Slate’s Amicus podcast is a show about the law and the nine Supreme Court justices who interpret it for the rest of America. At this live taping, Dahlia Lithwick and special guest Congressman Jamie Raskin discuss how the court is using originalism-a controversial approach to interpreting the Constitution-to radically reshape the law. Just in time for yet another consequential term!

I'm an almost 80yrs Black Lady, and had been to quite some interviews/conferences, and, absolutely this is the best of my whole life. The questions, the answers, the critical analysis on both sides; how much I had learn based on the form and message of every minute of it. You both are excellent. And, you Mr. Raskin are a God sent to this Nation, I lost a beloved son and had asked myself how this Man could collect himself to immediately continue to serve excellently his Nation, well now I understand: God had been taking special care of You in order to help save all of us.

@@andrewpinson1268 I became a Baptist about 50 years ago. . .well, maybe not that long ago, but almost. Our youth pastors and pastors started talking to me about Supreme Court Justices from day 1. It was as important as the gospel to them. I don’t know about Mr. Whitehouse, but I know some people have been eyeing the Supreme Court for a long, long time.
@andrewpinson1268
@andrewpinson1268 23 күн бұрын
@@alibobo2009 The word went out several years ago when more and more conservative - originalist - justices were being put on the court that the democrats needed to go after the justices by any means. If you have been watching you can see all of them. IF the majority of justices were liberal there would be No - NATA - talk against any of the justices. Whitehouse is one that was chosen to do some of the Congressional attacks on the justices. Like hundreds of fleshed out conspiracy theories from the right and left he has done his best. I have looked at a good number of his videos and have searched in other places to see if any should be considered valid. Not a damned one of them.

@@115foxron8you know as a Senior citizen myself I don't really care too much about the age of a candidate. I know that I am older than most people in Congress and older than any member of the Supreme Court and I'm hanging tight with President Biden. While my body might not be in the same shape it was when I was in my twenties and thirties my brain sure works a hell of a lot better than back then. Biden's age doesn't bother me as long as he's not showing any signs of dementia or other mental decline the way trump's is. There's a huge difference between an aging brain and a dementing brain and Biden is an example of the first while trump is an example of the later. I'm speaking as a retired member of the medical field and I know the difference when I see it. So unless Raskin should develop some sort of mental instability not related to age I really wouldn't worry about his fitness to serve in any leadership position as he ages. At least not related to him being mentally unfit to lead. He survived cancer during his time in Congress and he has shown quite clearly that he can lead even under the most difficult and trying of situations and I have supreme confidence in his ability to do so no matter how old he is.

That the Supreme Court has such authority to change the face of American jurisprudence and politics is not just frightening but truly terrifying and I as an American feel so completely helpless to do anything about it. This can not be happening in this day and age. In my considerable years I have come to believe that we had come so far from the America of my youth but for this to be happening right in front of my eyes makes lie of everything I have always believed to be true. As a Senior citizen and once proud American I have great shame for the direction this country and the Supreme Court in particular has gone in recent years. I'm a lifelong Democrat from the traditionally red state of Texas where one of my greatest memories is of my mother holding me up so I could see then Vice Presidential candidate Lyndon Bains Johnson at a campaign rally in Austin TX and I can remember how hard my momma cried when President Kennedy was shot in Dallas in his motorcade as it passed through the streets of downtown Dallas around Dealy Plaza. My aunt Merle, my Momma and my Mammy,(my name for my grandmother because I couldn't say Granny) all gathered at Mammy's house and sobbed as the younger children played outside but I stuck closer to my momma since I had never seen them so distraught. Not even when my daddy was killed by a drunk driver had I seen her crying like that and it made such a huge impact on me. When your earliest memories are tied to instances of such great political events in history you know that I grew up in a very politically active family fueled mostly by strong women who valued their right to vote above almost every other aspect of their lives. My mother's beliefs greatly influenced my brothers and I and we all registered to vote the moment we were old enough to. I skipped the eighth grade and was a member of the National Honors society and I gained that honor not just because of my grades but because during the Nixon scandal my math teacher decided to hold a discussion with the class about what we understood about Watergate and I alone carried on a heated debate with my teacher, (who was either a staunch Republican or playing a very convincing role of Devil's advocate) which the rest of the class found terribly boring and made impolite noises and stage whispers about what a suck up and a know it all I was etc etc etc. Well while my passionate arguments as to Nixons criminal culpability and lack of fitness to serve may have fallen on deaf ears as far as my fellow students were concerned my knowledge of what was going on and savagely opinionated and emotional debate with my teacher did gain me the chance to advance academically and a place in the honor society. My choice of career had nothing to do with politics but I have never forgotten how important and hard fought even the right to vote was for the women who came before me is and because of this historic backsliding in advancement in voting rights in the last few years I have realized again that as Americans we can never take our rights for granted. There's always going to be some faction somewhere just waiting and watching for the opportunity to take those rights away from us. And it's not going to stop there. Once they are allowed to get their foot in the door by whatever means necessary they will continue to pick away at all of our rights. Be it through bribes to high ranking officials,( the Supreme Court among others) outright lies all the way to violence and this is really nothing new in America but rather something that I had grown complacent about and had convinced myself somehow,(though my own experiences with politics from a very early age should've been enough to keep me aware) that we were passed this kind of thing happening here and I guess I just got old and let my guard down. But democracy is a fragile thing dependent on the good will of man who want the best for themselves as well as their fellow man. These people on the highest Court in the Land want the best for themselves and those who will continue to make their lives profitable and they care little about the average American citizen. trumpty dumpty ran on a promise to drain the swamp well that's one idea he got right. However my idea of just who it is that's slimy and murking up the water is very very VERY different from his. Rankin's ideas for expanding the Court and initiating term limits and giving each president two nominations to the Court are all wonderful ideas but we have to do something about the monster in Congress who are making any kind of meaningful policy's impossible and doing little for the American people and instead just profiting from making fools of themselves and preventing Congress and the President from doing anything for the American people as well. If we're really going to drain the swamp then we need to pull the plug and let all the water out exposing each and every single swamp monster in the government and judicial system all at once before they come up with a plan to disguise their actions through misdirection lies and we all know how good they are at that. But look at Justice Roberts. He's not even trying to defend himself anymore. He knows there's nothing that anyone can do to him and no possibility of his ever having to answer for his actions. So he doesn't even have to put up a defense. What can any of us do? It's more important than ever in history for every single one of us to get out and vote. As for me even if someone has to roll me up in a wheelchair I will be voting for Biden in November. And I will be voting for Democrats in every single race just as I have for the past 50+ years. My Momma didn't raise no fools! P.S. I apologize for any typos or misspelled words. I was asked to watch the grandkids right in the middle of writing this and I became a little confused about where I was when I got back to making my comment. So if you find any mistakes in spelling, punctuation or tense please excuse an old woman for them and try not to use simple grammatical errors as proof of my not knowing what I'm talking about. I know how the minds of MAGA work. They look for anything, no matter how small, to pounce on and use as evidence of anyone who doesn't agree with them as being stupid or not understanding the law. I am neither. But I am old so cut an old lady some slack if you find the occasional typo or incorrect punctuation etc. Although it's only the trolls who actually ever seem to notice those types of things since the average members of trump's cult and just your average right wing extremist doesn't have the educational experience and understanding of the English language to even realize that a mistake has been made. They're working with a third grade level of education and awareness so I probably didn't even need to make this disclaimer but just in case some troll is just out there looking for someone to make look foolish I'll say it again, My Momma Didn't Raise No Fools!!!!!

It may be shown to an observant student of the derivivation of laws and the legitimate reintegration of the observed abstractions required to compose a coherent interpretation sufficient to make opinions and judgments, that the balance of probabilities, differentiates, is the same principle as inherent mathematically quantized valuations in proportioning those probabilities. It's always evident in the facts put before a Court, so those who are selected to represent justice at court, at every level of assessment, should first be seen to have a record of moral/ethical behaviors, (or be recused, reverse selected, when they fail?)

The Constitution is a living, developing document. See all the amendments. The originalist view harking back to a view that takes us all back to English law of 1760s (as Alito did in reversing Roe v Wade) is insane.

According to originalism if it was legal before the Constitution it did not need to be addressed in the Constitution. Therefore, the Supreme Court overturning Roe was a wrong decision. Abortion was legal when the Constitution was written. "Abortion was not just legal-it was a safe, condoned, and practiced procedure in colonial America and common enough to appear in the legal and medical records of the period. Official abortion laws did not appear on the books in the United States until 1821, and abortion before quickening did not become illegal until the 1860s. If a woman living in New England in the 17th or 18th centuries wanted an abortion, no legal, social, or religious force would have stopped her." - Scarlet Letters: Getting the History of Abortion and Contraception Right
@kathyd9324
@kathyd9324 Ай бұрын
Abortion was outlawed just after the Civil war. Due to the number of lives lost in the war, some felt restoring the population was important for the future of the nation. (We are well populated now.) Abortion was only illegal for 115 years. Currently only 20 some third world countries have laws against abortion. The real question is, "Can you force a person to do something with their body against their will?" A woman's sole purpose in life isn't to carry parasitic fetuses to birth simply to breed more consumers and taxpayers. Outlawing abortions only leads to unsafe back alley abortions, unwanted children, filled orphanages, abused and neglected children, future citizens with mental health problems, and crime.

@@user-zd2uv3ss9z I am old enough to remember those horrors, and the dangers of dying from a miscarriage. It's an outrage that anyone would want to do that to society again. It's like taking the medical industry back to when they were just beginning to learn surgery, unsafe for all.

Unfortunately, Today's GOP thinks women are a lower species, unable to make good decisions for their families and themselves. Now that states like Texas think that all abortions are crimes, and too bad if the mother dies, I wonder what might happen to babies in families who don't have the resources to support and care for them well? Now we see that it's True the GOP thinks that life begins at fertilization of an egg, but ends at birth, so government has no responsibility for babies and kids as they learn to walk and talk. Rep. Raskin's proposal for SCOTUS to have 13 justices, serve 18yr terms, each president appoints two, and after their 18yrs they can serve on US district court is just BRILLIANT! That, and have the chief judges of the 13 districts serve as an ethics committee to the SCOTUS is absolutely what is needed!

Rep. Raskin, your suggestions for modifying SCOTUS are GREAT. We also need controls for some of the other bottlenecks: No ONE person should be able to keep SCOTUS or military nominations for MONTHS on end. I like Thomas Jefferson's thoughts that the Constitution essentially be reviewed for revision every 18-20 years.
