the issue is in what areas/aspects they're trying to apply the trademark. taylor only trademarks titles and lyrics in the context of merchandise and stuff like that, so people can't sell knockoffs with her face/work on them and even then, stuff like that is rarely followed through, she's not gonna sue someone on redbubble for selling a mouse pad of her 1989 album cover but she might do it if a big corporation did it.

thats definitely not how it works, or what he meant by that. he’s saying no other social media business can use the name “face” in the name of their corporation/business name, or he can take them to court & sue for a shit ton of more money even more so than normal because he got it trademarked, if he didnt do the trademark but he wouldnt have gotten as much money as he would with the trademark having been granted to him & now is in place.

It should be clarified that the trademarks are very specific in which they own it. Octomom owns it for anything related to corporate branding. The football player has the pose only related to NFL merchandising and branding. Zuccc Zucchini only has "face" in relation to social media branding no one else can use "face" so we can't see myface Or realface as social media platforms. The "let's play" as to why it was rejected is because it's a widely used phrasing in the gaming industry. It would be the equivalent of a car company trying to trademark "let's drive". I honestly think this person is being a little dishonest in his presentation cuz he's making it sound like you as a private person cannot but you can use any and all of these things you're not going to get sued by these people as long as you aren't trying to turn a profit in their industry.

Copyright law is all about context. Take "Just a kid from Akron" for example. Every NBA fan in the world knows that phrase is associated with Lebron James. Now imagine if someone started selling "Just a kid from Akron" t shirts or with a similar phrase and started making a bunch of money off his image without giving him a dime. Or what if they do something more nefarious and they start a fake "Just a kid from Akron" charity and stole donations from Lebron's actual charity.

Trademarks are not like copyright. You can only get one if your brand has establish value in something already. So Facebook can tm face because they have argued that anyone else using "face" for a social media app would unfairly benefit from the value they have created in the term. Edit: I was somewhat wrong about this. Trademarks are protections of a brand rather than a product. They can be acquired before some value is established but they must be uniquely identifiable with a brand to the exclusion of other similar brands.

That's not how this works. Facebook owns the word face in social media apps so people can't make knock offs like "FaceBlue" or "FaceBrook". Sony tried owning Let's Play for video games meaning they were asking for the right to be able to use that term in their starting screen which is very unfair since a lot of other games and devices have "Let's Play" when they start the game or device.

Trademarking a color doesn’t mean no one else can use it, it means no one can use it in a similar fashion that might make consumers think they are associated with your brand. If i start a car company and use a specific shade of blue that becomes a very recognizable part of the brand then i can trademark it and claim that a new car company using the exact same color is an infringement of trademark

Context for the Facebook one - it only applies to telecommunication companies. (FaceTime excluded, I believe Apple got it sorted out and got “Facetime” trademarked, so the “Face” claim wouldn’t interfere.)
