Right?! I mean I would assume that anyone who wanted to get away with this stuff would be using a burner phone with no sim with an always on vpn to access the leaker account. For like 200 bucks this would never happen. This is basic opsec. Of course I wouldn't ever bother leaking most of the bs he did. NDAs are important to prevent corporate espionage, and unless your leak is important to the public good, (like prism or something like Facebook app recording with the app closed) it really isn't acceptable. These types of leaks just mean that gaming companies will be less able to get community feedback early in the development cycle. Literally just makes gaming worse for everyone.

If I remember correctly, there was a bigger tech company that, to fight leaks, would distribute the same memos but in just so slightly altered versions. E.g. just very subtle changes in punctuation or spelling. Nobody would notice, but they could then narrow it down further.

i dont think he was committing a crime, as NDAs are civil law. These companies have to use NDAs in order to be able to show they have taken steps to protect their intellectual property, witch is required if you want to copywrite it. The companies should be protected enough in this matter just by having the NDAs in place but it can cause hell of a headache for them if they have to track down and follow up on people misusing this information. the Allen guy would be liable for that cost.

Every gamedev company gets NDAs broken from time to time, it's sometimes easy especially when you hire freelancing companies like 99.9% of AAA companies these days - it leads to lines of subcontractors where you might not even broken your own NDA but your contractor NDA. It's mostly a tool to get people in the industry marked as untrustworthy publicly.

To touch on the verbal countract thing "if you say yes to this thing, that is a contract and is still binding." Yeah, absolutely. You just don't usually hear about it because its a much more difficult to prove that this consent and agreement actually took place. But, if you can, it absolutely counts. It's like if you verbally made a contract on facebook market place "Im selling a $40 calculator do you want to buy this?" "Yes I do." "Great, do you want to meet at my house?" "sure." "Okay bring cash, come alone, drive up in a blue car and if you don't then you agree to pay $60." "Sounds good. Be there soon." And then you don't show up in a blue car and instead ask to pay by sending Paypal funds, now you're obligated to pay $60. There might be more nitty gritty complications with that example, but, you get the point. If you 2 parties agree to do something, it can be binding.

Depends on the extent of that breach. One can reasonably be charged for committing a criminal offense by leaking internal documents stored on private servers. The access to those private servers is predicated on signing the NDA, so breaching that NDA would automatically revoke any rights to accessing those private servers. If someone at Ubisoft were to publish actual documentation held on those servers, the breach of the NDA would also constitute a criminal offense, even if the breach of contract isn't itself a criminal offense. This is why, unless you're a lawyer arguing in court, the difference really doesn't matter. They can easily require the viewing to be on company held servers and computers and make the contract null and void upon ANY breach of any of the other contracts. This would allow him to get away with the first leak, but would make every other leak an unauthorized access of their computers. The law is generally broad enough that snooping through someone else's computer left unlocked is also considered a crime.

Only about 10 mins in, but there's nothing good about breaking NDAs. I've had to sign NDAs that last virtually indefinitely until the info comes out officially. Clout is very cool though; I can't deny it. I know the info about upcoming movies, games, collabs etc but I know exactly how a company could come after me. I would love to tell Twitter about a game adaptation in development but can't. The urge to fight those likes is really tough lol. Entertainment companies get serious about it-- I know someone who was a talent agent assistant and told someone about the financing of a movie that was already 2+ years old. Because she "leaked" information about a movie that was already out, not only was she fired her name spread through the industry, and she couldn't get another job in industry. They didn't sue her (though they technically could have) but basically got rid of her.

I genuinely don't get the appeal for breaking NDA. Especially today when it feels like fans are primarily angry at people for breaking NDA. But to me as a fan and as a business person, I cannot fathom breaking an NDA. From a business standpoint, it's helpful and good business to be in good standing so I can obtain early codes, review codes, and ask questions directly to the PR / developers. It's wise to keep those relationships healthy. From a fan standpoint, I'm excited to play some of my most anticipated and hyped games early. Getting to see it and experience it sooner than later is a beautiful and treasured privilege.

Something to also mention about NDA law. If an NDA is signed over an action that in itself is illegal, then the NDA is actually non-binding and is void. An example from a real crime I researched: A serial rapist forced his victims to sign NDAs and threatened to sue them if they ever spoke out. This was not a high profile case, it was actually a story that broke out in a small city. He was only caught by one woman finally speaking out. I think the reports were somewhere between 5-10 known victims of the guy too. It's been years since I researched this, but if you are ever forced to sign an NDA check to see if the contractor is actually just trying to hide a crime committed against you, because you cant be sued over breaking an illegal NDA.

Like leaking the name of a game, well you can't prove people suddenly never bought the game because they found out the name too early so no they can't really sue at all. Well they can but it gets thrown out. The better way to make an example is to limit information for a short while and to make it extremely known that its because of the leaks. Way more impact.

Here, we are only talking about breaching MNDAs and NDAs. The issue of leaking Trade Secrets depends on whether it was done for commercial gain and what state it took place in. This is a separate issue than breaching an NDA. Your MNDAs will not list trade secrets or terms like that, but will instead use the term “Confidential Information” and will keep it generally broad to better protect your info.

I knew a bunch of GM's back then that worked in the Austin office. And my videos ended up on a bunch of gaming articles back in 07. Yea I regret ever doing that but back then I was a edgy kid who didn't care that I put all my friends jobs at risk by doing that. But meh now im old and I would never do such things.

We had a raiding guild in wrath to we down full heroic ICC before the full nerf was in. A guild full of GM's and family members and friends of GM's. We where all on a list of people who knew them so we where always watched in the game to make sure we didnt "expose" them or do bad stuff like gold buying and stuff like that. We got tons of gifts from the GM's they got for blizzard. Like 1 year long sub cards. the blizzard bear. and the murlock suite. All of which I still have on my main, well minus the 1 year of game time that ran out a while ago. But I ended up quitting being friends with them after I got into a fight with one of the GM's who happen to be my best friends brother about how he treated his wife. Every night after work he would get drunk during raid and call her horrid names and sometimes when I was over I seen him hit her. So I stood up to him and yea. Ruined friendships. Lets just say a lot of GM's aren't the nice people you think they are. It's a cut throat job where people are always going for a new tier at the job and will backstab anyone to get it. And he got fired for what i told the rest of them and in the end I was left with zero friends. So I rebuilt in a new friend group. But yea. Thats how it all went down.

If I did something like that, I would have a dedicated desktop computer in a specific location for the "undercover" account and ONLY use that computer to post on that account. That way you never accidentally forget to switch accounts. ;)

NDA is an acronym for Non Disclosure Agreement, so yeah if he just sat on it he woulda be fine. Anyone who goes to these exclusive events and sign NDAs are agreeing to staying quiet on things.

@@fredko4293 Could he have gotten away with it if he was quiet? Probably not. He didn't do a great job covering his tracks and he antagonized people who's job it is to investigate stuff, ie Jason Schrier. Say what you will about him but the man knows how to investigate and perform journalism. Not to mention some companies go out of their way to put little things in pre release events to identify who is leaking stuff. Unique watermarks on images and videos mostly. Dan Allen comes off as someone who got hooked on the thrill and attention, and people like that usually slip up at some point.

I’ve played a good bit of the alpha/beta and it’s VERY CLEAR from the very beginning that sharing any in-game information is illegal as fuck. The game is very good, and this dude needs to get his ass sued. It’s worth the wait, trust.
