I managed to track down (and spend WAY too much on) a VHS copy of this back in the early '00s when all that existed of this was a few screenshots, and people still weren't sure if it might have been a parody or an adult film. I've since been collecting anything I can find related to it. I'd be happy to share any scans of materials you might not have found yet for bonus material!

I don't see Nintendo copyright claiming this movie in particular. Mostly because from what I know the company that funded and created this movie, Grouper Productions, went out of business sometime in the early 90s. It's pretty much the main reason why this film never got a DVD release and remained a pretty rare film. Nintendo might own still have the rights to to this movie. But considering that the likes of the Kirby anime and F-Zero anime that Nintendo were heavily involved in got proper home releases and sometimes actually do get copyright claimed when they're uploaded to KZbin, it's probably a case similar to the Sonic OVA where they're not interested in rereleasing it. Then again with KZbin's busted copyright system, you'll never know.

while this movie isn't perfect, you gotta remember that this movie was made during a time when the mario lore was much simpler and only the original mario bros and a handful of ports were what they had to work with and imo it nails it beautifully.
