The issue of whether to repeal Section 377A of the Penal Code, which criminalises sex between men, does not meet the “very high” bar for a nationwide referendum, said Deputy Prime Minister and Finance Minister Lawrence Wong on Monday (Aug 22) in an interview with CNA. He added that repealing 377A is a matter of public policy and the PAP does not intend to lift the party whip when the issue is debated in Parliament. cna.asia/3Clu6rs

Still don't understand the hate on PAP. They are doing an amazing job, so far no other country's government has such mature view on sensitive subjects like these and still manage to execute their bills/laws so smoothly without all the unnecessary bottlenecks. Goes to show the amount of hard work and effort they commit to their roles. Commendable even on an international scale 🇸🇬

I am still wondering why the government decides to repeal this law now and I don't believe it is for the LGBT's human rights. But seeing your comment, I guess it makes sense that they can now finally gather the LGBT votes.

As Minister Wong said, court ruling will always lead to a win vs lose situation… creating more animosity between groups and dividing the society. By repealing 377A and safeguarding the common definition of marriage in the Constitution, the Govt has wisely lead the interest groups out of the tunnel without further confrontation. Let’s respect this decision and close gaps that divide us.

Do not know how they are going to "protect marriage as between a man and a woman" from constitutional challenge .... is it even fair for a government to make a law that is free of scrutiny by a court of justice ? The court of justice should be just about upholding justice, pure and simple, not as what the government says its role is just limited to "interpreting the government's laws" ... if the government enacts an inhumane law, of course there has to be a separate independent entity to ensure such laws are scrutinised and struck down without going through the long process of waiting for the ruling party to be changed .... the courts are the only way to do that .... If they really want to make such a law just to pander to conservative sections of the population just because those people form the majority voting block, that smells like a political self-preservation of their own political power ... human rights laws should not be based on pandering to the majority, even a law students who has not graduated knows that ...

What do you mean by “the common definition of marriage”? If you mean female plus male you are exactly at the same spot where you started. The government issues civil marriage licences, not religious souvenirs. That puts you right back in front the “Equal Protection” clause. Religions are legally equivalent to private clubs and can have any rules they like ¡for their own members¡ only. You seem to be trapped in the same error that US religious fundamentalists made, they cannot distinguish between the separate church and state areas of authority and responsibility.

It's better to repeal an unjust and discriminatory provision in government's ' Criminatory Gay Law' of many decades than having it strike down by supreme court as 'unconstitutional' which can lead to barrage of challenging lawsuits with regard to Singapore Constitution. 🙄🙄

That sort of domestic instability is just too expensive and painful to deal with. The minister also alluded to problems fully embracing LGBTQ rights would challenge the housing system. That would in turn cause unrest and SG does not want to end up like HK

@@yvvonelee5026 probably not. Though who knows how will the society evolve in the future. From my point of view though, granting "equal" rights to same sex marriage is a unsustainable society policy. Laws of nature are discriminating, reproduction requires opposite sex, I'm not certain what happens when we try to take control of that in our hands. Also, who is going to bear the costs of all these unnatural attempts. Eventually, society is going bankrupt and revert to its nature form.

Let advocates of LGBT live their lives as they like privately. Let advocates of man-woman marriage uphold the sanctity of their marriage and their traditional social values. It's detrimental to Singapore society if they become opposing camps to champion their views and rights vehemently, and worse being prompted by non-Singaporeans who may have their hidden political agenda.

Frankly its a matter of time before gay marriage gains majority support , the government cannot forever shield the population from the worldwide change of attitude towards gay people ... Of course its dangerous to rush things, but at the same time the course of conversation should be allowed to run its natural course without the government or any interest groups trying to muffle the voice of either side from being heard ...

@@88feji It's less about shielding people and more of an economics issue. There's already not enough housing and birth rates are far too low. Having a bunch of childless couples consume public housing will worsen the HDB situation and cause unrest

That sound so wrong, its like forcing people into unhappy marriages just for the country to seem to be solving issues .. happiness of the citizens is the prime concern of the government, whats the point of having economic progress if the price is the citizen's life happiness ?

@@88feji I agree with you that the argument that we should not have gay marriage because they cannot reproduce is a fallacy. this is because there are heterosexual couples who also marry without the intention to have children. In that case, maybe we should give less hdb subsidies to those who do not have children after x number of years? No easy answers because everyone's idea of justice and fair is subjective. But I hope that the pro LGBT community can also agree to disagree on various issues that seems to have been 'progressive' in other countries. That makes us uniquely Singapore. why strive to be like other countries just for the sake of freedom and rights? How about security, how about mutual respect? In US there is no such thing as mutual respect and living with differences- no tolerance if u disagreed with the LGBTQ agenda. but that's because in the first place these minority were ostracized and never loved. And I don't think that is the intent of the Sinagporean identity where we have been taught to give the minority space, and that includes the LGBTQ community

The journalists have asked the ministers relevant & appropriate questions. I thank the ministers for maintaining the status quo of traditional marriage of 1 man & 1 woman & children born out of this norm. Let the government do their job by implementing new policies since PC 377A has been repealed.

Repealing section 377A while amending the Constitution to secure marriage as one for a man and a woman is a good and fair solution. There is no good reason to make criminals of people just because some others fear a slippery slope (to same sex marriage). "Hey, I fear a slippery slope, therefore you should be made a crininal." This is not the way to govern a country.

This fear of changing social norms is misinformed and pointless. Netherlands has adopted same-sex marriage for more than 20 years now. Studies have also shown that such marriages has no negative impacts on society but rather improves it, whether socially or economically. The fact that major religions concur with heterosexual couples should have no bearing on Singapore’s policies as they are not based on benefit but fear. Isn’t it the government’s job to do what is right and beneficial and not what is popular?

The repeal of Section 377A is a good compromise, regardless it will not change the attitude and behavior of the LGBT community anyway. It also does not affect those who are pious and want to practise their religion faithfully.

Dear Lawrence, the answer concerning the referendum thing is a new one, that is, it hasn't gone up to that required stage where a referendum is required. Second the result of the referendum may not be a good one and it may cost more animosity. Dear Lawrence and Edwin, by all means, stick to the present definition of marriage as far as it goes. BUT, BUT, never, never make it, or anything else, fixed forever, because we never, never know what the future holds. Life is moving and things are NOT fixed. Life is a constant change as the oldest Chinese book, I CHING, stated.

Can Articles 6 of the Constitution be amended instead of abolishing S377A. Why don't give the public a peek preview what laws the govt intend to pass or do to preserve the traditionalfamily unit after repealing of S377A.

Correct me if I am wrong, is PM Lee & Lawrence Wong essentially saying no Ah Gua (sorry no offence meant) shall expect to ever legally marry a man in Singapore as long as both of them are In charge ? Isn’t that cruel to whoever is the affected person if we look from their perspective ? Why does our PAP government continues to hide behind all these hypocrisy of still being a conservative society when in reality we have quite a high rate of divorce & abortion in Singapore !

In the context of protecting the definition of marriage in Singapore, this change is like an old rusty padlock being replaced by way more secure hack-proof lock, here's why: Before S377A is repealed: (A) The legalization of same-sex marriage is always a remote possibility as definition of marriage in Singapore is open to be challenged at the courts; (B) No gay men sodomising one another have ever been charged or prosecuted by this penal code, and our government has emphasized multiple times in public it will not be enforced, including at this NDR 2022 by PM Lee. Hence, do not be mistaken that S377A can actually prevent gay men from poking each other backsides, it hasn't and will never be able to. After S377A is repealed: (A) Same sex marriage being legalized will now be impossible as the definition of marriage as it is today can no longer be challenged or changed via the courts; (B) gay men can continue their consented perversions without being prosecuted. With or without S377A being repealed, this has not changed. The focus should not be that S377A is repealed, but that marriage in Singapore will always be defined as between a man and a woman, this is what the majority of Singaporeans want.

Is it Constitutional for PAP to "force" their MP to vote according to the Party's stand and not according to the Resident's stand? How many parents in the Community, in the Ward, in the Country can you find that will support the gay rights? You do not need to remove the padlock when your main door is not even ready. Strengthen the padlock while you improve your main door. Why can't you do it?

..... and even amongst those who would like to retain 377a as PM said yesterday most do not wantt to see actively enforced with criminal penalties because they recognise that a person's sexual orientation and behaviour is private & personal and should not become a criminal offence. So the repeal of 377a .... This quotation says it all. Gay sex in private MUST NOT be criminal offence.The repeal of 377a in Hong Kong & recently in India did not result in the legalisation of gay marriage or any THREAT to the Family. Singaporean women who choose not to marry & those who stay married but choose not to have children are more of a threat to The Family !

From the Islamic standpoint, homosexuality is a forbidden action; a major sin and anyone who partakes in it is considered a disobedient servant to Allah that will acquire His displeasure and disapproval. This is clearly stated in the three main sources of the Shariah: The Quran, the Sunnah, and the consensus of all scholars, which extends from the time of the Prophet till today. There has never been any debate or discussion regarding this viewpoint amongst the scholars, past or present, simply because the matter was always comprehensive and immutable.

People are protected by law, and it ensures fair treatment for all. Why is the government interfering with citizens' rights to live in a society that should not discriminate? Singapore is also not a conservative culture, but it is one that has attempted to influence our politics through religion. All these complicated discussions regarding S377A wouldn't have taken place if our country were an atheist one.

I haven’t read all the comments, but I’m sure some of this has been said before. To summarize my views from Canada, which has already modernized its legal system, here it is: As Min. Wong said, many other countries have been down this path based on constitutional laws such as Sec. 12. None of these countries has endured deluges of frogs, national bankruptcy or mass destruction existing heterosexual marriages. About a quarter of the world’s population lives with marriage equality and live had continued on as before but with a slight increase in total happiness. Canada was forced by their Supreme Court to provide equal access to government marriage but did not rule on equal divorce. (wasn’t in the case) It took years to fix all the oversights cause by rushing to comply with the constitution. Minister Wong is close to right about this, he should learn from countries with a similar legal history and update the laws voluntarily before he is forced. The minister is correct to say that it would be better if the people through their government made the changes voluntarily rather than by the means of Courts. Civil marriage is a government function and must comply with the Equal Protection clause. Religions have their OWN marriage process, this will not change, just as it hasn’t anywhere else. That will remain unchanged in any way. Some will certainly say “defend traditional marriage”, but what they really mean is RETAIN this vestigial remnant of COLONIALISM. The question I’d ask the religious leaders is “Could you please show me on this doll where Marriage Equality hurt you?”

IMO, the government has made an equitable decision in the sense that it'll not criminalise the gay community for engaging in gay sex but at the same time, it has to prevent the gay community from taking irresponsible steps to redefine what is a family. Thus it is the solemn duty of the government, (as the elected representative of the Singaporeans) to define (after consultations with the various religious bodies) what is a family and, if deemed necessary, to make appropriate amendment in the Constitution too
