I thought defendant was gonna win this one but that recording changed the verdict. He clearly agreed to pay for the repairs even if he didn't technically want to. The way he stumbled over his words when confronted with the recording just shows it.

I think you're right. The Defendant said that the plaintiff rented to Pit Bull owners in the past, that would break through the fence into his backyard...so they've had issues before.

I think the defendant really lost his cool when this slumlord tried to charge him for his labor. I mean good god the guy reused most of the pickets. Suing for 400+ when the cost of materials was 200.. this guy was just looking for someone to pay to fix his rental property for him

Yes the plaintiffs labor costs were rather high, as if he was a professional fence installer which he is not. But the defendant did verbally agree to pay based on the recording. The defendant wasn't expecting the plaintiff to bring those verbal "receipts"!!!😮

I’d rather keep my neighbors on my side of the fence- and put my pride and $100 ego to the side. We spend $100 on gas, at Costco, feeding the wildlife, etc.$100 isn’t worth a broken neighborly relationship.

I watch a British Barrister on KZbin talk about the law and he said suing on principle rarely leads to a happy outcome even if you win. I assume because if you are only doing it on principle the money doesn't matter and you will have invested all that time and effort so you probably still won't be satisfied, like these 2 won't be. Principles are fine to have but you need to weigh up the financial cost against your time and mental health whilst dealing with it.

@ColoradoMilk I know that, but these are picked out from actual court submissions. So they were quite prepared to go to their local court over this! I assume that like in the UK there is also a fee to pay to lodge a claim. So again I refer you to the barristers advice that 'it's the principle' claims rarely leave anybody happy. Yes they got a trip, all by themselves and put up in a hotel and then flown back home. It's not like they get to go sightseeing. I suppose in the US because you don't get proper holidays from work a trip like that might seem exciting, but this side of the pond where people get a legal minimum of 20 days leave a year plus the 8 Bank Holiday days a trip to us means going abroad or holidaying in another part of the country. Having to use your holiday days on something like this would not qualify as fun.

Plantiff crazy. We have same type wood fencing, whoever the fence belongs to they repair. I've had to get my side replaced and other neighbors the same who's connected.

That was fair. If you want to save money by doing the work yourself then you can’t make up a labor amount for your neighbor to pay. The defendant built new fencing on two sides, it stands to reason he would like new fencing on the third side. My guess is the plaintiff said no to the cost and that is when the defendant told him to go ahead and repair at as cheap a cost as he wanted. I believe he told home to turn the repair costs into home owner’s insurance. Wonder if maybe the plaintiff did not have insurance that covered storm damage on outside structures.

Four hundred dollars to fix 3 boards that were damaged was too much. I get why the defendant would deny agreeing to pay (half) to a plaintiff who was trying to rip him off. If the defendant had paid the two hundred, plaintiff would have repaired the fence, something that he was going to do anyway (labour), without forking out any money for materials.

He does appear like he hates his job. Then he was upset that JJ didn't invite him back on her new show. He said he never knew why she didn't ask him back. Maybe his sour attitude and he seemed like he resents having to retrieve documents and/or evidence from litigates and hand them to JJ. Appeared to be an easy job. Maybe he felt this job was beneath him and needed something more inline with his knowledge and law enforcement career.

I didn't believe plaintiff completely from the start.. something abt his body language and eye movements that tell me he was lying about money.... defendant looked sane but after the audio recording.. he is just a silent guy who looks like a good honest guy but can lie easily without anyone knowing lol... plaintiff is like me... I get caught easily if I lie lol
