This is Wild. My mother passed sway a year ago. My older brother is disabled and lived in her house with her. Until she passed. My brother asked if i wanted the house sold so the money could be split. I said no Man, you live there, the house is yours as far as i'm concerned. If you cant afford to pay the taxes on it, we can figure something out. My Mother would roll over in her grave if she knew i was trying to sell that house for the money. Instead of making sure my brother had a place to live. Could i use the money, yep. But. Some things are bigger than money.

Money is the root of all evil, you don’t know what people might do for money 💰 it’s happened to my family, it’s not easy , I had a friend who was being cared for by strangers , none of his 8 kids he had raised even visited him , yet when he passed away they all showed up one by one with their attorneys 😂 demanding to know what he’s left behind etc …. Money is dirty , it’s evil ….

My grandparent’s neighbors did that after a death. A lady who had lived there with her grandmother all of her life because her mother died when she was a child. Grandma died and the aunt kicked her out to rent out the house and make money. The house was paid off.
@basicallyno1722
@basicallyno1722 2 ай бұрын
@anndeecosita so did the woman living there ever save her own money to go live on her own? Was she a part of the family or just someone that got to live there? Was she special needs? A person isn’t entitled to live there because their mom died as a child. It seems they let the older woman live there until she died….why should this other woman live there for free or fixed rent? And the aunt is supposed to pay taxes on that and then pay for the upkeep of the home? Homes are expensive and they require maintenance. Aunt was just supposed to pay for that out of pocket so some woman could live there comfortably? They let the woman’s grandmother live there until her death…that’s pretty fair enough.

When my mother’s brother died his kids started suing left and right, especially over some property he owned in LA. Their family got torn apart. Learning from this, my mother put a clause in her trust stating that if anyone were ever to sue, that person would be disqualified from the trust. Smart woman, my mother was.

Awful. I went through it. We’re “over” it now, but it took a few years for the attorney to convince everyone that nobody got screwed. It’s become a barely boiling pan of water on the back burner, but it was boiling over on a front burner for a couple of years. And I say “over” very loosely because it will never go away. It’s like the old toothpaste analogy - once you squeeze all of the toothpaste out of the tube, it’s not going back in the tube.

The fact that there was no appraisal and that the Defendant's wife was on the deed makes me think something shady's going on. I am the youngest of three. When both our parents passed, all assets were to be divided by 3. They had it stated in the trust/will that if ANY of us contested this, that person(s) would receive $1. Our parents experienced what money (GREED) could do to a family. Even without that clause, they raised us with great moral compasses and would be extremely disrespectful to legacy to squabble over money. No matter what amount. We miss them every day!

And this is why you have a current will. JJ mentioned something about the estate not being worth enough to go to probate so this would suggest no will. If there was a will in place this family would know exactly how dad would have wanted his estate distributed. And a house for $7,500.-??? In my area you couldn't get a contractor to build your kid a tree house for that. Actually, you'd be hard pressed to buy enough land to park your car on for that unless you REALLY went out into the sticks to get it. How bad was this place?

Had my mother died with nothing left, im fine. But all her property vanished, including things written i the will for me from grandparents. So their lies and hiding assets, is unfair. Against the written will. We shall never speak once the lawyer is done. They cant afford to invite me over because ill see my parents and grandparents furniture and collectibles on display. The brother is shady he had the house sold to his son, so that way, he still got some of the money. Plus his wife is on the deed that way, he still has some control over the house. Because if him and his wife both bought it, his money would've come off the purchase price. Unless they agreed on a lower price to make up for his part of the inheritance. This way he got his inheritance plus his immediate family still has control of the house.

judge trying her hardest to scrutinize and catch the defendant, obviously on the plaintiff's side, but so far he's unphased and giving solid answers. surprised the judge is allowing so much hearsay about the son.

My only brother was the executer of the will when dad passed away. I was overseas when he was taking care of the estate. My brother was honest to a fault. He found $6,600 in cash in the house and informed me via email and gave me $3,300 when the estate cleared. He could have stuck it in his pocket and i would have never known.

Why does it matter what the son is doing with the house? It’s his house

She mentioned she agreed to the son getting the house for himself, not personal gain off the grandfather passing. It was under false pretense.

Because she was entitled to her portion of the full selling price/market value of the house if she hadn’t agreed and she didn’t agree with the understanding that someone else was going to make money off of it.

Nah, she's just greedy. She can't get the full value since it's already sold and she can't negate the deal without proof it was indeed false pretenses, which is currently just a he said/she said thing. She has no proof beyond her own words so she's now trying to get more of a share from the sell than she should.

Assuming the house was sold at fair market value and the plaintiff received her correct share of the proceeds, I tend to agree. If those assumptions are incorrect, I'm much more interested in the case.

It's definitely worse when it's family. But when my parents and aunt sold my grandparents' house, the man and his wife gushed over it and said how excited they were to raise their family in it. It wasn't long before they sold it to a property management company to rent for college students. To be fair, it's within walking distance of the college. It just hurts being lied to.

I don't really understand the plaintiff's case? Yes the family "should" ensure that all of the siblings should receive an equal share, but to my knowledge there is no legal obligation to do that, unless it was specified in the will.
