43 years old man using his mom as a shield to protect him from all his problems. Mom, hes an adult, has been an adult since the late 1990s, should told him in the early 2000s hes a grown man and be responsible. If he was an ID/DD or some form of mental disability that required guardianship, I would understand but this is a functioning brat.

From Georgia government website "During your court appearance, the judge will hear your plea and make a decision. You can: plead guilty and pay the fine, plead not guilty and request a jury trial, or plead Nolo Contendere (“No contest”). Please read the Georgia Department of Driver Services Traffic Court Reference Manual to learn about the implications of each plea." So YES, she does have a right to trial by jury. Almost no one does it because they're not aware or its not worth the time away from work or your day over what's probably under 200 dollar fine.

Those are your "pleas" under "Summary Justice" when in fact there are a whole range of plene ut plainte (pleas and plaints) going back to the beginning of your law that Roman-court judges will not tell you about and all of them have legal and lawful effect. Presumably because they themselves have no clue how their own law functions.

I have been in court twice in my life... first time was a traffic stop and the officer noticed a rolled cigarette in my shirt pocket I got from a hitch hiker for giving him a ride. Never gave it a though. But it was in the 70's and they removed me from the vehicle and arrested me. Read me my rights as the other officer searched my vehicle and found nothing else after 30 minutes... since his partner had read me my rights it was jail for the night... I went to court without an attorney and plead guilty after explaining how I received the joint (a blunts outer wrapping is to be a cigar leaf) I was put on 6 months probation charges dropped if no other infractions in the time and my record would be clean. Even just a joint was serious in the 70's. Second time I was rear ended and the gentleman tried to sue me, again I explained what had happened and the judged ruled in my favor plus extra cost for some reason... Again in the 70's... Beware of the stupid 20's stage in life....

Good evening Mike. We actually have snow and ice everywhere down here in Louisiana. The people here can not drive in this weather and act nuts. My family is from Chicago so we know how to handle it plus my son and I both have Jeep Wrangler 4 wheel drive vehicles so that helps. I'm probably going to have to drive over a hour out to the country almost to the Arkansas border to rescue my mother and aunt as they decided not to come to the city to ride out the weather in her city house. Oh well we do whatever we have to do for our mothers and when she's in her 80's what are you going to do. Have fun wherever you are at.

Note that the judge did not get it wrong (re: 7th Amendment). It isn't something that comes up frequently, but 7A is one of the amendments that has never been "incorporated" (that is, applied to) the states. If this isn't a federal court regarding federal civil conflict... the claimed standard does not apply. Many (most?) states have their own minimum listed in their state constitution. But I think this was an appeal from a traffic offense and thus wouldn't qualify anyway.

So, the Seventh Amendment of the U.S. Constitution does not apply to state cases. The amendment only applies to federal civil courts and does not apply to state civil courts that only hear state law disputes. The Seventh Amendment protects the right of citizens to have a jury trial in federal courts for civil cases where the claim exceeds a certain dollar value. The amendment is unusual because the U.S. Supreme Court has required states to protect almost every other right in the Bill of Rights, but not the right to civil jury trials. However, most state constitutions include their own provisions guaranteeing trial rights. Almost every state has a provision for jury trials in civil cases in its constitution.

The Supreme Court has held that the 7th Amendment does not apply to lawsuits in state court. It’s one of the few provisions of the Bill of Rights that either the Supreme Court has held, does not apply to the states (like the right to a grand jury indictment and felony cases) or where there’s no Supreme Court case on point (like the third amendment prohibition on quartering troops). Of course, a state is free to set its own state, court jury threshold as high or low as it chooses.

Yep, 7th amendment handles suits and not criminal/administrative proceedings. Honestly, we need a few amendments to the amendments. Such as changing the $20 limit of the 7th to some percentage of a set value, like the minimum income that is taxable or something along those lines. Also an amendment to codify what the sixth amendment means by speedy, which should lay out something like 48 hours for initial arraignment, formal charges must be filed within 30 days and a trial must be conducted within 1 year of the arraignment unless both the defendant and prosecution agree to a continuance/deferment.

As I understand it, the courts have arbitrarily "bumped" up the original $20 threshold to $75,000. Now, I understand inflation, but that seems to be such a ridiculous overreach, as to make it unenforceable. I'm not even sure a realistic inflation amount could hold up in court since the 7th amendment offered no such contingent.
