MS employee here, my comments: 1. There is no grey area here, it is certainly a violation, even OEMs cannot sell licenses separately. They are only authorized to sell device (laptop or desktop) with license key in it. 2. In case of device malfunction or OS reinstallation, users purchased the device can get the key from OEM without any additional charge. 3. MS tracks individual licenses and knows through which channel(Retail, OEM) these licenses are purchased. Hence misuse like using DELL OEM key in Lenovo laptop can be easily tracked. 4. A2D could have easily reached out to MS to check authenticity of keys when he started his partnership with cdkey. These are my views and I am not authorized to speak for MS. Edit: Complaint has been filed internally. Website might be taken down if legal team decides to act on it.
