And until about 23 weeks gestation the chances of surviving outside of the womb are pretty much zilch. Most terminations happen well before that. doesn't matter. the initial decision by the texas court was profoundly stupid anyway. ofc the FDA had authority to approve it, ofc the drug is safe, and ofc the FDA was correct in approving it. what's more, even if the FDA approval was revoked, the drug would still be available. they couldn't actually ban its use, worst case scenario the FDA would simply give it emergency approval as it went through the approval process again. it was a stupid lawsuit, the supreme court realized there was no way to keep the ban.

The courts are supposed to determine law, not medicine practices. Even a liberal Supreme Court would have taken this case. The district court (aka the trial court) enjoined the FDA’s approval of mifepristone, effectively taking it off the market. The 5th Circuit Court of Appeals then heard the case and ruled that only some of the FDA’s approval decisions were unlawful, which still allowed mifepristone to be available but with more restrictions. If the Supreme Court hadn’t taken this case, those restrictions would remain in place.

The problem is that while plaintiff has no standing to challenge the FDA, congress does. Congress gave the FDA the power to make these decisions and congress can take that power away if the gop gain control. Vote Blue!

Because of no standing. All it takes is to not be an election year and finding someone who has standing. Remember that the GOP blocked a bill to insure the federal right to access and obtain contraception just a couple weeks ago and the GOP governor of Virginia vetoed a similar bill at the state level just a couple weeks before that. And remember that the GOP blocked a Supreme Court ethics bill just this week.

They did not rule that it can stay on the market. This is incorrect and misleading. They simply rejected this attempt at its removal. Do better with your reporting. It has the effect of keeping it on the market for now but does not mean they made a ruling to keep it on the market.
