Super Injunctions. How do you get one? And what even are injunctions anyway?

It was blowing a hoolie today. My brain froze. So all the info is there, but you might have to put it in the right order yourselves.
But should be all you need to apply for an injunction; super or otherwise.

We have all heard about the "super Injunction" about Archies's birth and I have wondered just how that could work. Thank you for explaining this. My question is, If Archie is in the LOS, why isn't his birth and all facts concerning it an open record for the people of the UK to see. These facts should be above board and not hidden, in my opinion.

Agree...Super Injunctions should not be issued as a gag order to cover up high treason. Otherwise, why not issue super injunctions as a gag order to witnesses in a murder trial. Well, there is more than one way to skin a cat....DNA is forever, whether old Megs gave birth isn't a matter of debate, and not even the King can sanction fraud in the LOS. The public has a right to transparency, and legitimacy in the LOS.

I recently came across an interview with Ian Hislop where he talked about super injunctions. Apparently Private Eye got into trouble at one point for publishing something, unfortunately for the complainant the notice hadn't been sent to the magazine unlike the rest of the mainstream press. Oops :)

@seymourclearly The children are styled as Prince and Princess. They are on the line of succession to the British Monarchy. The British public has a right to legitimate birth certificates and proof of birth from the body. If they don't want to give that information fine. Take away titles and remove them from LOS. If there are any children, I feel so sorry for them. Not fussed if I see them or not.

I can't help feeling that court orders and injunctions only work if the subject of the order respects the law, funnily enough there are a significant number of people out there who do not and because they don't respect the law they run rings around lawful authorities who have to follow procedures.

Future video? When your proerty falls into the sea (I live on the suffolk/norfolk border) your land is lost. The local council seem to own the new beach and the crown the high to low water line. However, sometimes one person's property loss results in other beaches zooming out into the sea - does the land owner get this land, when their property gets further from the sea?

You mentioned blackmail. I've never understood how reporting an offence of blackmail works. If you report that you're being blackmailed aren't you basically going to the police and confessing that you've committed a crime.

Blackmail suggests the victim can be made to feel shame or embarrassment over some action/behaviour or that some questionable action/behaviour would cause social/pecuniary censure. Its not necessarily because it is wrong or illegal.

What's the difference between an Injunction and a Restraining Order? Also, what are the consequences for breaking a Super-Injunction?

Restraining order is just a colloquial term for an injunction that prevents you harassing someone. Breaching an injunction is a contempt of court. So usual penalties. Fine or custody.

If in an employment contract it says something like "When you leave employment you cannot work for anyone in the same market" or similar. Is this generally enforceable as presumably this is unenforceable due to the human rights legislation?

£332 in the County Court. £569 in the High Court. There may also be a hearing fee subject to how things proceed.

Could you do a video about Warwick hunts, special protocol ? Please. I do not understand how it is meant to work. IF it is secret and members of the public do not about it how are they meant to report any breaches to the police? I'd literally only heard of that today. Interestingly our local chief constable is the main guy on hunt liaison; and he was very disparaging about it. But yeah, soon as I saw that thought it might be a good topic. Ill just have to behave myself and try and keep my objectivity.

Usually injunctions are "Until further order". So they run until and unless someone is able to successfully apply to set them aside. Although some do have time limits from the start. Say to enforce a 'no competition' clause; the injunction would only run for the relevant period.

A good few years ago a similar idiot tailgated me on the M5 Southbound when I was literally driving home for Christmas. The Nissan Skyline was in such a hurry, flashing him lights etc that he didn't notice the car i was passing was a fully liveried police car. They usually last "until further order". That is to say, indefinitely. But the Respondent can always apply to set it aside; if for example circumstances change.

I'm not sure if it'll make a good video bit I'm currently reading the Law report for Batty v Attorney General for Northern Ireland on Westlaw & Lexis but struggling to pick out the ratio decidendi. Is there an easy way to spot the ratio in long judgments? Also, when there are 5 judges are all 5 ratios applicable if they all find differently?
