This is just a delay tactic, probably to benefit Trump in the election. After they grabbed the case before it had been finalized by the 9th Circuit appellate court (which they refused to do, initially in the Jack Smith Jan 6 case) some of the justices then realized that they were be issuing a ruling this term, before the election, and it would not be politically popular because it would uphold the Idaho statute which will force more at risk, pregnant women to be airlifted from Idaho to other states. So they said "oops", we made a mistake by improvidently and prematurely granting review in the Supreme Court--best to send it back down to the district and appellate courts to let it play out through the normal process. With the idea that then once concluded and conveniently after the election, they will take it up again, or a case with similar facts, and rule on it without it politically blowing up in the faces of Republicans just before the election. Note that four of the justices wanted to resolve the case here and now: three of the conservatives (Thomas, Alito and Gorsuch), and one of the liberals (Jackson, who would have ruled the Idaho law was preempted by federal medicare). But three of the conservatives, Roberts, Kavanaugh and Barrett, thought it best they kick this can down the road and let the game fully play out as it should have from the beginning, thus not handing Trump and Republicans a political disaster right now. The two other liberals (Sotomayor and Kagan) went along with kicking it down the road, maybe because it provides some relief for women in Idaho right now, and maybe in hopes they can talk Barrett and the Chief Justice or Kavanaugh to agree with them when it comes up again.

If SCOTUS is admitting they never should have taken the case, then at the very least they are responsible for that harm and owe those women a HUGE apology. The removal and then reinstatement of the stay wasn't just some quirky legal mishap, of academic interest only. Real lives were affected.

Women's lives (which include health) are at risk. And it's not merely regarding abortion. All reproductive health is involved, as -are issues of things like divorce (where they want to take away "no-fault" divorce which is essential for women in abusive marriages.) These are not "slippery-slope" problems (since the "slippery-slope" arguments are fallacies) but what we've seen happen repeatedly in other countries when they start trying to control reproductive medicine. And we also have Project 2025 and statements from people like Judge Thomas who has said we should revisit issues such as Oberfell, Griswold, and Lawrence to know what they have planned for the future of our country.

You can’t switch from state court to federal court its two different derestriction a case can’t be tried and convicted in a state court then when one party loses they go directly to the supreme court for answers without even going to the state appeal court in that particular state. The supreme court had no jurisdiction over this case and should never have been involved in this case.

What doesn't make logical sense to me is allowing for abortion in the case of rape or incest as kind of an "of course" attitude, while not allowing for abortion in other things such as how far along the pregnancy is etc. If the Right is saying that abortion is killing an innocent child, how that child was conceived should have nothing to do with it. It really ruins the whole argument of abortion being wrong because it's murder. Murder is murder, no matter who you murder. Saying it's okay to abort a child born of rape or incest, but not okay otherwise, is actually pretty judgemental of the mother. It implies that if the mother chose to have sex, you can't kill that baby; but if the mother didn't chose to have sex, you can kill that baby. It's shame based, not logic based.
