Generally statement given by accused to police during the course of investigation under sec 161 crpc can not be used against him even if it is confessional in nature but the catch is if that statement of accused disclose altogether a new fact it would be said there is a discovery of new fact for example accused confessed that only he who committed the murder by gun and i have hidden my gun in the backyard of my farm and subsequently there is discovery of that gun from his farm backyard hence the gun which is recovered would be held relevant under section 27 of indian evidence act though in aforementioned statement he said he killed the person B but as it is a confession in front of police and same is expressly prohibited to be addimissibal in court of law read section 25 and 26 but if u read section 27 it saying provided which means it is a proviso carving out an exception to section 25 and 26 which says that generally statement of accused which is of confessional nature would not be taken into consideration but if there is a discovery then the material recovered during discovery panchnama would be held liable under section 27 of IEA
