So, kids, a jury of 12 folks picked from a pool of 200 sat through several weeks of testimony and presentation of documents, paid close attention by all accounts, and found Trump guilty. Just because Trump says he did nothing wrong, just because you happen to not like him being held accountable, just because he is a candidate for public office are not adequate reasons to ignore the law and the finding of the jury.

Smith is not constitutionally appointed. Every thing he’s done is null and void. The DC judge didn’t even make a record on the case. They are reversing on that basis too. Bailey out of MO is suing NY for the gag order. It’s unconstitutional. Will they take it. That is the question. Sometimes they refuse cases that are so politically charged. No, what makes the hush money case eligible is the evidence Bragg used to prosecute the case. The evidence used was dated after Trump was elected president starting in February of 2017. Trump claimed executive privilege on that evidence . Now that there is some presidential immunity involved that evidence may no longer be admissible. It may be thrown out. Then Bragg would have to start over. The problem was that Bragg and Merchan were so quick to get a conviction that they didn't wait to see what the SC immunity ruling would be.

The AG Missouri case against NY State is about far more than violation of 1st Amendment Rights. Because potential sentencing on the 34 felony counts could include imprisonment, home arrest, or probation that restricts travel, all of which would impact on Trump's ability to campaign in Missouri, the lawsuit against NY could also raise issues with violations of Trump's 14th Amendment right re selective prosecution and equal treatment under the law, 5th Amendment right to due process and to know the charges he was tried under, and 6th Amendment right to an impartial jury. This case could potentially be a fast-track to the Supreme Court overturning the entire case without having to go through an appeals process through the NY state courts first. If that NY trial judge sees the writing on the wall, he may choose to dismiss the case before it can be overturned.

I believe he will declare a mistrial. It's a much more graceful outcome for the judge than being reversed for due process violations. As for Missouri's suit, it is strictly about the 1st Amendment. They can't sue because Trump's rights were violated, only their own. The 1st Amendment isn't only the right to speak, but also the right to hear. This is how Missourians have standing.

Second they are loathe to intervene in the usual appeal process. And in fact since the sentence has not yet been pronounced, the judge could conceivably set aside the jury's verdict (fat chance I know) so an appeal would be unnecessary. Stranger things have happened, and I'd be truly surprised if even stranger things DON'T happen between now and the election!

Trump will not serve even one day in prison and will not be a "convicted felon". Trump is NOT "above the law". Presidential immunity IS THE LAW. The JUDGE is not above the law. The case will be declared a mistrial. The verdict will be vacated. The Judge messed it up by allowing inappropriate evidence and testimony to be presented over defense objections of immunity. He should have waited for the SCOTUS decision before starting the trial. 🤷♂ Haste makes waste!
