Yes Right to remain in the community was upheld in Mansur Ali vs T. Mansur Ali . The Right to remain in community or to remain as member of the community and exercise the privilege of being in the community . So expulsion from the caste will qualify for case of suit of civil nature

Expulsion means making somebody leave a place or an institution. Expulsion of caste is not a civil right, because Section 9 of cpc tells us that right to remain in a community is civil in nature. It is also said in the case of Mansur Ali Vs Mhd.Ali.

The question asked by you is having no jurisdiction to any civil court becouse of there principle questions is related to cast and no such questions will be dealt with civil court if their respective core questions having any relation other than property. And in the same no other questions is on follow on other than expulsion of a person from the cast so here it's the main question which is "cast".

But if you observe,the rights differ from caste to caste.If any upper casted person is wrongfully expelled to a lower caste then he can not exercise all the rights as he was allowed to exercise previously.So it's a violation of religious right. It provides limitations on him newly.How you will explain it?
