Right now, H1B is given to lower wages, not the best talent. As an engineer, I see many Indian engineers getting paid $30-$50/hr where American engineers like myself are unable to compete. It's a great program for business owners. Not engineers.

Quick story to share. I jumped into IT in the 1980s and the IT department was half Black and everyone was American. H1B blew up in the 1990s. I am retiring soon and IT departments have less than 5 percent black. There is nothing an H1B can do that any American can't do.

H1B is absolutely needed to bring top talent some times these Talent are foreign born students in STEM degrees that stay back after graduating from our colleges. Americans always need to be told they are the best. You can keep with that BS or admit that our native born don't take to math and science like the previous generations. Lot of companies in US are made with the hardwork of these H1B's who never get enough credit. Look around 33% of all silicon valley startups are foreign born. Look around top CEOs etc are foreign born. The H1 program has prevailing wages determined by Dept of labor we can revise it and make H1 change employers easily so all these will increase their cost in the market further so there is no discussion about undercutting local born. At the end now days a guy flipping burger has an opinion on H1B as if with little training he can be a data scientist. Funny, ignorance is bliss. I believe Elon and Vivek are uniquely apt to fix H1B shortcomings. Trump added some safegaurds in first term to this program in first term that was gutted by biden. Bring it back also. Why would another country send their best people? This is not true? Their government keeps them in their country. India is sending their mediocre talent. As a US software engineer native to the country, I can definitely say I've seen a huge trend of American companies outsourcing their tech jobs to foreign workers either via H1B visas or through outright contracting with foreign companies. While software engineering is definitely a specialized skill and there can be individuals out there with a lot of experience and some talent, the vast majority of the work that companies are outsourcing doesn't require the top 0.1% let alone the top 10% of talent in the world. I most definitely wouldn't say that the work I do is anything close to "top talent" level, yet when I consistently meet with very "well known US companies", their developers are all from India, some of which live in the states on visas or have lived in the states for a short time and are now working out of India for US companies. US companies aren't outsourcing because they can't find talent here, they are outsourcing to be greedy and not have to pay a fair wage + benefits to the average American worker. Then after selling out American workers, they turn around and sell our own US made software back to us at exorbitant prices. The entire irony of all of this being, that most of the people in the world pirating software are from impoverished countries where it doesn't get prosecuted. Meanwhile, the average person here in the US can get a hefty fine...... if they don't know what they are doing, for torrenting software. What a joke.

But it’s never ever as high as 500k. The cap is always in the range of 60-120k new H1Bs per year. Where are you getting this “half a million per year” figure? Also, the government has a cap on green cards per year, and it is 14k per country. So even if 80k are coming in on H1B, they won’t all be able to permanently live in the U.S. H1B is a temporary resident visa. If they become unemployed for 60 days, they have to leave the U.S. Their spouses and children are also ineligible to work in the U.S. They can’t retire in the U.S. Only permanent residents (green card holders) can live permanent and their spouse and children can work, and they can retire in the US. But that’s only 14k per year from any single country like India.

I'm not a fan of these visas. Most companies that want this will be paying half or less than half the wage of an American worker. According to MIT the US has plenty of qualified workers for these positions. I would be in favor of bringing in the genius crowd. If companies want an H1B worker then they must pay 50% more than the prevailing wage for that position. Meaning the highly skilled H1B's that the companies deem worth the expenditure will stay. There are massive problems with the program. It should be dissolved and replaced with something new that only allows companies to take the top 0.01% of talent. This program would charge a 50% above prevailing wage premium tax on companies using the program. They can bring someone in to fill a 200k salary position but they will have to pay 100k tax on top. That money would be used for upskilling the American workforce to ensure we have the most skilled workforce in the world.

Ironic that Elon Musk, who himself is an import, wants to import others and get them for a fraction of the price. This is all about saving money and maintaining complete monopolistic control. Musk bought a company (he didn't create Tesla) built it off of government subsidies, and tax incentives. His companies are notoriously anti-union, have many lawsuits concerning working conditions, and discrimination. It relies on heavy immigrant labor in the engineering, tech departments, and upper management. That Musk has this point of view isn't surprising, he is not on the side of the American worker, never has been, never will be. The question is whether the American people realize who has president Trump's ear and their agenda.

There will never be "blanket" immunity for police officers. Any officer who abuses their power, uses their position to break the law, or murders someone should always be held responsible. They deserve due process, and nothing more or less. There MUST be more oversight in local law enforcement. What's gone on can go on no longer.

Only 85000 people get the H1-B visa with lottery system per year. The employer needs to pay the salary which is decided by the department of labor. Don’t know how they abuse that system though.

Worked for an Indian owned tech company for many years. Maybe 1 of 10 visa recipients there were defensible on grounds other than cost savings. Maybe. More like 1 in 50 tbh. There was one legit genius we were lucky to have in the country

As an attorney I’d offer that revisiting the sovereign immunity doctrine is a MUST. We need more accountability by our government employees and peace officers across the board…unfortunately. The level of their immunity for their actions is unclear and one of the hardest matters to argue in court. And the outcomes lean the wrong way

See, the rub is this. I worked in corporate environments across multiple companies for several decades. H1-B is good for some things where we genuinely cannot find people. Many doctors and such are here on H1-B. Certainly there are some very high level folks in different fields that have come here. The problem though is right now companies are abusing the heck out of it. They are NOT just hiring the "best and the brightest" or the top talent. Companies, especially in IT, are bringing in foreign workers primarily from India, who are no more skilled than many American workers. The thing is, the foreign workers tend to make much less money, sometimes half as much. Additionally, they can overwork the foreign workers because they can't really quit or they have to return home. So, not only are American workers losing out on work, but the people brought in are being exploited. These positions are being filled across levels in an organization including entry level and it's a genuine problem.

I read that Musk fired TI workers to hire HB-1 workers were replacements at lower wages. Nothing against legal immigrants but pushing out American workers is wrong. That's not the American way. SA Smith needs to research why some are calling foul. Farmers can't have immigrant workers but billionaires can. Make it make sense.

Hey Stephen A Smith, I believe you have a substantive voice in America today and I respect and admire your tenacity and ability to give quality and quantitative commentary on the pungent issues of our day. With that said, please be careful to think the H1-B policy thoroughly through before taking a stand on a “sports winning concept” that may not meet the needs of the American people as a whole. I believe that our quest to continue to make America great, should entail providing the means for workers across the spectrum to gain the skills to work and provide for their families. Having a job brings dignity and respect to the workers, while providing a means to take care of their families, and establishes a work legacy that will be followed by their children. This issue can’t be looked at as only a need for special expertise, because special expertise and intelligent comes in different forms, shapes and sizes. It cannot be measured by only one standard. There are hidden and laden abilities in the masses that can be brought to surface and utilized when we make an effort to include them. Otherwise, we are saying that only those with a certain expertise we deem important to win, are the only ones we should be concerned about. I content that we can still utilize foreign expertise and still develop our native talents and abilities. In fact, this what has made America the nation that it is. Therefore, we should first focus on developing our available work force across the labor spectrum. By focusing our attention on the available work force, through training and development initiatives, we will bring out an up surge of expertises that are lying dormant in our society. But if we pursue getting expertise from predominately foreign sources, we will stifle this great American potential and creat more poverty and lawlessness, because they will be left out of participating in a prosperous society, that they should be apart of, thus creating a lack of patriotism and and disregard for laws and policies that they do not feel they have a part in. I believe to only focus on those who have the expertise need to win will result in our losing in the long run, and furthermore it will falls short an humanitarian approach to governing for the well being of all the people. Just think, Stephen A, if you had not been given the chance to participate and showcase your abilities and expertise as a communicator, because your humble beginnings and your unknown expertise, look at what the world would be missing today!

Expanding H1B isn't a solution. Put a 50% premium tax over prevailing wage in companies wanting to use the program. 200k H1B now costs the company 300k. See how quick companies will suddenly find that there is plenty of American talent to fill 95% of the roles currently take by H1B.

I am an American citizen, a former legal immigrant and I am a Trump voter. I work for an engineering company. A lot of immigrants there. The problem is the Americans don't favor engineering much when choosing a career. Make engineering great again (😉) for the Americans and we will need way less foreigners.

Same here...legal immigrant but working in the FinTech industry. Most of our technical resources are from India because to be quite frank, they are far more skilled than their American counterparts. It means we clearly have a gap in our college education curriculum. People upset about H1B, but it definitely fills a gap that some clearly don't know about.

I agree but there should be a balance and percentage of H1B visas released...there is the issue pf pay of illegals vs the standard pay (cheaper), there is the issue of national security and double agents (didn't the feds just arrest a Chinese gentleman who was here on that same visa who'd overstayed the visa and found to be selling IT technology and military weapons tech info to Kim Yung?) overstay of visas. So there are several considerations and more discussion on this topic.

The problem isn’t that companies are seeking the .1 percent. It’s that along with the .1 percent, several very large companies are actively pursuing the top 25 percent through the same h1-b program. That 24.9 percent is being hired at ~70% of American average wages for the same positions. I don’t know if these companies are required to provide health insurance or other benefits as well. There’s also the issue that a couple of these companies appear to be Indian companies seeking h1-b visas for Indian nationals 🤔 I don’t know if that’s nepotism, work ethic, culture, wage advantage, or some other influence, but it is worth looking at.

If India has “top talent,” it’s not reflected in their GDP as a nation or per capita gdp. Which is only $4800/year. This so-called “top talent” hasn’t produced or invented anything that the world needs or uses. So, Musk and Ramaswamy can “talk” all they want about their so called “top talent” but the numbers in their own country speak a whole different story. India’s talent is hardly at the top.

The Problem with H1B visas is that it is being abused to bring in High Skilled Cheap labor and not bring in indispensable highly skilled Employees the .1% of the best engineers in the world. The number of Visas for this program need to be very highly restricted perhaps no more than 10k a year for the entire country. The Visa should have expiration of 2 years and renewed upon assumption that we still need those employees. No more than 20K engineers allowed at any one point. Having a very high Visa amount without limits only suppress wages.

I disagree with an expansion of the H1b visa program at this time. If we are talking about the top .01%, you should be able to accomplish under the current program however there have been extensive layoffs within the tech industry during the last couple of years. For every job open, there are hundreds of qualified applicants. For the most part, our American workers are competitive to their foreign counterparts, especially taking into consideration they have attended the same universities. If you want to bring in more workers, start by bringing back jobs you’ve outsourced to other countries.
