Hello there Dan! I can only speak for myself, but I think of all the KZbin prospectors on this platform, you are BY FAR the most outwardly law and environmentally conscious one that there is. This is not a judgment or casting shade on other prospectors, just a statement of respect and an acknowledgment of how obvious it is that you care about doing things right and taking care to cover your bases. Please don't let those out there that are hateful and malicious toward you and your channel discourage you or get you down. Keep up the amazing work, and continue using your best judgment.

You hit the nail on the head. As long as you are in good faith trying to do the right thing, the authorities will generally give you some grace. They're not looking to hammer the people who are trying to do it right and follow the rules. They have their hands busy with dealing with the people who don't care about what the rules are. There is no possible way for anyone to know all the little details in the laws around prospecting and mining in any country, state, or province. If the inspectors are aware of your activity and watch your videos, then they know how you try to work within the law and rules. Keep up the good work and love your videos.

This is one of my favorite channels. Youve brought a whole new appreciation for nature ive never had before. Dont get me wrong, i was that kid in the creek, chasing crawfish and water snakes. Ppl called me Dr. Dolittle, growing up, because of how much I got along with animals. It helped I could imitate their sounds. But youve gotten me to look at the landscape differently. My GF will watch me studying the river banks while kayaking. Studying the land while cycling. Im in SW Ohio. I know youve mentioned in the past, you didnt want to confuse ppl with discussing the Laws in BC but, it gives me things to look out for. The questions to ask for my area. Claimed an old mine, Got in lots of trouble with BLM 3 mile BLM Road, access was not Claimed by our mine. Land was leased to cattlemen. Access WAS TRESPASSING. This was after we fixed the road. FYI I own all my properties as patented private land. I like your videos but be careful for pitfalls.

i was under the impression , classified down specific amount allows you to take samples from nature with no claim . i've done this as well and extracted buckets for home test .

Obviously the regulations here in the states are different (and vary a bit from state to state) but when we had some earth work done on our property in a known gold bearing area, they hit a band of gravel and black sand. The digging crew took a day off and panned the material. Nothing was found but since nobody owned the mineral rights and the area wasn't claimed, it was permitted since it was prospecting for a potential claim similar to what you were doing with that material.

Hi Dan, great video, I have explored this deposit before. In answer to your questions about the ministry, regulations, believe it would be both classified placer and mineral. Hint, I have crushed some of the conglomerate in the lower horizon and got small but rough edged gold from it. As far as the removal of material is a grey area, regulations have changed so much over the years. If it was staked, no problem, but because you have a free miners license, I would think you are ok. I live in Alberta and love the outdoors and used to spend lots of time out camping, walking along rivers, etc and always wanted to try looking for gold... sadly 3 years ago I was diagnosed with fibromyalgia, an extremely painful and disrupting chronic disability and I'm only 31. I'm not physically capable of spending much time outdoors anymore, so watching youtube channels like yours allow me to enjoy the outdoors I can no longer enjoy in person so from the bottom of my heart, thank you. First, this is an Ancient River Bed, and you can determine it’s prime path, then it’s a Placer Deposit, as any runoff is natures new path for that river bed to continue placer deposition. RIGHT ON DAN!

You can dig a hole on your yard and move the dirt around. I think the issue is removing it from the property (like sending it downstream) or digging a pit beyond a certain depth. Not sure about the rules in B.C. or your city or whatever Canada calls a county though.

Check your property deed. It will say surface rights to a certain depth, as for washing the sample yes you can you own the surface. Hope this helps. Cheers

Hey Dan! Great video. I love how you get the whole family in in the fun, and manage to keep everyone in high spirits. I know that down in California a lot of youtubers do get togethers with fans for outdoor activities. Is this something you'd ever consider doing? A public claim where it's not too hard to get to, invite viewers and their families, and they could learn some hands on skills from you and yours. Now that the heat wave has somewhat broken, this could be a real cool way to get the kids to touch some grass, rocks, and fresh water! Keep up all the great educational work!

Hey Dan! Gold Pan Dan here! 😁 In our area we have conglomerates that carry good gold and they were registered as lode claims here. Lode claims are staked on veins or lodes of quartz or other rock in place bearing gold. Since the conglomerate is a type of sedimentary rock formation it would be a lode or mineral deposit as you call it up north 😉. Two of the main areas I work for placer gold in my area are placer deposits created from the gold eroding out of the conglomerates. Keep up the good work!

Pretty sure this would be a mineral claim. It terms of filing claims, it doesn't matter where the material came from originally, what matters is where the material currently stands... which is not currently a river gravel bed.

Can a prospector take samples of BC crown land to test them for minerals? Heck yes! How you test them is up to you.. What would be interesting is a Q&A of all the questions that have come to light in your videos, and some answers from the BC agency in charge of it all. Hey Dan! As far as I'm aware, any river run gravels are Placer, regardless of their proximity to water. Lode or Hard Rock, is exactly that, mineral in place within rock that has not been released. Although a conglomerate is hard, it is not a mass of rock formed within the earth, it was deposited by water. I could be totally missing the point, but that's how I've understood it, and it is why you can have Placer claims far away from water sources. Just like another prospector's Drift Mine, that is a Placer mine 40ft down below a dried up inland sea, below layers of conglomerate and solid Caliche.

Here in Ontario the Mining Registry site is very poorly laid out when it comes to differentiating between all the different types of claims on a piece of land. The site leaves a lot to be desired if you want to do everything by the book. If you spend too much time thinking about every last little rule or definition when it comes to prospecting or working a claim you will pop a gasket, lol. Keep the videos coming!

I believe the problem starts with the Department of Natural Resources and Ecology in these situations. You see they use our land and sell it to the large corporations for profits. It's likely why here in America we are gated out and not allowed to use our own property

I believe that you are not allowed to remove a sample from your claim. As it was explained to me you have the right to the mineral AU only. So on open ground you are to the best of my understanding you are ok. I just had a lumber company remove about 800 yds from a claim for road work, no permit and no permission. Gold Commissioner refused to enforce the Act. It paid fairly well too.

I'm in WA. state and when I see someone doing something wrong, I tell them. Then i ask them if they have their recent WA. state fish and gold pamphlet and read it. People who break the rules make it harder on us that don't. If the spot you're on is an ancient riverbed, it must be placer. Keep up the good work Dan.

@@Danhurd There are placer claims here, specifically the Liberty area. The "potato patch" uncovered a massive nugget/specimen. They were considered to be old river channels. The people to ask would be the registry I guess.

Dan your doing an amazing job and don’t let anyone tell you different. You’ve taught me tons of information about gold and prospecting. And I enjoyed every min of it. I’ve seen most all your videos. They never disappoint and make me feel like I’m right there beside you diggin away lol. Thank you for your effort and hard work. I hope you keep making them for a long time.

My understanding of Canadian Mineral rights law .. concurs with your opinion .. seems obvious. MANY Canadians are shocked to learn they do not own mineral right to their property .. HECK sometimes you don't even own timber rights! (Do NOT cut down a Christmas Tree on your own property, without checking) :)

Love your videos, good question on the legality of moving product to your sluice my wife got me a 6 foot sluice last year a lot of places look for gold I need to do the same thing. I’m going to look into it for sure. Keep having fun.

Granted I'm new to prospecting but one of the things I remember reading is even if I do stake a claim I don't have the rights to sand/gravel only the placer material. Taking a few buckets home to process would certainly be easier

Well as always another great video 👍👍👍 ... That was a good amount of gold for only 10 buckets so on with the search... If you add some garlic oil to your panning pond it will get rid of the mosquitoes or there is a product called mosquito dunks (little round biscuits that look like a donut) that are made for putting in ponds and lakes to help control mosquitoes ...
