My ex opened a credit card using my electronic signature and social without telling me. I cancelled the card once I found out. I reported the fraud to the credit bureau and the feds. If it happens again I will report it to the local Sheriff department and face our children's wrath. Sadly they will likely take his side even though it is identity theft on his part.

State game warden going to NC and two deer mounts he claimed were poached in WV. One was taken legally from there the other was a legal buck from NC. No warrant . Reason? People from that county were PO that someone from out of state took a trophy buck from their county. A man was sleeping on his coach at 5Am. State SWAT team busted into the home and shot him multiple times on the couch . They say he came after them with a hammer . The cushions on the couch are soaked in blood and there's also a pool of blood under the couch. They were after his uncle . They didn't have a no knock warrant and it wasn't for a violent crime. State police in WV don't wear cameras but, the command does. Figure that one out. The corruption is endless . Steve did a story on the family court judge who broke into a house and search it illegally

I caught my boss using my signature without my permission once. I am a licensed Professional Engineer and the documents were related to safety systems for an industrial plant that handled hazardous materials. I ended up being fired because I make a big stink about it. Lesson learned, you need to be a team player when your engineering company is engaging in fraud.

I worked with a girl when I was in HS. She was a couple years ahead of me. She told me she forged her parents name on all school documents throughout HS, until the last semester, when she submitted something with her mother’s signature on it. She was called to the office and accused of forging her mother’s signature on that last document.

When I tried to have my mother sign a notarized document in the hospital, she was too weak to sign without aid, so the notary refused. In old genealogical documents from French Canada & France, the last lines are "read to the [parties], since they didn't know how to sign [their name]. If I have to sign for a friend to pick up medicines, I sign as "my name for their name", so it is apparent who picked up the prescription.

If you suspect someone is signing documents with your name and for whatever reason you can't stop it and can't quit. Then start doing something to all docs you sign that they don't know about. This makes it trackable which docs you signed vs them. Like you could add a special char somewhere or add a space into header/footer etc.. just something to tag the docs so if your in court later you can prove with some certainly what docs you signed vs didn't. PDF sigs require password but you could always sign them around 00 seconds on the minute, since they have a timestamp

My best signature story. Back in the 1980’s, Jerry Pournelle was recommending me for an editor’s job, and he asked Robert Heinlein to recommend me as well. Which he agreed to, sight unseen. So, we were all at a convention. Jerry decided that since Heinlein was going to recommend me, I should at least meet him. So, we found him next to a dealer’s table, Jerry introduced us, then rushed off to do something else. A few minutes later, a young man came up to us looking for an autograph. I assumed he wanted Heinlein’s, but oddly enough, for some reason, he wanted mine. He must have figured that since I was talking to Robert Heinlein, I must be someone important. I told him that we were talking business and didn’t want to be disturbed. He went away but returned a few minutes later and again asked for my autograph. Again, I told him we did not wish to be disturbed. When he came back the third time, I just took the book from him, signed it, and handed it back without thinking. He went away happy. It wasn’t until a few minutes later that it dawned on me. That wasn’t my book. To this day, I have no idea what it was I signed.

@@christopherg2347 there is a difference between creating a document that will pass casual inspection, and a document that will pass close scrutiny. For electronic documents, to pass casual inspection all that’s needed is to spell the name more or less correctly. The meta-data is all hidden, and often all you need is for the document to pass casual inspection. To pass closer scrutiny you may need to use their login, from their computer. If all you need is to sign the document as the other party, from their computer, as their user, when they’re near it - that’s not actually a big ask in a work setting. You may have issued them the computer, their login and even installed the remote access software for legitimate support reasons.

Correct me if I am wrong, but since an attorney is an officer of the court, an attorneys signature on a court document should be an attestation to the court that the attorney has read the document and *believes* it to be true. EDIT: I use the word "attestation" here referring to ETHICS here, not law. That is, as an officer of the court in the jurisdiction where they are licensed to practice, an attorney's duty of candor to the court would suggest that their *alleged* signature would serve as an attestation to the court that they had read and understood the document under Rule 3.3. Conversely, if he/she did not sign something, as in the present case, the court would still accept their signature as true until told otherwise. If this is so, and if the attorney found out that their signature was thusly used, would not they also have the duty to notify the court under the same ethical standard of candor to the court?

In Kansas City, MO I had the Legal Aid office do this many years previous. The lawyer that represented me didn't have her signature on my documents, it was the stamped imprint of her supervisor. It came up several years later when she was now acting as a judge. I was able to get her removed from the case. She and the opposing side were so upset but it ended up good for my side.

This has been a small fear of mine for a while. That's why I use the actual digital signature option in acrobat. It's cryptographically signed, so if someone tries to falsey digitally sign my name I have some evidence that it wasn't me.Especially since I exclusively use it for all my E-signed documents.

I'm fairly sure that wouldn't actually count as being a crime- or a forgery, for that matter. If he told you to sign his own name, that means that he directly gave you permission to authorize things in his name. A signature is intended to act as a sign of authorization. Giving your 'stamp of approval', so to speak. at 6:15, Steve addresses that a signature written by someone else can be considered a signature, if it's done with the person's permission, and at their direction. Since your boss told you to, that is giving his direction, which also implies his permission to do so. If he told you to sign for him in his absence, giving you authorization and direction, then that should count as a valid signature, thus making it not a forgery.

The act of using the window as a light table to make a facsimile of his signature is in fact a forgery. But as it was fully confessed to the Prez/CEO, it went. (And full disclosure, this sort of thing happened a lot on internal approval docs; but never on submitted government docs).

I have been in the chain of submissions to be processed, such as invoices and change orders on projects. These were not in my sphere of influence (had no say in what occurred), however I was the only one at this level of signature which was required to be processed. The person who was responsible, a senior VP, wouldn’t sign it (for whatever reason). I checked with legal and was advised to sign it with the stipulation (on the same line), “signature is for corporate policy, and is not an authorization or concurrence as to the action”. Surprisingly (actually it wasn’t), the signature was never challenged not some of the dubious invoices and change orders that came through.

There is potential in data forensics to determine the original terminal. Digital signing: in computer security success the 80s had involved using your personal public/private key pair to encrypt usually your name, date and time of creation at the end of the document text. If I process using my private key (never to be shared) then only my public key (usually filed in a public database, in business cards, and personal websites.) Thus verifying and validating that I did sign and process this document.

Electronic signatures shouldn't even be allowed, the whole point of a signature was to be able to pinpoint that signature to the individual because each person has a specific where they signed things. Anything of that importance should be hand-signed no ifs ands or buts.

If this is true everyone who signed those documents without the persons permission should automatically be disbarred and criminal charges be filed for forging government and court documents

Aside from the "automatically" part, I am tempted to agree. Forgery has civil and criminal implications for an ordinary person, and ethical implications for attorneys. Steve used the term "fraud upon the court" (if you blinked, you might have missed it!). The attorney who submitted the forged document has essentially corrupted the judicial process, and done so in violation of their oath as an attorney to be honest to the court, as well as in violation of criminal law. As officers of the court, attorneys hold a position of special trust with the court. Thus, when they deceive the court, they should be held to a higher standard of accountability, not a lesser one. To your argument (and in support of it), if an attorney forges a document and is not prosecuted, who should be? And if they violate their oath of ethics and are held accountable, what is the purpose of their oaths of conduct?

It was a electronic signature I think also ...the court isn't checking to see if signatures match without being prompted so yah it be easy to prove in the end if it's WAY off but wouldn't stop it from happening

If someone "signs" someone else's name, it is forgery. Isn't it? I can also see charges of (I can never remember which is which) libel or slander. Whichever is on paper, not vocal.

You may not remember that Kim Fox was the prosecutor who went after that couple who brandished weapons on their own property when a mob stormed their private neighborhood - the entire neighborhood, including streets, being gated and private with no public property anywhere.

What was the threat? A mob didn't "storm" their neighborhood. They walked on a private street . That's just trespassing . I didn't go running out with a gun when the MAGA truckers marched by my house

I’m pretty sure if I file documents to the court and put in attorneys information on there as a signature, I’d be charged with forgery, or falsifying documents, or maybe even identity theft. It sounds like it’s illegal. So the people who are doing it need to be disbarred and charged.

In the military, a digital signature is not valid unless it includes the signer's digital certificate, which requires their ID card and PIN. I got the state of Oklahoma to accept our digital signatures on our military tag affidavits (military gets discounted tags in OK). The stupid tag agency wouldn't accept it and required me to put a wet signature over a printed copy with the digital signature. As if a scribble is "more secure"?

In the navy we had a procedure for this kind of thing. It happened alot where you had to sign for someone else with their knowledge and consent. You'd write For: (sign their name) By: (sign your name). Clerks did it for the captain all the time since it was part of their job to file his paperwork. And I signed as my department head every now and then in logs for various reasons, always after getting permission. But it let us track if it was signed by someone else to keep n the record straight, and you had better be ready to explain why you signed.

That is simply fraud, and should be prosecuted to the greatest extent possible under the law. There is zero excuse for this kind of activity. Those "executive actors" must be prosecuted and jailed. Somehow, a host of people who get in public office as "administrators" seem to feel they get to do anything they want, as if there are no laws. That person should be prosecuted to the fullest extent of the law.

When I signed a contract recently agreeing to pay over 100K$ for goods for my government I had to insert a chip card and provide a password stored only on the card to prove it was me before it would electronically sign it, that system is over 10 years old on the software side. It's not that hard to find a system like this.

What kind of system are they using that other attorneys even have access to others E signatures? Not to go too far into my job but part of it is submitting decisions to the Federal Register & in any given year I may submit about 200 give or take. Each time I have to add my digital signature & enter a code that only I know so there’s no way that I could ever use someone else’s signature nor could they use mine. If it’s that easy to use anyone’s signature then how can you trust anything that comes out of that office.

I was wondering about that. I could be wrong, but it was my impression that when a case is NPed, prosecutors only have a limited amount of time to revive the charge. What are the implications, however, if the NP was never a valid court document in the first place?
