Hi there I have a question regarding pattern making. If I create a dress inspired by a design I've seen elsewhere, but I add my own unique touches, am I legally allowed to create a pattern for it and sell it online? Additionally, if I create a pattern for a dress style that is common and widely used, can I sell that pattern without infringing on anyone's rights? Please I hope you answer ❤

Hi! Great question. If you see something in a clothing store, you can create a pattern inspired by that garment/trend. You cannot use another pattern company’s pattern in any way. You cannot use their measurements or pieces to create your own pattern to sell, even if you change it. That is copyright infringement and intellectual property infringement. You can create your own pattern based on your own size chart from a trending style, using your own pattern blocks to create and sell patterns. For example, you can create a short sleeve fitted or relaxed t-shirt pattern even though many companies sell a t-shirt pattern. You just cannot use any part of a pattern company’s pattern to do so. These include their instructions, size charts, pattern pieces/blocks, etc. There are some online courses that teach pattern drafting for PDF patterns. Pattern workshop is one. I wish you the best in your design endeavor.

@@EllieandMacPatternsLLC Thank you so much for explaining this. I am actually a self-taught sewist and I've been wanting to start my own small sewing business from home. And while doing research, I came across this concept of selling patterns digitally but I couldn't quite understand how it works.. Because I noticed that many people sell almost identical designs, which I assume are basic ones since we see those kinds of dresses everywhere.. so I was feeling a bit confused about it. But now that you have explained.. So, I guess we can create basic patterns from our own measurements and tools and understanding..

Yes. Just so long as you aren’t using other people’s work. You got it. 🩷 I find inspiration from clothing stores and fashion trends.
