I also heard that the side effects of the medications you’re taking can play a part in how it’s seen. For example, medications that cause fatigue, absent mindedness, high blood pressure or headaches. Some medications cause weight gain and weight gain can cause more strain on the joints causing even more pain to an already painful situation.

I hope everyone that deserves assistance and is struggling financially because they can’t work full time or get a decent job, first pray everyday and ask God for help, secondly do a kind deed daily for someone else.... start with family members then neighbors..etc Thirdly, apply for SSDI OR SSI . enas

Thank you for your videos. I hated Zoloft...I couldn't cry which I need to release my emotional pain. Wellbutrin helped after my hysterectomy back in 2003. I suffer from lifelong chronic depression but since I'm older and more spiritual & meditate more, I'm using my chronic Anxiety in my case for mental disability (I also have physical). I would be constantly in the E.R with high BP and panic attacks w/o my anti anxiety med, as hospital workers discovered recently after I wasn'r allowed to take any meds the night after a small surgery. They ran into my hospital room because the heart block in my gown alerted them. I'm in so much physical pain these days & the stress in my heart is causing crazy up and down hypertension. I turn 55 this year & hope I fit in line with the grid rules as I see myself quickly declining w/little support, esp from family who don't get it knowing my childhood abuse messed up my life's dreams.

Thoughtful analysis. I would only add that if one has been prescribed some of these serious medications, more is not better. Too many high powered drugs and the judge might start thinking "drug seeking behavior."
@ryanoutlaw1327
@ryanoutlaw1327 10 жыл бұрын
This statement is ludicrous. Druggies do not generally try to get disability. All they are interested in is narcotics. Getting disability is a long term thing and most pill heads are worried about tomorrow not a year or two from now. Telling people not to use what's available to ease their pain is downright cruel.

“Druggies” normally aren’t working and in fact are seeking to get that high. So they wouldn’t qualify for SSD (social security disability) but rather SSI ( it’s not an entitlement it’s welfare) this is what I’ve seen ppl who don’t make that money but rather have to get in SSI because they can’t or haven’t worked. But for SSDI. It’s different judges will look at the controlled meds as it’s considered “drug seeking behavior at that point” not as much anymore as it’s being controlled and eliminated from providers handing them out like candy as they use to a few years ago. If it’s not prescription controlled drugs it will be some other form of addiction unfortunately. Good luck all who are tying to get their SSDI( worked for and put money into) not SSI.

Axis 5: (The letters "GAF"--for "Global Assessment of Functioning"). This is a numerical score between 0 to 100, (or a "dash" for insignificant information. IF this is noted in psychiatric hospital records (not required); there might be a distinction between "upon admission" and "upon discharge" (with 2 different numbers). Nobody is at 100. The DSM-IV-IR (mentioned above) has guidelines; the ACTUAL number is quite subjective in the sense that distinction between a 52 and 54 is irrelevant.

You never know with people. I'm on a lot of meds, two antipsychotics and prozac. I'm diabetic (just started) and also suffer from dizzy spells,, so I can't ride my bicycle. I have memory and sleep issues. One time I was in the hospital with a man who'd been shot in the head, and he was getting like 10% VA compensation but functioned well. He had his head shaved, so I think he was proud of it. Every case is unique, in my opinion.

This does NOT refer to the "Grid Rules" (the "Medical-Vocational Guidelines"); but rather something that pertains to: "mental disorders", only. According to the DSM-IV-TR (Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition, Text Revision, 2000; American Psychiatric Association--check the reference desk at the local public library); the complete mental health diagnosis is coded on 5 (five) axes--Axis 1 (main psychological/psychiatric conditions; if any.

persuade the judge to order a new "consultative exam" (at the SSA expense)--& even remand an new hearing, in some cases--& depending on the specific circumstances-and nature of impairment(s), that one (or multiple) new exam(s) might be enough to demonstrate permanent-or long term- severity--perhaps in combination w/ the other med records (however "otherwise lacking"), the treatment up to the hearing, AND possibly the medical-vocational factors, & other info.

The "Catch-22"---literally, as regards to your last questions. Some answers: 1) Some claimants have relatives and/or friends to support them. The SSA web site even states that the program assumes that the claimant has access to assets and support from relative and friends during the waiting and appeals process. Go figure. 2) Some live in groups homes in communities that are lucky enough to have outstanding resident physicians who are trained by licensed board-certified physicians

Has this advice changed since the "war on painkillers" has begun? I have chronic pain as a result of a physical trauma that occurred on active duty, but for whatever reason VA doctors have refused to do any diagnostics (tests, images, etc.), but they have fed me an endless stream of drugs that seem dumb to me (anti-convulsants, for example) that have had no effect other than crappy side effects. The thing that's kept me going all these years is that I've also had a painkiller. Now my doctors have just decided to stop prescribing my painkiller, but they still haven't found an alternative that works and they still haven't diagnosed the problem. I believe I can be cured, but nobody seems to want to try. I work full-time in a skilled profession, but once my last prescription runs out, if things go back to the way they were before I started receiving painkillers, I'll be rolling around moaning in agony on the floor for several hours at a time every day. I will not able to keep my job (it's the reason I ended up out of work in the past too). Will SSA not take me as seriously if I'm taking OTCs because my doctors are assholes and stopped my pain meds?

All I want is to be able to live, work, and be some approximation of a normal person. Continuous excruciating pain sours my mood, obliterates my relationships, twists my mind into an apathetic monster, and destroys my physical capacity for anything. The day they tell me I can't be cured and also that they won't prescribe adequate pain management, that's the day I'll start looking to street drugs. If I can't manage to acquire those without getting into trouble with the law and subsequently losing them, then that's the day I'll put a bullet between my eyes. Life as a mindless monster contorted in pain with a permanent grimace for a face is not worth continuing.

This is the main reason why the mass of us, need be more active in the legislatively. Best to have long term or short term disability insurance. It's a shame that you can be ill, but it have to be beyond. What if a person is asymptomatic or not showing as much as it really is, the person need their compensation? What if a person not have any insurance? This is ridiculous. They don't be all that process and procedure when they taking those taxes.

Not pleased to hear that depression is not considered as "significant" as schizophrenia. It's just as deadly and debilitating. Ive taken antipsychotics for my depression and panic disorder (in addition to other meds) and they were detrimental to my both health and my mental state. I do much better on antidepressants and anti-anxiety meds. I do wish the people in charge were better educated about depression and bipolar. Plus, how dare they judge someone's level of pain based on their drug use. Why would any sane person take opioids for a chronic pain condition, knowing what we know? I saw my mother nearly overdose because he doctor gave her a whole variety of opioids to take at the same time. Luckily, the prescribing laws in my state are more stringent. I was offered oxy and refused it. I'm not an idiot. I take a cocktail of over the counter oral and topical pain meds, which are nearly as effective at easing pain as opioids and are not addictive. No wonder we have people turning to street heroin when their oxy runs out, the medical establishment gets them hooked. Very sad.

Please do not assume my sanity because my doctors and I have decided I benefit from narcotics enough to use them long term. You want depression to be recognized and yet you stigmatize other people in the same paragraph. I’m happy to read that you can manage without oxy, because if there isnt a need, it’s best to stay away. I am not able to though for many reasons, and that’s okay too.

It's sad that you feel you can decide on seriousness of pain based on the meds the patient is taking. Suggests that patients who come in to Primary Care demanding controlled meds are encouraged to do just that for their disability status to be taken more seriously than someone who may be just as disabled but does not want the complications associated with using controlled substances, opioids in particular..

View the book at the reference desk or search "DSM-IV-TR GAF scores". These scores refer to MENTAL FUNCTIONING only---and are supposed to be INDEPENDENT of physical conditions. As a **general rule**, anyone with a **consistent** GAF score of under 60--and definitely under 50--would be lean towards "probably likely to be disabled--due to mental impaired"--IF the score can be supported by longitudinal history; objective--and appropriate--psychometric testing/assessment---and other data.

I am what you call "body sensitive" to the narcotics...... throw up, put me in hospital, bed spins, passing out ect..... so my physicians have me on a cocktail of many different middle medications. So, how will that work in my case..... it is documented that I can't take them...... last back surgery they gave me delodid (sp) during and after surgery and I was sick throwing up for a day from it, found out what they had done, told them to take me off and the throw up stopped and it threw me into a massive migraine. So with all my physical ailments and extreme pain, there is nothing that they can do..... your thoughts??

Medications mean nothing though. I am on the spectrum, I have Aspergers. And medication isn't going to magically make me better. I been working on getting a service dog because of my anxiety and my meltdowns and sensory overload. Either way though, I appear highly intelligent, but my adaptive behavior exam classifies me as low functioning in my day to day life. Medication should not be a factor in all disability cases. I think it should solely rely on the condition the person has. You can't take medication for all Autism. Not all of it requires medication.

Remember, the decision-makers deny NUMEROUS cases they believe are/might be disabled. Despite the language in your denial notices, the reality is that the evidence is not sufficient enough to meet the RIGID standards. By appealing in person (pref. w/ attorney), you can submit updated & even new medical evidence, challenge the information in your file; demonstrate your credibility; point out, discuss/resolve any inconsistencies; answer any questions posed by the judge, and more.

I can't afford to be off work for any period of time. how can I apply for disability if I'm still working. I'm in severe pain every day.

The devastating part of the disability process is that it is not really designed for people who are still working. The purpose of the regulation is focused on those people who's medical conditions prevent them from working. There are unique circumstances that may take in consideration people who are working under sheltered conditions but, unfortunately, Social Security is focusing on those people who are unable to work due to their medical conditions.

Have you changed your opinion about this since they started tightening up on Opioids? The VA doesn't give out strong pain medications anymore unless it is an extra extreme situation.

I need help. I have herniated discs. Fractured one of my vertebrae. Was born with severe scoliosis and a hereditary nerve disease called charcot-marie-tooth which causes my muscle mass to deteriorate. I've tried to work my whole life and just deal with it but at thirty years old i'm afraid that it's gotten so bad I most definitely need surgery. I can't afford to pay for surgery and badly need to get disability benefits along with the insurance. It's crazy the serious narcotic medications you mentioned don't even completely ease my pain. Only a little bit. Any help would be appreciated.

I would like to note that I disagree about what he is saying about the narcotics. If I could take narcotics frequently for pain without becoming addicted *I so would*. I don't think that is relevant b/c sometimes there are other non-narcotic medications that can make it tolerable, and there are many people who (like myself) put up with a horrifying amount of pain because they don't want another problem like addiction to derail their lives any further. Often people feel caught between a rock and hard place in that case and feel no choice but to live with pain and leave the narcotics for emergencies.

Nowhere NEAR enough info, to tell. Psychological testing/assessments? Psychologists/psychiatrists? Longitudinal history? Response to treatment? Documentation. RFC assessment or listing level severity? Medications play an important role; as do other recommendations from licensed treating sources; but is not everything. Decompensation? Work history, if any? Too vague to determine. Have you applied---and has your case been denied? Did you appeal in time? Still get denied? Hiring attorney?

3) It would be extremely rare to get approved on agoraphobia alone. If agoraphobia is any factor, the specifics (extent, reaction, etc, must be documented w/supporting evidence. In extreme (very rare) cares, a consultative examiner (psychologist or psychiatrist can come to the claimant's home---documentation must support the need, &appropriateness must be verified. Do panic attacks occur when the claimant attempts to leave the home? Neighborhood? Other reactions? To what extent? how long?

Also, I was wondering how long after the 10 page CDR packet has been completed and mailed in, how long will it take to receive a verdict? (From Massachusetts)

+In19944 exactly. i know that. you know that. but the medical establishment doesn't make money off of cures. the disability system is real old & so are the requirements. before I got sick, I worked at a car dealership & small engine repair. Now I can only lay down & have parkinsons, walking is real hard. The Vocational Expert said there were 74,000 jobs nationwide I could work on railcars & train maintenance. Even he laughed & said, "we should update the job list".

Paxil is very hard to wean off of. Everybody has a different chemistry, and what works for some in treatment will not work for others. Paxil does not eliminate Depression symptoms in many. Mental/Emotional disorders are very hard to treat, and not without trial, and error. I am sure a person who applies for disability because of migraines, and is on Anacin/Bayer asprin is most like not going to get SSD, as opposed to someone who has severe Depression disorder ,and is on Paxil Very hard to judge.

I believe one of the reasons most individuals get turned down is they are not very specific in their symptoms, diagnoses, and how their disability affects their life on a daily basis that they can't work. I've seen so many people fill out their part of the forms with 1 or 2 sentences of each question and they would be turned down over and over. I've also seen SSA also discriminate based an individual's education or age when they are truly disabled.

+DaisyExposer The first time I applied for Social Security Disability I was denied and had to file an appeal. It will take me 2 to 3 years just to get court hearing scheduled. I was unable to wait 2 to 3 years four a court hearing to be scheduled because I would be homeless, no food to eat, and lose everything I ever owned. So I started doing intensive research for 9 months to get my appeal case reviewed by the ODAR Office. With the information I gathered, I was able to get my appeal case reviewed by the ODAR Office and my case was forwarded to a Decision Writer. Yes I finally got approved for my Social Security Disability in 1 year. I did not hire an Attorney because I wanted to decide my own fate. That's when I decided to write a book called "How To Win Your Social Security disability Without An Attorney". Please log on to www.socialsecuritydisabilityandyou.com and download the book for $19.99. Good Luck

I will forward this to some friends who have been turned down. I applied in 1999 and was approved within 5 months. I believe it was because I wrote specifically how my disability affected my life, symptoms, etc. Weird thing is my ex applied in 1989 because of slow kidney failure. He finally hired an attorney and was approved in 2000. He won just after they changed the law that you would only get 2 years back pay. If he had won before that, he would have been owed 10 years back pay.

Typically, critical is a designation which allows SSA to process the case faster. This designation does not necessarily mean you will be approved or denied. This designation may mean that you don't have to wait as long for your case to be processed.

This doesn't really have anything to do with your video but you seem like a good person to ask; there is some kind of score you get 50+ means you should be able to work but under 50 means you're disabled enough that you probably can't work. What is the name of this "work score thing"?

Medications tried? Responses? Psychometric testing/assessment? Other physical/mental conditions? Behavior modification treatments? responses? success--to what extent, if any? or only to short extent? Can claimant get things done in house but not function outside of house--detailed ongoing documentation; do others provide items; shopping? Who? THE POINT BEING---THESE ARE SOME EXAMPLES. The system does seem, unequivocally, unfair.

How do I afford to pay for my own medical and maintain my life? Do you know if they will up the limit soon or is it a state by state thing? Thank you very much...

I have been on SSDI since 2007 and was approved for bipolar depression and anxiety on my 1st try. SSA did a medical review then I was denied. I filed appeal and had 1st appeal. Then denied again so hired a SSA attorney and filed 2nd appeal for ALJ. My appeal date should be coming up anytime soon. I can't work especially now due to fibromyalgia and osteo arthritis. I have been going to my doctors to update my medical records. I have substance abuse in my file. Now I am worried about being denied again cos in 9-10 months I have relapsed a few times and last dr appt last week he wanted know if I had done drug treatment which I did couple times before my disability. I agreed to give the treatment another try so I will be going in a few days. My medical records can prove I have cleaned for 3 years. Another time 6 years. Did I screw myself?
