Squatter laws apply to "abandoned" properties. If the taxes are current the property is not abandoned. These people should be arrested on the spot for breaking and entering, burglary and any other charge they can come up with. Your better off not calling the police and retaking possession of the property by force if necessary. If someone is arrested/charged for retaking their own property and I was on a jury I would side with the homeowner and nullify the jury. Seems the Castle Doctrine should apply here.

The problem all states (except Florida) have is that squatters claim to be tenants and tenant law puts the burden on the property owner to disprove that statement. There need to be tenant protection or else crappy landlords could toss tenants out at will. And there also needs to be ways to eject (not evict) squatters as trespassers. With apartment complexes, there is no problem. They are for rental obviously. Condos and single family homes are more tricky.

Not true. Squatters can gain possession of a property by Adverse Possession. It doesn't generally apply to those squatting in unoccupied homes or apartments because of the requirements to adversely gain possession of property. This is true in every state though the criteria changes slightly.

In some states, getting mail with your name and their address on it, I dont care if its a magazine subscription - now it becomes a civil matter and the police cant do squat until you get an eviction order. That is exactly what this guy did. Now every state is different (a day, 3 days, 7?) so he was banking on her not acting before the threshold is up. So the cops come and he is able to show the fake lease, his driver's license and mail and say "see officer, I live here" Now its a civil matter. Some, not all, squatters will open and pay for utilities like this guy, to establish tenancy, making it harder to get rid of them. And no, dude, the property owner wouldnt be held liable, unless the squatter stole their ID and opened the account in the owner's name. This guy was an idiot for suing her! He was trying to be slick when he shouldve kept her mouth shut and made her sue him and get the eviction processs started - which can take several weeks or even over a year (as they keep using delaying tactics) But since he brought this to the judge's attention, he essentially evicted himself.

Glad I live in an area where squatters rights do not exists. I only have to post a no trespassing sign. If they trespass they get arrested or shot if they get violent before police arrive. We also have stand your ground laws. When a homeless person ask to use the hose to refill their water jugs, im not going to be cruel but they can't stay with the exception of some rovers that took shelter in the barn during a bad electric Storm. The father risk his life to knock on door and let me know they we there, would not steal, and would be gone after the storm. I informed them they were trespassing, but under the circumstances I was not making it an issue. I'm still friends with those folks.

Technically! But it also depends on what state you live in too. Because states such as New York and California, the squatters have more rights than the property owners. California is by far the easiest state for squatters to steal your property and only need to be in your property for 30 days minimum to legally repossess the squatted property. California even became the first U.S state to invent squatters Insurance if any squatters repossess anyone's property whether the owner is out of town, plans to use it as a rental home, renovating, or even as an air bnb.

We need more judges like this. It took me over 1 1/2 to kick out a squatter in Philadelphia. On the meantime, I had to pay the mortgage, gas bill because it was leaned against the house, and $6,000 in water bills. he probably has done that before find a vacant place under renovation which means it might not be locked so the contractors can get in or who forget to lock up, break the lock put in new locks makes me wonder why the contractors did not report it unless they were done and he ws waiting in the wings.
