If the 2nd is not clear enough, there needs to be a constitutional amendment that will charge any politician, or anyone who is an employee of any agency who knowingly attempts to infringe on any constitutional amendment will be charged criminally, up to life in prison, and a substantial fine!

@JdubbJdubb. That *statute* already exists, USC 18 §241- conspiracy against rights. Section 241 makes it unlawful for two or more persons to agree to injure, threaten, or intimidate a person in the United States in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States or because of his or her having exercised such a right. Unlike most conspiracy statutes, §241 does not require, as an element, the commission of an overt act. The offense is always a felony, even if the underlying conduct would not, on its own, establish a felony violation of another criminal civil rights statute.

It's legal to not pay taxes for three years. If collectively everyone in the country doesn't pay their taxes for three years (which is legal) in a silent protest it will cripple big government. It will send a clear message. They will have to limit the government to the bare minimum.

Since the Court has adjudicated that the actions of these agencies are in violation of the law, and have violated the rights of the American people, what is the remedy? Fine? Prison terms? Both? There are very real damages, and people who were hired to PROTECT our rights did just the opposite. They violated our rights, and they need to pay a penalty for that.

There's a positive aspect to getting rid of Chevron. Federal agencies will no longer need staff, lawyers sitting in the basement figuring out new rules. Federal Budgets can be cut drastically 😂 since the creation of laws are created in congress. We can cut budgets by billions.

I know this is a gun channel and is about the ATF overreach, but One of the first lawsuits about this same type of agency overreach was against the EPA. They were making rules to act like laws by any means in the name of the environment. I hope people understand how good this decision really is as a whole and how dangerous things were becoming.

Chevron Deference was literally an abjuration of the courts responsibilities. The checks and balances ideal of our Constitutional republic cannot work without the checks, and that is the role of the courts. It's about time they accepted their responsibilities.

Thanks for the video. What wasn't touched on is that for decades now, whenever a statue or rule was involved in a lawsuit, Chevron was the agencies defense, and part of that defense included the agency essentially saying "take it up with Congress for passing a vague law". When Congress is approached for the same matter, their response has always been "take it up with the Agency for the unelected bureaucrats implementing rules and statutes that were not the intent of the law". Now, finally, Congress will have to do the job we elected them for. They will have to pass well defined, unambiguous laws and to do this, it will have to have the approval of the House, the Senate, and the President. Agencies will no longer be able to implement new laws under the false premise of rules and statutes without facing legal challenges they know they will lose. Now...what does this change right now? Nothing. Until each and every one of these illegal rules and statutes are litigated, or until Congress gets off its lazy ass and defines their vague laws, it will be a long, slow uphill battle to remove this unelected power from agencies. The only people that benefit during this process are attorneys. We the people, will continue to pay for the agencies defense of these upcoming lawsuits.

This goes well beyond federal bureaucracy. It is ruled on the basis that bureaucracy cannot be trusted to point the direction legally on constitutional issues. So in essence, this has removed all state and local government power to use deference in making laws that are federal court jurisdiction...like anything that has to do with the 5th amendment and the 2nd amendment, etc...

The Main problem is that none of these Agencies were created to make laws; Any Regulations that they impose carry the force of law so therefore all of them should have to go to congress in a bill and be decided there; The framers and until the Communist FDR came into power never intended these agencies to make laws only to carry out the day to day function;

The EPA has been a problem for me. There is a low spot in a 40 acre corn field that is wet spring and fall, for a couple of weeks. This field has been cultivated since the 1800's. A few decades back they marched in and declared a half acre in the middle of the field a wet land. I pay taxes on it but I am forbidden to work it. Of course the cotton wood trees grew like weeds in the fertile , cultivated soil reaching 80 feet high. The Federal Court has refused to hear an appeal citing Chevron. Given this ruling I will be demanding that they remove the wet land designation.

chevron deference seems to replicate the concept in England that the opinion of the Crown takes priority over the citizen

For all intents and purposes, it was. What chevron did was create an automatic assumption in law that the government is always right. That's why overturning it was so important.

I think you are right, it's like flipping them off like the lower courts and other state legislatures have taken to doing like new york keeps coming back with more obviously unconstitutional new laws

All executive branch agencies will, to some extent, ignore and test the limits of this decision. But this give the people more power to challenge that and end it when it occurs via the courts.

This is truly great news. It naturally always takes me back to my original baseline questions; which are a) how in the hell do such obvious absurdities such as Chevron ever take hold? By definition it is so obviously ridiculous. It’s saying - if something isn’t clear - just let the agency (govt) interpret it like it “wants”, which is of course at the core, antithetical to the constitution which is in essence, a limiting entity to what the govt “thinks” vs what is defined as “rights inalienable to citizens”. So again - how is this allowed!? Then it hangs around for decades?? B) how is it every liberal justice rules in opposition to the basic constructs of the constitution? The Constitution just isn’t THAT complicated. And it doesn’t define the Constitution as an “outline” of what may be “right or wrong”, further subject to interpretation of (once again) govt. I’ll have to read the dissent to see the logic. What did the liberal justices say? “Well if we get rid of Chevron, then govt agencies will have a harder time ruling against the Constitutions main constructs so we should leave it in place so agencies such as xyz can just run ramshod over the citizens without accountability !?!?!” I mean hell is that what they’re saying?? Cause that’s what they mean!!
