In Michigan, as Mike said, A PR bond is a personal recognizance bond meaning the person is let out for free if they do not break any more laws or have arrests. It is the same as when Judge Manning from Fulton Co. Georgia says good bond meaning you promise to be good and show up to all your court dates. They are called different thing in different states. If this judge gives this guy one i will eat a ghost pepper with wasabi on it.

I have a counter example to illustrate how far good behaviour can take one. There was a mister Schrock in Michigan who appeared by zoom in a judge Middleton video. Mister Schrock was on probation for some felony and had violated the terms by consuming meth. He was very apologetic and pleaded guilty to the violation. Taking into account how he was courteous, had no prior probation violations, had a job and a family to support him, judge Middleton sentenced mister Schrock to two days of jail to be done over the weekend so that mister Schrock doesn't miss a day of work.

I think the issue about, "you're practicing law from the bench," has to do with the ethical proscription against an impartial arbiter acting as an advocate for either party. In entering a plea on behalf of a defendant who stands mute or refuses to plead, the court is not acting as an advocate, but is acting to protect the integrity of the proceedings, as well as preserving the defendant's constitutional rights.

I moved to the US about 14 years ago when I was 19, from a British territory. I had to follow the laws of the land I wished to reside peaceably in. That meant I had to wait 2 more years to have an alcoholic drink again(legally 😜), color, harbor and labor had no U in it, roundabouts were called traffic circles, etc. But I’m pretty sure ‘tooken’ is still not a word. American or otherwise

Long ago, what happened when the accused refused to plead to an indictment was the person was subjected to "peine forte et dure" until either he pleaded or he was dead. That's what happened to the one "witch" in Salem, Massachusetts who refused to plead. The others were hanged, but the one who didn't plead was pressed to death. I think these sovcits should get on their knees and thank God the judge is allowed to enter a plea on their behalf.

Giles Corey, was the name of the alleged Witch, who refused to enter a plea. Both he and his wife were accused as a supposed plot to acquire their farm land by a more affluent family in Salem. Which was the cause of many of the allegations of Witchcraft. He was tortured for 3 days, before he died by pressing. Not exactly a bright day in American history, coupled with thousands of others.

None of the judges are practicing law improperly from the bench. Which is how it should be said if they were. But they are always supposed to follow the law from the bench. As Mike so eloquently pointed out, if a defendent refuses to enter a plea, the legal rules state the judge must enter a not guilty plea on their behalf at that time. They can change that at another time following. It doesn't put the defendent at a disadvantage in any way.

The US bail system is so strange when compared to the UK. In the UK he would be out on police bail where there's no fee, he might have some conditions imposed, have to report to the police station at intervals etc but remand is unlikely for a non violent drug possession offense. And there's no way he'd be facing 20 years for possession of methamphetamine whether or not he'd had 3 previous convictions. You can get convicted of murder and get less than 20 years here, that possible sentence is utterly ridiculous.

The US bail system is horrendously broken in most states and leads to poor people who haven't been convicted spending time in jail for minor offences. Sentencing is also similarly ridiculous. The US has the highest incarceration rate in the world but doesn't have the lowest rates of crime so your system is broken. Rather that try an fob the problem off onto other people, maybe you should try and fix it.

When I think about this guy I feel sad, like he said it's his life. He has to be tired of it. Mike wasn't sure if he believed everything he said. I have met people like this, there is always crazy things happening around them. Like his dad is missing and his mom is Awall the caretaker died, and all those charges against him. After I went to work, my second job and did things around the house, I didn't have time to get into trouble. That's how most of us live. Someone has to get a handle on this before these people turn 12 or 13. They need to know an, education is the way, they don't wind up, with a life like this. Also the drug problem, these kids start early, and can't stop.

You can call that "biasing" the judge's opinion if you want. I choose to call it "making a well informed decision".

This is the thing that blows my mind about these sovcits. Why would they think that the small amount of research(if you wanna call it that) they'd done in jail and the advice they got from their idiot friends, be in any way capable of going up against a prosecutor or a judge who has spent their entire lives learning and training on this. They went to school for a ridiculously long time and it's safe to assume they are somewhat intelligent naturally to have achieved their position. The ego it takes to be that kind of arrogant and disrespect the work and knowledge of these very well educated people. You're not gonna catch them up or trick them by using some magic sovcit spell while in court.

That is attorney won't even look up at him, he doesn't want to be there. I am betting his client has run him through the mill............He just looks beat. I wonder why this has taken a year, no damn wonder that attorney looks worn out!!!! Oh my, both parents have wandered away, and the caretaker for the father died, I don't doubt his dad may be missing, but all that other stuff, I have a hard time with this story?? I feel like he is saying what he feels will work best for him in order to get out, what he thinks the judge will be most sympathetic with.
