The Supreme Court heard arguments Wednesday in a trademark case involving whiskey maker Jack Daniel's. The company is suing Arizona-based VIP Products over a poop-themed dog toy called Bad Spaniels that parodies Jack Daniel's signature bottle.

If the Supreme Court hands down an adverse judgment against the defendant on this a whole bunch of people are going to go down and get sued. Even they don't want to have to deal with all that.😅

Even the most conservative Supreme Court do not have the big bull balls to pass down judgement against this defendant. They just simply don't. And the reason why is because a whole bunch of small businesses will get sued. Because parody is a small business effort. You don't see big corporations getting involved in parody.😅

We're having a conversation about design trademarking. You need to trademark and copyright the design. It's the same thing colleges do. There's a lot of organizations that will create and invent their own font and then trade market.

This is an amazing public relations coup for Jack Daniels! Free advertising for its products via the United States Supreme Court. How many of us have access to such a forum, a forum which will generate publicly available documentation about Jack Daniels indexed in US government archives?

I could buy a Nike shirt then take it to the shop and put just poop it on there. And people could confuse that and think Nike manufactured that shirt. Which is entirely stupid regardless whether they did or not. You cannot punish people for parody. It's a part of American capitalism.

At the end of the day if I put my Blood Sweat and Tears and years into a product and somebody turned it into dog food and was on the open market😅😅 selling it I will probably be really angry about it. But it is American capitalism. It is freedom of speech. It's an open market. If you start restricting these sorts of things people are going to start copywriting and trademarking Designs. You won't be able to put a circle on a t-shirt without somebody trying to sue you.

They do not have a leg to stand on. It's a freaking dog toy. Nobody's going to say oh Jack Daniels got into the😊 toy business. And if Jack feel so strongly about it by the company and fire every last one of them and burn those things in the garbage bin. And make a big show of it. KZbinr send you a check bigger than what you paid for the company LOL

No, that is not a possible point. The dog toy company is riding the coattails of the beverage company through name and appearance recognition in order to sell its product.
