Tawanda Hall was slightly behind on her property taxes. She was on a payment plan, but short $900.
So the government took her whole $308,000 home.
Hall says she tried to pay, but, “They didn’t want our money… They wanted our house."
Now they’ve got it, and the town won’t give her the $286,000 difference back. That’s just wrong.
Hall’s attorney, Christina Martin of the Pacific Legal Foundation, says the government can’t take more than it’s owed. But that’s exactly what’s happening in eleven states. "This is unjust and it is unconstitutional."
She’s gotten three states to stop doing these confiscations.
But it’s kind of crazy to find out how common this is. In 11 states, if you’re behind on your taxes, local governments can grab your home and keep much more than what you owed.

A government that is ok taking a person’s home due to an 8 dollar debt is a government that won’t hesitate to imprison someone for little or no reason. Pure evil.

@@mikeicee That's not true. You can own land outright with no taxation on Native sovereign land. I'm Choctaw and my land in Pushmataha can't be taxed by your government.

If I was a city official and I saw an $8 tax bill and that the person was going to lose their home over it, I'd skip lunch and pay the $8 tax bill. That's the human thing to do.

The only difference in paying a mortgage vs. renting is the mortgage payment doesn’t change over time unless refinancing is done. At least for now. The taxes and insurance go up that can be another can of worms.

There is another layer to this that ticks me off: Even if (hopefully when) these citizens win their cases against the government, the government was still paid by the tax payer while they were stealing houses, and the tax payer will pay the legal fees for the government while they attempt to defend their house thefts. It's lose, lose, lose for the tax payer.

No one owns property as long as property tax exists. Property tax effectively means that you are renting your property from the government. It is wrong. Property tax needs to be abolished and made illegal, or better yet, made unconstitutional via amendment.

Yes, I’ve seen senior citizens who worked their whole lives to pay off a 30 year mortgage lose their home over these taxes! We are paying for our homes over & over again. It’s absolutely ridiculous.

I'm not gonna lie, seeing this completely -to my mind at least- justifies a lot of violent action people are forced into taking when their government quite literally shuts the door in their faces after stealing from them.

Property tax is ridiculous. The idea of having to pay a tax just for owning a property is mind boggling. If I remember correctly the majority of tax revenues from property goes towards funding public schools, but they keep asking for more money every year while test scores and student performance declines. It's almost like government uses sleight of hand to keep people poor while preaching that all these government programs are good for us.

There is good reason for property tax when it is small (below 0.1% of value per year) and owner decides value by himself. In that case, everyone know what property value is, so if it get destroyer by anyone (including government) they are required to pay back the value +20%. The need for hiring lawyer and go to court to prove you property value becomes pointless and you don't loose half of the payback due to fees.

Really what it is: You don't purchase the property, you merely purchase the right to rent it from the state. What about schools? What about fire departments? Police??? These can all be handled in other ways. You should just own your property.

Every time I hear someone say "I own my home," I laugh at them. You own nothing in the US. You pay a lease to the government to use the property where you live. You own nothing, and you WILL be happy. Because they say so.

@TheCarnivoreSoprano Yeah, you absolutely do! It's crazy to me that people don't even understand the basic structure and inner workings of their own government. Smdh! Of course, most of those same people will be totally comfortable with voting for a president. (As well as have strong convictions about what side of the isle they sit on). Tbh, this is exactly what is wrong with our country, no responsibility or accountability, but everyone has a say. All town hall meetings are open to the public. They veeeeery rarely have closed doors. They discuss all town issues in those meetings. If they are going to do something, they will discuss it, and then they'll vote. So, for instance, a business comes in and wants to privatize a utility board. (Keep in mind this has already happened in the majority of all communities bc people weren't paying attention). They can't just do it and sign a contract without a vote taking place. They also must have sufficient notice to the public what they are doing. They hold a meeting to discuss it publicly. Then, if there are any questions or comments by the citizens, then they're given a time allotment to say their peace. Then, they must have a vote, and the majority of all votes will determine what they'll do. If the citizens show up and vote no, it doesn't matter if the entire board voted, yes, they'll still be out voted. The board's vote isn't any more persuasive than a regular citizen. This is obviously a simplified description, and I didn't go into details about state or anything like that, tho. There are thousands of these meetings being posted online, and most towns now even have online access for citizens too. They have to do all of these things bc it's literally the law. There have been times when the council was going to vote in favor of something, and less than 5 people just showing up to vote has kept it from happening. Not voting sends them the message that the community doesn't care...bc most don't. It is like giving someone else your vote and trusting them to vote for your own personal benefit. That's exactly what that is. It's even worse when you realize that most people don't even know whose representing them at all. They might see a sign in a yard or get a flyer handed out to them, but they couldn't tell you anything about them at all. Another incredibly stupid thing about not getting educated about local and state gov, is that the majority of those non-voters will 100% go vote in the presidential election. Yet our votes are significantly more impactful in our local communities than in our federal offices! This is also why a lot of reps take advantage of their positions! We aren't going to keep them accountable to us! THEY. WORK. FOR. US. Imagine pouring every cent you can into a business investment. You hire employees and get your business started and running well. Then, one day, you just stop showing up to your business. You keep paying your employees. Every now and then, you message them about plans and ideas you want to do. However, you just don't ever go back. Days, weeks, months, few years. Anyone quits you just replace them and keep it moving. You aren't checking to make sure that they even show up! If you do ever have anything you want them to do, then they just tell you they can't without more money. Every time. More more more. This is the equivalent of ignoring your government and especially your local government!

I know a senior living on a fixed income that has had to deal with the stress of coming up with $1200 every year or risk losing her home. She manages to make the payment from asking friends and family to help. What is the point of social security if the state can take away a senior's home?

Well you never owned it, you payed rent in the form of taxes, grant it that is supposed to pay for municipal services, but if that is the case they need to do more. I am more concerned about Democrat versus Republican/ Left versus Right tactics that can be used in this way to kick out those of a community just because of political sides.

Ban taxes on everyone with less than $200,000worth of property. Let everyone use an acre of free tax free land to live on. Its unfair to force those who pay taxes to subsidize those who dont? The only point of taxes is for tax payers to subsidize those who dont pay taxes. Thats an argument against taxing people and stealing their homes at all. These gov thieves belong in prison! Make them pay compensation to their victims, that they earn from working in labor prison, not from a tax funded job and not with tax money.

Property taxes are our government's way to say, "You don't own your property. We do. You may use it as long as you pay rent." The fact that the city officials are personally getting to pocket the money is particularly egregious.

@@bvegannow1936 that would not have helped anyone in this story. Property taxes should be banned. Consider a retiree on a fixed income. If there was an income tax, they could control their income and predict their taxes. But property taxes are based on assessed value and that is out of the control of the owner. Even if after age 65 the county cannot raise the amount they claim, they can have already raised it to such a high level that a person on a fixed income can no longer pay.

Anyone who buys a house needs to know that even when you own your house outright they can still take it from you for not paying the taxes every year. It sucks but it's the way things have been for a really long time, property taxes (especially fully paid for/owned) should be illegal.

If the government can take your house do you really own it ? I mean you can not both own the house and not own it at the same time. To me at least in America home ownership is a full fledged scam. It's like if i bought a computer from amazon and paid taxes on that computer every year until i am dead. Than to make it worse if i miss a yearly tax on the computer amazon Come's to my house and take it from me. Not only would i never pay the damn thing off i also could not be rightfully said to own it.

A challenge to property taxes needs to make it to the supreme court. This case could set the states ablaze. Property taxes on homes and land shouldn't be a thing.

Govmnt can "seize" any property they please, at any time they please. The Bill of Rights of the USA Constitution is a Feel-Good document that has no legal authority over Police Departments, who will take your house if directed by local Govmnt,,, OR take your car and cash if they please. Civil Asset Forfeiture supersedes the Constitution

@@bvegannow1936 End ALL property tax! Look at farmers. Some farmers own millions in land but when they leave it to their son they're taxed even though they don't sell it. I personally bought a property 10 years ago for 120,000. I worked my ass off improving it paying for everything with cash! It is now worth 300,000. Why should I have to pay taxes because I improved my property?

6 years ago I came across this article/video telling a story how a man worked hard all his life (lets call him jack)..finally after 30 years the day came when he had paid off his mortgage..he received the fancy paper that said DEED..he was proud of his accomplishment..(jack) a short time later got down sized from his job of 37 years..his company was merged with a bigger one and part of the merger was that pensions were converted to 401k and his blue cross blue shield was now a 1/3 of his monthly payout which had been reduced when the pensions were converted over.. Then his wife became ill and his medical (also reduced) didn't cover the most expensive parts..soon his savings were depleted and he went into debt after almost a year..so (jack) went for a home equity home loan that would almost cover all his debt..he could make the payments and with the help of family and friends pay off the rest of his debt to be eligible for the loan.. Hoop after hoop he was made to jump through by the bank he had done business with for over 50 years to acquire this loan..he had been in contact with all of his debtors including the county tax office and everything was in line to be taken care of..then he received a eviction notice to vacate the premises within 14 days..not 30 for non payment of property taxes..he vacated and by the time he got a lawyer and a court date the house was auctioned off.. I thought this can't be right..so I dug into it..it's true even if you you hold the deed to your home it doesn't matter..you just rent your home from the county in the form of property taxes while you maintain the property to the city's standard and banks are very eager to see your demise so they can get another mortgage on the property..it boils down to this folks..you are a cash cow for the county and the banking system if you choose to own a home and live in it.. You know what I did when I regathered my thoughts of how much of a rip off owning a home was ? we sold ours and most of our belongings and bought a class "A" motorhome..click on my avatar and you will a 3 part video of a home that can't be foreclosed on because it's payed off and there are no property taxes on it so we can't be evicted..matter of fact only taxes on it are the tags (and those are a requirement..only if you drive on the road with it)and gasoline and btw the house in the video is the one that was sold..we go anywhere we want when we want and we are debt free..also being in this coach is a lot cheaper than a house let me tell you..the best thing about it all is all the headaches of owning a home like the lawn,crappy neighbor's,expensive repairs some stranger from the city telling YOU what you can and can't do with YOUR property anything you can think of to do with home ownership just dries up and blows away in the wake of your coach (sighs a sigh of complete contentment) 😎

@@taralynnhoffmann5831 True..at best they sleep 6 with some rearranging..but a bunk house 5th wheel can sleep much more..and my neighbor next door where I am currently camped has 1999 38 foot Alpha 5th wheel for less than 10 grand..the point being here is there are options out there to be found..I didn't mention it before but we are right side up by about 20 grand in our coach..that is a extreme rarity in the RV world and the coach being a 3 slide model will never drop below what we payed for it..so there is a very positive outcome at going this direction financially..you just have to put in the time to find the deals..NEVER EVER buy from a RV dealer go private only..also here is some more advice 1998-2008 are the golden years for RV's luxury and quality of build..if this is something that might appeal to you hit me up on my channel and we can further this conversation..

Interesting to hear how one can justify taking the ENTIRE SALE for unpaid taxes, whether it's 900 or 9000 by saying that the rest of the community subsidizes the amount owed. It is a BROKEN BUSINESS model. It's DISGUSTING and REPREHENSIBLE. People should NOT lose their homes over it. What should happen is a lien is put against the home with a small bit of interest added and if not paid within 25 yrs then sold, TAXES owed plus interest taken with the proceeds given to the person who owns the home.

@@lemongrass3945 You are missing the point. I agree, after say ten years of unpaid taxes, sure, the town, city, etc has every right to sell the property and house for unpaid taxes. However, they should only be able to collect the 22 000 in arrears, plus an acceptable amount of interest. The rest of the sale should go to the person who owned the home. Otherwise, it's just LEGALIZED Theft.

Ban taxes on everyone with less than $200,000worth of property. Let everyone use an acre of free tax free land to live on. Its unfair to force those who pay taxes to subsidize those who dont? The only point of taxes is for tax payers to subsidize those who dont pay taxes. Thats an argument against taxing people and stealing their homes at all. These gov thieves belong in prison! Make them pay compensation to their victims, that they earn from working in labor prison, not from a tax funded job and not with tax money.

I had a friend lose a house for a Wal-Mart. The city only paid him a portion of the value. He lived there for 30 years before. Wal-Mart pays no local taxes here. The truth is no one really owns their house. If you did, you would not need to pay the state for the right to live in it.

@@noelc2 I am 76 and pay NO property taxes at all. (my taxes are deferred and will be subtracted from the value of the property when I croak.) So I can enjoy my house till I die and my relatives pay whatever tax is then due when they inherit. This is available in Texas, I don't know about other places.

This is also the biggest problem with Eminent Domain in the United States. A city or state can take someone's property, "for the public good", and sell it to a private developer to build a Walmart or shopping center. It's basically legalized theft.

I bought a derelict house, the town tried to make me pay for water services retroactively back to the turn of the last century, WITH INTEREST. I could write pages upon pages of horror stories about my town, but suffice it to say, I WILL be running for council after seeing the dishonorable and illegal way they operate.

My latest one is that they charge me 2x property taxes, and 2x service fees because I am a duplex, but when I asked for a second waste bin, they told me it would cost 120$ a month, as my type of duplex didn't get a second bin. I take my trash to city hall now. Oh, and as of today they've issued a complete moratorium on all building. their mismanagement has lead to a failure in the sewage system. I know a lot more about it, but that's a tome on it's own. I WILL be running for council this year though.

@@dannydaw59 There was no record of it anywhere until I showed up at city hall. I didn't wind up paying for it, but that's mostly because there was a giant fight inside city hall about it. That is how they work though. Often borderline criminal. They'll take money in trust for developments, then spring changes and tack on costs to the developer, after they've already put up money and started engineering. Each phase brings additional costs, and often draconian demands. They were mad at one guy and started to put a law on the books requiring a study from a consultant and a permit for each individual tree cut down over 4". The guy owns 40 acres of forest full of fast growing cottonwoods. He deforested the whole hillside before the law passed. Sometimes it seems they just make shit up. We've had to get the province, and large utility companies lawyers involved several times. The law is whatever people with power get away with doing. If they do it, and people cannot stop it, then that's just how it works.

Property tax should be illegal. By implementing it, the state is declaring that owning property is illegal; you can only rent from the government, which owns everything. This is indisputably a heinous violation of our basic human rights. However, like with every violation, 99% of people just accept it and go along with it because it doesn't affect them personally. Until it does. It's good to see more people waking up to reality, but nothing will change until the majority are informed and willing to act.

Thank you Mr. Stossel for revealing this evil. I sincerely hope that mayor and his corrupt colleagues are held accountable, including jail time. Another area that you may have explored is where politicians are using eminent domain to acquire valuable property they can turn over to their developer friends.

My friend always told me, that government is eviler than those scam callers. The government will never let citizens know what they owed, or how much they owed. My friend owed 78 dollars to IRS, but he did not know about it, and later government charge him 24078 dollars for not paying immediately with a late fine and delay payment.

Article 10 states all power NOT given to the Feds belongs to the States and local governments (where you may ACTUALLY be listened to). For a century treasonous politicians and bureaucrats have steadily and, in violation of the Constitution, acquired vast amounts of power and the money (taxes) that come with that.

Ban taxes on everyone with less than $200,000worth of property. Let everyone use an acre of free tax free land to live on. Its unfair to force those who pay taxes to subsidize those who dont? The only point of taxes is for tax payers to subsidize those who dont pay taxes. Thats an argument against taxing people and stealing their homes at all. These gov thieves belong in prison! Make them pay compensation to their victims, that they earn from working in labor prison, not from a tax funded job and not with tax money. Replace taxes with independence and chairty.

I'm a baby boomer, and this has been standard practice as long as I can remember. But yeah, it defies common sense that the government can keep more than what they are owed. It's almost like another form of civil asset forfeiture, which is morally repugnant as well.

I see this as a long con. By shaping the enemy(baby boomers) into investing all their money into their real estate as a nest egg. Then just before the boomer bite the dust, passing on their inheritance. Create a law that allows for the seizing of the number one greatest value the citizens had.

As I see it, levying and collecting an arbitrarily high tax on property violates the doctrine of substantive due process under the 14th amendment (how can you tax someone without any regard whatsoever to their ability to pay?) and it violates the fundamental right to "acquire, possess and protect property" set forth in many state constitutions (as taken almost verbatim from George Mason's Virginia Declaration of Rights). Finally, property tax - especially as it applies to residential property - is a manifestation of pure Satanic communism. If you have a God given right to exist in the first place, then you also have a right to the things you need to exist such as land (for food and water) and "shelter" (shelter from the elements) But in communist countries like America, you have to pay the state just to be allowed to have land and shelter and therefore to exist. This means the state has usurped God - which is what communism is all about. That's why "the abolition of property in land and application of all rents of land to public purposes" is the VERY FIRST tenet of Karl Marx' communist manifesto.

@@BS-vx8dg well if you were born 1946, if voting was 18 you could've voted by 1964 if 22 han 1968... this was he oldest batch of boomers. he youngest batch born 1964 couldn't vote unil 1982-1986.... but boomers do get a lot of flak they're no a monolithic group.

this happened to an older lady near me in my country of Canada, she owed the local government 350 dollars in property taxes so they took her home which she bought for 200k and the city sold it to a developer for 3.5 million.. this is disgusting

Poor woman. I'm Canadian, too (I live just outside of Vancouver, BC). I was wondering if this happened in Canada when I read your comment. What city did this happen in? Where I live, if seniors can't afford their property tax, they don't have to pay it, but the city keeps track. When the person passes away, whoever inherits the home can keep it as long as they pay off the debt (or sell the home, pay off the debt and then keep the difference.)

@@Person_Not_Known Yup. We "ain't" in Texas (except maybe Alberta). We're a "mortgage" jurisdiction like Oregon. We're NOT a "Deed of Trust" jurisdiction like Texas, Florida, Calif. et al. Completely different financial system.

the 2nd amendment is no good when you have an invincible government where you have no chance of fighting these thugs off. You could kill a few dozen cops but you'll be destroyed trying to defend your own home. The 2nd amendment doesn't keep government in check nothing does, only when people stop believing that a small group of people have rights that no one else has does this crap end.

@@AndSendMe I agree, and commend your valiant effort to bring truth to light, but take it from someone who's been around for quite a while, given that "there's none so blind as those that will not see", you're more than likely tilting at windmills. Perhaps I'm too much of a misanthrope, but the repeated demonstration time and time again of the inability of roughly half this country to understand facts or history is just too overwhelming. I've become an ardent follower of the saying "life is too short to argue with stupid people." And I love Mark Twain's admonition in that regard as well.

Property taxes are flat out wrong. You're basically renting your own property from the government. Hurts the elderly the most. Basically forced into selling their paid for house because the property taxes are too much.

One of the main reasons california is such a basket case is the low property tax. Compare this with high property tax red states without income and sales taxes.

If it's unfair that taxpayers have to subsidise her property taxes, does that mean the taxpayers will see £286k of tax rebate? Nah, I suspect not. This is just corruption, plain and simple. Far more predatory than any of the payday lenders that get criticised, at least there's a voluntary element to that, you can't choose to NOT pay your taxes as far as the state is concerned

Exactly, their whole argument topples down after knowing that the revenues created by stealing these homes aren't going to the taxpayers that has to "make up for missing taxes" and instead go to corrupt officials. Though it is still not fair to take the home completely especially without any refunds.

I had a friend that built his home and lived in it mortgage free for many years. His wife left him and he went through a head up his ass faze for a couple of years. He lost his non mortgaged home because of overdue taxes.

Yep in Indiana my property taxes have increased 360% in the last two years and there is nothing stopping them from raising it every year.

My county made me pay $500 for mailing my property taxes with a Bank Check to the State Comptroller instead of the County assessor. The State comptroller received my check on December 29th, but mailed it back out to me On February 1, 2022, six weeks later. February 1st was the first day of my delinquency period. I went to the Mayor, the Tax Assessor, the County Commissioner, the City Manager and ALL to no avail. Government in all form is corrupt and just horrible.
