to ask for a supplemental hearing so the VE can tell me about jobs they think I can still perform? Or is this case over?

Hopefully alll good because i have had 3 stokes 2 heart attacks and foot drop plus bipolar disorder. Attorney said we got a good judge. Your video was helpful
